This letter is intended to provide a response to the issues raised from various referral agencies. Also, attached is our Change of Zone submittal, which we feel addresses the various concerns raised through the Minor Subdivision Sketch Plan review. North Weld County Water District(NWCWD) A water extension agreement has been submitted to and has been approved by the Weld County Attorney's Office. Windsor—Severance Fire Protection District(WSFPD) A meeting was held with Mike Davis of WSFRP on September 8, 2003 to review his comments. This project will be able to conform to the requirements of WSFPD as outlined. Weld County RE4 School District A meeting was held with Brian Lessman of Weld County RE4 School District on September 3, 2003 to address his comments. An agreement has been provided with this submittal which addresses the Districts concerns. A bus turnout will be required at the entrance to this project along the west side of County Road 21. r Mr. Ken Ogle, Planner III Weld County Planning Offices September 15, 2003 r ` Page Two Ault,CO Postmaster A meeting was held with Lana Cozad, Ault Postmaster, on September 5, 2003. It was verified that the project is within the Ault, CO service area. A turnout for postal delivery will be required along the east side of County Road 21. Weld County Department of Health and Environment Irrigation improvements have been shown on the site plan. Water service commitment information has been provided to the Department. The large lots being proposed will allow for the requested setbacks and delineation of two locations per lot for absorption fields. Weld County Department of Public Works Additional information has been provided by the Department of Public Works dated September 8, 2003. Included with this submittal is a summary of flood plain and geohydraulic information. Water Supply and Storage Company A field review was conducted with Fred Walker on July 26, 2003 to address his concerns. An agreement was completed and is attached with this submittal. Colorado Geological Survey Additional information relating to groundwater depth has been provided. It is agreed that site specific design should be completed for all buildings. West Greeley Soil Conservation District(WGSCD) The WGSCD provided soil information identical to information shown on the Sketch Plan submittal and prepared by Church and Associates, Inc. WGSCD expressed no concerns. Colorado State Engineer Additional information including a water supply information sheet and commitment letters have been provided to the State Engineer. Please see information provided with the Change of Zone submittal. We agree with these comments. Town of Severance A meeting was held on July 23, 2003 with Amelia Tuttle, Severance Planner, to discuss this project. This project is outside of the Severance Growth Management Area and the Town of Severance has no concerns with the proposed project. Weld County Sheriff The Weld County Sheriff has no concerns with this project Colorado Division of Wildlife(CDOW) No response has been provided by the CDOW. Engineering Cc: Charles Meserlian Black Hollow Estates Minor Subdivision Change of Zone Questionnaire Section 23.2-50.E .3 Black Hollow Estates is proposing to change the existing Agricultural Zone (A)to an Estate Zone (E). The change is initiated to convert the existing unused agricultural parcel to a residential use. The residential use is intended to maintain the rural character of the area by proposing large (7 acre ±) lots. The lots would encourage the utilization of existing irrigation facilities, large animal use and small scale "farming"to maintain adequate ground cover. The proposed site has NO restrictions because of geology, flood plain, overlay districts, intergovernmental agreements or mineral extraction. Transportation, irrigation, gas, telephone, electric, and water providers currently have systems adjacent to the property although a short segment of watermain will need to be extended to the site. School, law enforcement, ambulance, fire prevention, and mail delivery services are also available in this area. The low density of this property does NOT create a negative impact on these services. All improvements will be designed, constructed and financed by the land owner. The proposed HOA will provide critical maintenance and management of the fencing, irrigation system, and transportation system including snow removal, grading and weed control. While this project does not provide opportunities for multi-family or affordable housing, it is located in an area with excellent existing services. The rural character and low density being proposed will create minimal impacts for service providers. The creation of a Homeowner's Association will provide an excellent mechanism for maintaining developer provided improvements,thus eliminating financial impacts to Weld County. .4 Black Hollow Estates is proposing a Change of Zone from Agricultural (A) to Estate (E) Zoning. The parcel has not been a productive agricultural tract for several years. The creation of large lot residential uses allowing large animals is consistent with uses adjacent to this property to the north and south. .5 The proposed use for Black Hollow Estates will be residential. The large tracts created by this project will maintain existing land forms and irrigation improvements indicative of the area. It is anticipated that this type of residential development will appeal to large animal owners who are now part of the rural community. .6 Water service for Black Hollow Estates will be provided by the North Weld County Water District (NWCWD). NWCWD will provide both domestic and fire flows via a water main extension proposed in Weld County Road 84. A commitment to serve this area and an agreement outlining water extensions and associated fees have been provided by NWCWD. Sanitary Sewer will be provided by Individual Sewage Disposals Systems (ISDS) constructed for each lot A preliminary percolation report prepared by Church and Associates, Inc. indicates that conditions are favorable for this type of sewage disposal. .8 Access for Black Hollow Estates will be provided by Weld County Road 21. The traffic generated from the nine lots will have minimal impact on Weld County Road 21. Weld County Road 21 is classified as a local roadway, currently has an aggregate surface and is capable of facilitating the proposed traffic. .9 Based on the geological report prepared by Church and Associates, Inc., sand, gravel and other mineral resources do not exist within the project boundary. There is NO mining or extraction activity currently located on the property. Pam Smith, Weld County Department of Health and Environment BLACK HOLLOW ESTATES MK-1039 SUMMARY OF GROUNDWATER AND GEOTECHNICAL ISSUES Black Hollow Estates is proposed as a nine lot residential subdivision located on an 80.0 acre parcel at the southwest corner of Weld County Road 84 and Weld County Road 21. The lots will typically be seven (7) acres except for one fifteen (15) acre lot at the west side of the project The design and implementation of Black Hollow Estates is based on geotechnical data, interviews with previous owners, interviews with ditch company representatives and several field investigations. As a result of this information,we have implemented the following criteria: 1. NO overlot grading will be completed. All land forms will be preserved except for the construction of Black Hollow Court within the proposed right-of-way. 2. All structures will be kept a minimum of 250'from the Larimer County Canal. 3. All irrigation systems will remain undisturbed. Appropriate setbacks are provided to all headgates and laterals. 4. Two locations are provided for absorption fields on each lot. The lots are large enough to accommodate two 100'X 100'locations. In addition several items will be implemented during the building construction phase to ensure code compliant residential structures as follows: 1. Building elevations will be set to minimize the depth of basement excavation. 2. Perimeter underdrains will be provided for each foundation. 3. A separate geotechnical evaluation, foundation design and open hole inspection will be completed for each proposed residence. 4. Lot grading details for each structure will ensure that surface runoff will not create a problem for the construction and will not contribute to groundwater flows. There are several other issues which mitigate groundwater, geotechnical, surface runoff, and septic system concerns as follows: 1. The conversion of historically irrigated agricultural property to residential use typically results in a more efficient application of irrigation water and a general receding of groundwater depths. 2. An underdrain system adjacent to the Larimer County Canal was installed to minimize groundwater migration from the larger ditch. 3. The development of an on-site drainage system will provide an efficient way of conveying storm runoff from the site. 4. The larger lots provide ample room for placement of structures and placement of absorption beds. 5. The irrigation pond and associated swales, berms and irrigation laterals at the west end of the site have been incorporated into one large premium lot. This was completed to allow these improvements to be protected and undisturbed by proposed development. 6. Test holes indicate that the highest groundwater elevation is 8.5' from the surface. These groundwater depths, as determined from the detailed geotechnical testing, will not impact foundations or septic systems. 7. The attached floodplain map shows that there are no major drainage conveyances which would impact this property. 8. There appear to be no particular concerns relating to swell or shrink of on-site soils based on the geotechnical evaluation.
