Re: Regent Broadcasting of Fort Collins (USR-1057)
Dear Chairman Masden:
On March 17, 2004 at the public hearing for the above referenced USR, I did state
to the Commissioners and on the record that Regent Broadcasting would continue to make
best efforts to enter into an Operating Agreement with Fox Television. I also stated that
I would continue to keep the County Attorney's Office and the Board of Commissioners
advised as to the status of any negotiations.
On March 2, 2004 Regent Broadcasting did submit to counsel for Fox a proposed
Operating Agreement. Next, on March 12, 2004, Regent again contacted Fox requesting
a response to the March 2nd letter and proposal. A copy of the March 2nd letter and
proposed Operating Agreement,and the March 12`h e-mail communication were submitted
as evidence at the March 171h hearing.
Subsequent to the March 17`h hearing, another e-mail was forwarded on March 19,
2004 from Regent to Fox (copy attached) again requesting a response to the March 2nd
proposal. As of the date of this letter, Regent has received no response nor
communication from Fox regarding the proposed Agreement.

Dear Mr. Keneipp, as you know I have tried to speak with you concerning the above matter, but you
have not returned my call or e-mail message to you. In the hearing before the Weld County
Commissioners held on March 17, 2004 it has been reported to me that your local counsel made
statements to the effect that unless the Commissioners denied or delayed the decision, Regent would act
in bad faith and not pursue any further discussions or negotiations with Fox as to an Operating
Agreement. This is not the case.
Regent continues to believe that a fair and concise Operating Agreement would be of mutual benefit to
both parties. As you may recall, on March 2, 2004 I forwarded to you a second revised draft of a
proposed Operating Agreement which did incorporate most of your comments and concerns. I have not
received any response from you with respect to this agreement despite my attempts to talk with you
concerning this agreement.
Please contact me so we can discuss this matter.
