INTERGOVERNMENTAL AGREEMENT FOR COOPERATIVE
MOSQUITO MANAGEMENT PROGRAM
THIS INTERGOVERNMENTAL AGREEMENT is made and entered into effective as of the
1s' day of January, 2004, A.D. between the COUNTY OF WELD, a political subdivision of the
STATE OF COLORADO, whose address is 915 10th Street, P. O. Box 758, Greeley, CO 80632,
hereinafter referred to as"Weld County,"and the TOWN OF FIRESTONE,a municipal corporation
of the STATE OF COLORADO, with its principal office located at 151 Grant Avenue, P.O. Box
100, Firestone, CO 80520, hereinafter referred to as "Municipality."
WITNESSETH:
WHEREAS, in order to effectively deal with the continuing threat of mosquito borne
transmission of West Nile Virus,Weld County has contracted with Colorado Mosquito Control,Inc.,
("Company")for Integrated Mosquito Management("IMM")services within certain areas of Weld
County,Colorado,during the year 2004,including within an approximately 1 mile area surrounding
Municipality, and
WHEREAS, said IMM services are detailed in a document entitled, "Bid No. B0200268
Weld County Cooperative Mosquito Control Services 2003, Colorado Mosquito Control, Inc.
(Contract),"and
WHEREAS, Municipality intends to perform those IMM services detailed in the attached
Exhibit"A"within its boundaries during the year 2004, and
WHEREAS,Weld County and Municipality now desire to enter into this Intergovernmental
Agreement so as to memorialize their agreement with respect to their respective roles and
responsibilities regarding the provision of IMM services in and around Municipality during the year
2004.
NOW, THEREFORE, in consideration of the mutual promises and covenants contained
herein, the parties hereto agree as follows:
1. PROVISION OF IMM SERVICES BY COMPANY WITHIN AN
APPROXIMATELY 1 MILE AREA SURROUNDING MUNICIPALITY:Upon the
signing of this Intergovernmental Agreement by both parties hereto, Weld County
shall direct Company to perform,during the year 2004,the IMM services set forth in
Contract within an approximately 1 mile area surrounding Municipality, to be paid
for exclusively by Weld County.

2. AGREEMENT BY MUNICIPALITY TO PERFORM IMM SERVICES WITHIN
ITS BOUNDARIES: In consideration of Weld County paying for and directing
Company to perform during the year 2004 the IMM services set forth in Contract
within an approximately 1 mile area surrounding Municipality,Municipality agrees
to perform within its boundaries those IMM services detailed in the Exhibit A.
3. TERM: The term of this Intergovernmental Agreement shall be from January 1,
2004,to and until December 31, 2004.
4. ENTIRE AGREEMENT: This writing constitutes the entire Intergovernmental
Agreement between the parties hereto with respect to the subject matter herein,and
shall be binding upon said parties,their officers,employees, agents and assigns and
shall inure to the benefit of the respective survivors,heirs,personal representatives,
successors and assigns of said parties.
5. NO WAIVER OF IMMUNITY: No portion of this Intergovernmental Agreement
shall be deemed to constitute a waiver of any immunities the parties or their officers
or employees may possess, nor shall any portion of this Intergovernmental
Agreement be deemed to have created a duty of care which did not previously exist
with respect to any person not a party to this Intergovernmental Agreement.
6. NO THIRD PARTY BENEFICIARY ENFORCEMENT: It is expressly understood
and agreed that the enforcement of the terms and conditions of this Intergovernmental
Agreement, and all rights of action relating to such enforcement, shall be strictly
reserved to the undersigned parties and nothing in this Intergovernmental Agreement
shall give or allow any claim or right of action whatsoever by any other person not
included in this Intergovernmental Agreement. It is the express intention of the
undersigned parties that any entity other than the undersigned parties receiving
services or benefits under this Intergovernmental Agreement shall be an incidental
beneficiary only.
Wherefore, the parties have signed this Agreement on the date set forth adjacent to their

Source Reduction—Source reduction is the alteration or elimination of
mosquito larval breeding habitat. This remains the most effective and
economical method of providing long-term mosquito control.
A. Sanitation
1. Municipality will strive to ensure proper disposal of trash,
unused tires, and other containers that can provide breeding
habitat for mosquitoes.
II. Mosquito Surveillance & Control- Effective mosquito control begins with
a sustained, consistent surveillance program that targets pests and vector
species, identifies and maps their immature habitats by season, and documents
the need for control.
A. Larval-Larval surveillance&control targets the immature stages at the
breeding habitat before adult populations have had a chance to disperse
and to maintain populations at levels at which the risk of arbovirus
transmission is minimal.
1. Municipality will conduct weekly larva sampling from known
larval habitats & conduct systematic surveillance for new
sources.
2. Municipality will provide Weld County Department of Public
Health& Environment (WCDPHE) a detailed map that indicates
the area in which larval surveillance &control activities will be
conducted.
3. Municipality will apply larvicide based on surveillance data
using products appropriate for habitat, with equipment properly
calibrated and at label dosage rates in compliance with the
United States (U.S.) Environmental Protection Agency(E.P.A).
4. WCDPHE will provide training for larval surveillance&control.
B. Adult- Adult surveillance & control is an important component of any
Integrated Mosquito Management (IMM)program. Control should be
based on surveillance & application of adulticide timed to coincide with
activity period of target mosquito species.
1. Municipality will set mosquito traps to monitor species presence
and relative abundance of adult mosquitoes.
2. Municipality will set mosquito traps using standard and
consistent surveillance methods on a schedule coordinated with
WCDPHE.
3. Municipality will facilitate delivery of mosquitoes with
WCDPHE.
4. WCDPHE will provide two to three CDC Light traps per
Municipality for surveillance use during the 2004 mosquito
season.
5. WCDPHE will provide mosquito identification and virus
surveillance as needed.
6. WCDPHE will consult with Municipality regarding surveillance
& control "zones"
7. Municipality&/or mosquito control contractor will apply
adulticide products using appropriately calibrated equipment and
according to U.S. E.P.A label dosage rates.
8. Adult control will be considered if CDC Light trap counts are
above 100 female mosquitoes per night.
