WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determinted by the Board of County Commissioners at a public meeting held on the 21st day of October, 1981 in the Chambers of the Board, that the division into two parcels of land, as shown on the plat know as Recorded Exemption No. 519, being the property of Darrell and Nelva Bearson, described as part of the Southeast quarter, Section 7 , Township 2 North, Range 66 West of the 6th P.M. , Weld County, Colorado, being more particularly described as follows: Attached exhibit "A" is incorporated herein by reference. does not come within the purview of the definition of the terms, "subdivision" and "subdivided land" . pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis- sioners that the hereinabove described parcel of land owned by Darrell and Nelva Bearson be, and hereby is, exempt from the definition of the terms "subdivision" and "subdivided land" . The property is described as part of the SE4, Section 7, T2N, R66W of the 6th P.M. , Weld County, Colorado. The property is located three miles north of Fort Lupton. The property contains approximately 47 acres of Class II irrigated and Class VI nonirrigated soils. The request is to split the property into parcels of 4.4 acres more or less and 41.5 acres more or less. On August 12, 1981, the Board of County Commissioners approved a request by Mr. and Mrs. Bearson for a lot size variance so that they could make application for this recorded exemption. At the time they made the decision on that request, the Department of Planning Services staff submitted a letter of recommendation to the Board. A copy of that letter of recommendation is included in the attached packet. Nothing has been received by our office that would change our recommendation of approval for this request as outlined in the letter to the Board of County Co:xeissioners dated August 11, 1981. The property on which this request has been made is described as part of the N1, Section 7 , T2N, R66W of the 6th P.M. , Weld County, Colorado. This property is located 31 miles north of Fort Lupton, Colorado. The request is to obtain a variance from the minimum lot size requirement, Section 9-4 A. (6) so that they may make application to apply for a recorded exemption. If this lot size variance is granted, the as 's will proceed with their application for a recorded exemption to divide the property into two parcels. Mr. and Mrs. Bearson wish to create a five acre and a 37 acre parcel more or less, both of which contain existing improvements. The balance of the property will be used as a dairy operation. Based upon the information and the adopted policies in the County, the Department of Planning Service's staff recommends this request be approved for the following reasons: 1. The request is in compliance with the intent clause of the recorded exemption procedure (Section 9-2 of the Weld County Subdivision Regulations) in that the proposed use of the property will be compatible with the surrounding agricultural land uses. 2. The request is in compliance with the intent clause of the Agricultural Zone District (Section 3.3.A. of the Weld County Zoning Resolution) and the Weld County Comprehensive Plan in that the request will be encouraging agriculture and related uses to continue as the predominant land uses. 3. The request complies with Section 9-4 A. (6) of the Weld County Subdivision Regulations . It should be noted that the parcel is par i"ja ly located in the 100 year floodplain of the Platte River.
