RE: APPROVE PETITION FOR ABATEMENT OR REFUND OF TAXES FOR 2003 - EYE
CENTER OF NORTHERN COLORADO, PC
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County, State of Colorado, at a
duly and lawfully called regular meeting held on the 27th day of September,2004, at which meeting
there were present the following members: Chair Robert D. Masden, and Commissioners M. J.
Geile, William H. Jerke, and Glenn Vaad, with Commissioner David E. Long being excused, and
WHEREAS, notice of such meeting and an opportunity to be present has been given to the
taxpayer and the Assessor of said County, and said Assessor, Stan Sessions, being represented
by Mike Sampson, and taxpayer Eye Center of Northern Colorado, PC, not being present, and
WHEREAS, the Board of County Commissioners have carefully considered the attached
petition, and are fully advised in relation thereto.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado,that the Board concurs with the recommendation of the assessor and the petition
be and hereby is, approved, and an abatement or refund be allowed as follows:

RE: Possessory Interest Assessment WELD COUNTY ASSESSOR
Dear Taxpayer, GREELEY, COLORADO
In May of 2003, Poudre Valley Hospital requested that the Weld County Assessor assign
a possessory interest assessment to all tenants leasing space in Windsor Medical Center
located at 1455 Main Street, Windsor. This request was made with the belief that the
State of Colorado would grant a 100% tax exemption to the Windsor Medical Center for
the year 2003. That is not what transpired. The State ruled that there is no possessory
interest, and required the Weld County Assessor to classify the Windsor Medical Center
as 84% taxable (the leased space) and 16% exempt (the space occupied by the owner) for
the year 2003. Consequently, the leased space is doubled assessed. Therefore we have
enclosed a completed petition for abatement or refund which will allow the County
Treasury to refund any 2003 taxes paid on your possessory interest tax bill. Please sign
and return the petition to the Assessor's Office in the self addressed envelope provided.
We apologize for any inconvenience this may have caused and hope this will conclude
this matter.
