WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 23rd day of November, 1983 , at the hour of 2 : 00 o' clock p.m. in the Chambers of the Board for the purpose of hearing the application of Interstate Broadcasting System, Inc. , 2150 West 29th Avenue, Denver, Colorado 80211, for a Use by Special Review for three (3) radio towers on the following de- scribed real estate, to-wit: Part of the NWa, Section 30, Township 1 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS , Section 24. 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the re- quest of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence pre- sented in this matter, and having been fully informed, finds that this request shall be approved for the following reasons : 1. The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24. 4. 2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Weld County Comprehensive Plan and is consistent with the in- tent of the Agricultural Zone District in that the use does not constitute an interference with agricultural activites. The use is compatible with existing agricultural activity. b. The applicant has complied with the Weld County Zoning Ordinance Section 50 Overlay District Regu- lations . Staff has reviewed the applicant' s Flood Hazard Overlay District Development Permit and found it to comply with the regulations as set forth in Section 50. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the application for a Use by Special Review for three (3) radio towers on the herein- above described parcel of land be, and hereby is, granted sub- ject to the following conditions : 1. The attached Standards for Use by Special Review be adopted. 2 . The plat for the Use by Special Review Permit be placed of record by the Department of Planning Ser- vices staff prior to any building permits being issued on the site. The type of use shall be a broadcasting transmitter facility and three radio towers as described in the submitted applciation material on file in the office of Department of Planning Services. The proposed use shall include the following structures: - Three guyed towers; - Three small tower buildings at each tower base; - One transmitter building; A six (6) foot cyclone fence shall surround the transmitter facility and the guy wires; 2. The proposal shall comply with the design standards for Uses by Special Review, Section 24.5, et seq. , of the Weld County Zoning Ordinance. 3. The proposal shall comply with the Operations Standards for Uses by Special Review, Section 24.6, et seq. , of the Weld County Zoning Ordinance. 4. The Use by Special Review shall be limited to the plans shown hereon and governed by the Standards stated above and all applicable Weld County regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the Office of the Department of Planning Services. 5. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Commissioners. The following business was transacted: I hereby certify that pursuant to a notice dated October 24, 1983, and duly published November 3, 1983, in the LaSalle Leader, a public hearing was held November 16, 1983, for the purpose of considering the application for a Use by Special Review, .three radio towers; for Interstate Broadcasting System, Inc. The hearing was continued to November 23, 1983, to allow the posting of the property. Lee Morrison, Assistant County Attorney, read this proposal into the record. Jim Mayerl, representing the Planning Department, explained the request and presented the favorable recommendation submitted by the Planning Commission. Mr. Tom Moller, General Manager for Interstate Broadcasting System, Inc. , informed the Board that they plan to upgrade their existing facility by adding two additional towers. There will be three towers in total; 265 feet high; with lights. After discussion, Commissioner N. Carlson roved to approve this request with the conditions and Operation Standards. The proposal calls for the erection of three towers with three small tower buildings and one transmitter building. The following statements and documents will detail exactly the proposal and will demonstrate compliance with the standards of the Weld County Zoning ordinance. 1.a. KLTT (formerly KBRN) has leased the property referred to in exhibits A and B since 1956 for the purpose of operating and maintaining a radio broadcast transmitter and tower location. The proposal is to increase the number of towers on the property to three according to exhibit C. Three tower buildings will also be erected, one at each tower base. And a new transmitter building will replace the current transmitter building which is in need of upgrading. The proposal is consistent with the Weld County Comprehensive Plan. A radio tower has existed on the site since 1956. The proposal continues this existence, with exactly the same uses for the property as previously. The addition of two more towers will occupy a total of only .09% of the land involved, including three towers, three 6 'x10' tower buildings, and one 20'x20' transmitter building. The remainder of the land will continue to be available for grazing, as has been the case since 1956. 1.b. The tower construction is consistent with the intent of the district in which the use is located. This is demonstrated by both the present use of the subject property (as a tower/transmitter site for the past 27 years) and the use of surrounding land. Since the proposed use is the same as has been the case in the past, and since such past use has not been in conflict with other uses in the area, the proposal will offer no conflict with other users or uses in the area. l.c. The addition of two towers will be compatible with the existing surrounding land uses . Contiguous properties are presently used for grazing or commercial purposes. A gravel mining operation is adjacent to the subject property. 1.d. The presence of the two additional towers will be compatible with the future development of the surrounding area as projected by the plans of the county or affected municipalities. Existing zoning is agricultural and the proposed development will not alter the rangeland character in the immediate area. 1 Page 2 (, Interstate Broadcasting Special Review Application 1.e. While the proposal does lie within a Flood Hazard Overlay District, the applicant has complied with all regulations concerning development of the area. An application for a Flood Hazard Development Permit is attached to and incorporated in this application. 1.f. The proposed use is to be located in the "A" district. All efforts have been made to conserve productive agricultural land. The proposed development will make no use of the land which is any different from that to which it has been used over the past 27 years. Only .09% ( .0009) of the land will be affected by the development. Animal grazing has been a historical fact on the applicant's land and will continue to be allowed. Land surface disturbed by construction will be reseeded with grasses recommended by the Weld County Soil Conservation Service. 1.g. The health , safety, and welfare of the inhabitants of the neighborhood and the county will be secure due to the following reasons: 1) The subject property is located in a remote agricultural area with no inhabitants nearby. 2) The applicant has researched and complied with all technical specifications regarding the design and construction of the towers (see exhibit D) . 3) A fence surrounds the entire property to prevent unauthorized access. 4) The towers will be properly grounded. 5) The guy wires will be grounded and surrounded by fencing. 6) The towers will be obstruction marked and lighted in compliance with FAA Advisory Circular 70/7460-1, Chapters 3,4,5 and 9. In accordance with FAA aeronautical study number AWM-507-OE, the towers will not be a hazard to air navigation. The towers will be lighted in accordance with FAA specifications . On April 25, 1983, KLTT engineering consultants Edward F. Lorentz and Associates filed a completed FAA Form 7460-1, a copy of which is attached hereto and incorporated herein. (Exhibit E) Page 3 Interstate Broadcasting Special Review Application 5. a. As previously mentioned, the proposed operation represents a continuation of the use already being undertaken, and for that matter, undertaken since 1956. It consists of the transmission of radio broadcasting signals through the presence and use of transmitting and control equipment and three towers on the site. The use involves primarily equipment and not personnel . The proposed operation will upgrade the equipment currently in place by enabling KLTT to increase the power of the transmitter from 500 to 1000 watts and by improving the signal southward by increasing the number of broadcast towers from one to three. The operation will make use of the same property as previously, thereby changing nothing as it relates to proximity to surrounding uses and residential structures . With the exception of two more towers on the site accompanied by one more small 6' x10' scructure at the base of each tower, no change in activity or physical plant will be discernible to the neighbors. The current 12.2'x14.2' transmitter building will be replaced by a new 20'x20' transmitter building with exactly the same use: to house the transmitters , and other necessary radio equipment. 5.b. The nearest residential structures to the proposed operation are mobile homes which are located across the highway approximately one-half mile from the subject property. 5. c. Also as before, the number of employees regularly working at the site will be minimal . The increased power will not result in increased engineering activity. Usually, one employee at a time will be at the site. One who will do routine maintenance work approximately 5 hours a week, mostly at night when the station is off the air. . And one who will play taped programs approximately 5 hours a day weekdays during the early morning hours. The only other work would be in the event of an equipment failure, which of course is an unscheduled event and might require the work of two employees at a given time. All this is precisely what is presently occuring in the way of activity at the site. X r Page 4 Interstate Broadcasting Special Review Application 5.d. The KLTT main offices are located in Denver at 2150 W. 29th Avenue with the station' s public file located in Brighton at 637 bridge Street. There will be no public access to the transmitter site. Few KLTT staff people will require access to the site. Depending on the delineation of duties, at the most there will be only three different employees who will have duties at the site, and rarely will there be more than one of those employees there at a time. This proposal represents no change from what is presently taking place. 5.e. Cattle and horses have grazed on the land in the past. They will continue to do so under the proposed operation, thus assuring the essential agricultural use of the land is not altered; nor would it be hampered in any way by the proposal . All buildings , towers, and guy wires will continue to be fenced off as before, assuring the safety of grazing livestock and assuring the continued free access to the property for agricultural uses. (See Muller Engineering recommendations, attached hereto. ) 5.f. Three structures are presently on the site: a tower, a small equipment structure at the base of the tower, and a transmitter building. The proposed development will add two additional towers , each 265 feet in overall height above ground level . The three towers will be spaced 256 feet apart on a line bearing 40 degrees east of True North. The towers will be insulated guyed, uniform triangular cross-section structures with three guy anchors per tower. They will be mounted on a 3-foot concrete base foundation and obstruction marked and lighted as required by the FAA. (See Exhibit C. ) A ground system comprised of #10 AWG copper wire and copper wire grid screen will be placed around each tower within specified limits and buried 6 to 8 inches beneath the surface. A small all weather shelter (6'x10' ) will be constructed near the base of each tower to house impedance matching components . The current equipment building at the base of the tower will be replaced as will the current transmitter building. 5.9. Access to the site will be on the current one-lane gravel country road which is secured by a locked gate at the entrance by the main road. Vehicular traffic will consist of one passenger car or one pickup truck at a time under scheduled circumstances listed in 5.c. above. • I Page 5 Interstate Broadcasting Special Review Application 5.h. Ron Stowe of the Weld County Health Department indicated there are no specific toilet requirements that cover our proposed situation, but recommended a chemical toilet be secured to meet the needs of the employees. Accordingly, we will equip the transmitter building with a chemical toilet to be serviced by a chemical toilet company who will co-ordinate waste disposal through the chief engineer so that such disposal coincides with times a station employee is scheduled to be on the site. 5. i . Because of the minimal use of the site there will be no external stockpile, storage, or waste areas utilized. 5.j. Waste disposal needs will be minimal consisting primarily of expired tubes and other electronic equipment. The chief engineer will remove any such items after performing his weekly routine maintenance. 5. k. Once the appropriate permits have been granted by Weld County and the Federal Communications Commission, a typical construction time (including conducting engineering field tests, adjustments, and proofs of performance) is six to nine months. The actual erection of the towers and buildings will take less than two weeks. The bulk of the time consists of engineering studies. 5. 1 . No additional landscaping plans are presently contemplated. The agricultural nature of the property makes such plans unnecessary. • 5.m. Very little of the construction will disturb the land. The buildings will be elevated on piers or friction piles to position the floors above the 100 year flood level , and the towers will not affect areas other than where they enter the ground and where the guy wires are tied. What little area that will be cleared during construction will be reseeded after consulting with the Weld County Soil Conservation Service. 5.n. The subject property is located in the Brighton Fire District approximately six miles from Station number 1. The fire inspector, Doug Kraft, has been contacted to inspect the property. In addition, a fire extinguisher especially designed for electrical fires is available at the transmitter building for emergency use. There is a telephone in the building for emergency phone calls to the fire department. X Page 6 Interstate Broadcasting Special Review Application 6. The "Use by Special Review Permit Plan Map" and all other requisite features are included in the Flood Hazard Investigation report prepared by Muller Engineering Co. , Inc. , attached hereto with the application for a Floodplain Development Permit. Twelve copies of the map are also included herein. 7. Supporting Documents: a. ) Exhibits A and B are a lease to the subject property and a letter from the property owner indicating KLTT is a successor in interest to the lease. b. ) As mentioned previously, the facility will involve very little human use. No water will be required to run or maintain the facility. A water cooler from Brighton Culligan is supplied and will be supplied under this proposal to meet the needs of the few employees who will work there. This amenity was suggested by Ron Stowe of the Weld County Health Department. c. ) See "a. " above. d. ) The necessity for a noise report has been waived by the Department of Planning Services . e. ) A soil report of the site is entered as Exhibit F, prepared by Goodson and Associates , Inc. , consulting engineers. Interstate Broadcasting System of Colorado, Inc. will erect the towers and buildings according to the recommendations of Muller Engineering Co. , Inc. , elevating and fencing the facilities as recommended. Plans for each structure will be submitted to the builing department based on soil reports submitted hereto, on the Muller Engineering report, on the specifications of the tower and building manufacturers , and on the recommendations of Edward F. Lorentz and Associates , consulting radio engineers. Completion of the project is subject to the approval of the Federal Communications Commission before whom Interstate Broadcasting has an application pending which is expected to be favorably acted upon around the first part of 1984.
