RE: APPROVE PARTIAL VACATION OF SPECIAL REVIEW PERMIT #156 - MONFORT
FINANCE COMPANY, INC., C/O LANDPROFESSIONALS, LLC
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated July 12, 1972, the Board did approve Special Review
Permit #156 for a cattle feed lot operation for Monfort Finance Company, Inc., do
LANDPROfessionals, LLC on the following described real estate, to-wit:
Part of Section 24,Township 5 North, Range 63 West
of the 6th P.M., Weld County, Colorado
WHEREAS, the Board has received a request from Monfort Financial, do
LANDPROfessionals, LLC, 4311 Highway 66, Suite 4, Longmont, Colorado 80504, to vacate a
portion (approximately 23 acres) of said Special Review Permit#156, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present,studied the request of the applicant and the recommendations of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and,having
been fully informed, deems it advisable to approve said partial vacation, conditional upon the
following:
1. Pursuant to Section 23-2-200.G.5 of the Weld County Code, the applicant shall
submit a revised Partial Vacation Use by Special Review Plat,conforming to Section
23-2-260.D of the Weld County Code.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Special Review Permit#156 be, and hereby is, partially vacated,with the
abovementioned condition.

SUBJECT: Vacation of SUP-156
The Department of Planning Services has received the attached letter dated April 6, 2004 from
Monfort Financial c/o LANDPROfessionals, LLC Lauren Light. Ms. Light is requesting that
SUP156 for a feed lot be partially vacated. The partial vacation would include approximately
twenty-three (23) acres north of the railroad tracks as a pre-requirement for a Recorded
Exemption and Use by Special Review on the site.
Background information:
Legal Description: Part of Section 24, T5N, R63W of the 6th P.M., Weld County, CO.
Location: Approximately 1/4 mile west of County Road 61 and north of and adjacent
to the railroad; approximately % mile north of Highway 34.
SUP-156: SUP-156 was approved by the BOCC on July 12, 1972, for the relocation
of an existing cattle feed lot operation in the A (Agricultural) Zone District.
Three parcels are included in this request as illustrated on the attached map.

Parcel 3 - Parcel number 0963 24 000012
Should the Board of County Commission choose to approve the request to vacate the
approximately twenty-three (23) acres in SUP-156, Planning Staff recommends that a revised
Partial Vacation USR plat of SUP-156 be submitted as required by Section 23-2-200.G.5.

Board of County Commissioners:
Monfort Financial is the landowner for the Kuner feedlot that was approved under
SUP-156 on July 12, 1972. ICM Inc. will be applying for a special use permit for an
ethanol plant as well as a recorded exemption to create the parcel. As Monfort
Financial will be selling the land to ICM Inc. a partial vacation is required.
The vacation will incorporate 23 acres of land north of the railroad track as indicated
on the attached map. The land is not used in association with the feedlot in any
manner. All the cattle pens and structures associated with the feedlot are located south
of the railroad track. The land is not needed as a buffer for adjoining parcels as the 23
acres is contiguous to property which would still be included in the existing special
use permit.
Access to the parcel will be from an agreement with the railroad to purchase or lease
right-of-way to provide access from Weld County Road 61 to the parcel.
As the land that is proposed for vacation is not utilized in any way for the existing
feedlot the existing special use permit for the feedlot should not be required to be
reviewed. Thank you for reviewing the proposed vacation.
