The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
Use by Special Review, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and
requirements are as follows:
COMMENTS:
WCR 1 (County Line Road) is designated on the Weld County Road Classification Plan (FHU) as a major
arterial road, which requires a 140-foot right-of-way at full build out. There is presently a 60-foot right-of-way.
The road is NOT maintained by Weld County, but is maintained by Boulder County. Pursuant to the definition
of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is
measured from the future right-of-way line.

Existing Access: As a part of the north access, there are several parcels that share this access point. The
access point is 20 feet in width then narrows to a 10-foot concrete slab to the east properties.
REQUIREMENTS:
Future Right-of-Way: The applicant should reserve and place on the plat drawing an additional 40 feet of
future right-of-way adjacent to the front of the property for future expansion.
New Access: The proposed new and improved access point at the south edge of the property shall
accommodate two-way traffic. An adequately sized culvert will need to be placed under this access point.
Adequate turning radiuses shall match the existing asphalt on WCR 1.
Circulation and Parking: The off-street parking spaces including the access drive shall be surfaced with
asphalt or the equivalent and shall be graded to prevent drainage problems.
Each parking spaces shall be equipped with wheel guards or curb blocks where needed to prevent vehicles
from extending beyond the boundaries and from coming into contact with other vehicles, walls, fences or
plantings.
Existing Site Access: The existing driveway shall be restricted to emergency/maintenance vehicle access
only. This existing access point should be gated and kept closed.

Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent property damage of the
type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned
ponding of storm run-off. The applicant identified all storm water drainage shall be designed for on-site
detention.
Section Line: The south property line is on the section line between Sections 6 and 7, T1N, R68W. In
researching our records, Weld County is showing no claim to any reserved right-of-way between these section
points.
Notification to adjacent County: The applicant shall contact Boulder County as it has jurisdiction of this
section of WCR 1 for maintenance purposes. This will give them the opportunity to respond on the access or
any drainage issues associated with the right-of-way section.
Verification shall be provided to Planning Services and Public Works.

Environmental Health Services has reviewed this proposal for a church. We have no
objections to the proposal, however, we do recommend that the following conditions be
part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall provide current evidence that the facility has an adequate
water supply. (The applicants have submitted a water tap commitment request
to the Left Hand Water District Board. This request will be determined on
September 16, 2004).
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to issuance of building permits:
1. The septic system serving the residence/proposed church (Septic Permit #
G19930290) shall be reviewed by a Colorado Registered Professional Engineer.
The review shall consist of observation of the system and a technical review
describing the systems ability to handle the proposed hydraulic load. The review
shall be submitted to the Environmental Health Services Division of the Weld
County Department of Public Health and Environment. In the event the system is
found to be inadequately sized or constructed the system shall be brought into
compliance with current Regulations.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
5. This facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in 25-12-103 C.R.S., as amended.
6. Adequate handwashing and toilet facilities shall be provided for employees and
congregation members.
7. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
8. The facility shall utilize the existing public water supply. (Left Hand Water District)
9. The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

Site Specific Development Plan and Special Review Permit for a church in the A (agricultural zone district).
1. A building permit shall be obtained prior to the construction of any new building, addition or remodel of the
existing building..
2. A plan review is required for each building for which a building permit is required. Plans shall include a floor
plan. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans
are required when applying for each permit. Provide a Code Analysis Data sheet provided by the Weld County
Jauilding Department with each Building permit application.
3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application.
Currently the following has been adopted by Weld County: 2003 International Building Code; 2003 International
Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; and the 2002 National
Electrical Code and Chapter 29 of the Weld County Code.
4. The building will be classified as an A-3 (Church) occupancy. Occupant load will be determined at the plan
review. Occupant loads of 300 or more require additional requirements of a manual fire alarm system and an
automatic fire sprinkler system. Fire resistance of walls and openings, construction requirements, maximum
building height and allowable areas will be reviewed at the plan review. Setback and offset distances shall be
determined by the Zoning Ordinance.
5. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of
determining the maximum building size and height for various uses and types of construction and to determine
compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall be
measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset
and setback requirements. Offset and setback requirements are measured to the farthest projection from the
building.

Landscape Referral
The Department of Planning Services reviewed the above referenced Use by Special Review
Landscape Plat and offers the following comments:
The applicant shall prepare a Use by Special Review Permit Plan Map per Section 23-2-260.D
of the Weld County Code. Alternative scales shall be approved by the Department of Planning
Services.
Section 23-3-50.B and Section 23-3-50.C of the Weld County Code addresses the required
setbacks and offset bulk requirements.
The applicant did not submit a Landscape Plan in the application materials, however the
application materials indicate that the existing landscape will be retained and areas of
disturbance will be re-seeded. The application materials indicated that fencing is on-site, this
component shall be clearly delineated on the plan.
The applicant has not called out a selection of ground cover including decorative rock, mulch, or
other landscape material on the Site drawing. Future submittals shall address the type of plant
material, including surface treatment proposed for the ground plane.
Landscaping materials as indicated in the approved Landscape Plan shall be maintained at all
times. Dead or diseased plant materials shall be replaced with materials of similar quantity and
quality at the earliest possible time.
The applicant shall demonstrate how the proposed plant material will be watered, thus ensuring
• adequate growth and established of the feeder root system. Further, the applicant shall provide
evidence that a commercial well permit has been obtained prior to recording the Use by Special
Review Permit Plan Map.
The "Future Church" building delineated on the plan is approximately 2800 square feet on size.
Per Appendix 23-B of the Weld County Code, the number of off-street parking spaces required
is 1 space for every four seats of building rating. The applicant shall provide this office with
evidence that adequate parking for the proposed Church has been accommodated on the
property. Given the known information, Staff is unable to determine if the intent of the Section
23-3-320.C.3 of the Weld County Code has been met.
The new Christian Education building is approximately sixteen hundred (1600) square feet in
size. Per Appendix 23-B of the Weld County Code, the number of off-street parking spaces
required is not specifically addressed, therefore, the Department of Planning Services shall
require one space per occupant load for this facility. Therefore, the Department of Planning
Services will require the minimum number of parking spaces be installed and accessible to the
users of this facility at all times. There shall be no exception to this standard.
The Plan reviewed by this office delineates twenty-three parking spaces, with two spaces
identified as non-ambulatory spaces in the main parking area. The applicant shall provide
evidence that the number of parking spaces delineated meets the intent and requirements of
Appendix 23-B.
The applicant shall address and adhere to the American with Disabilities Act and ADA
standards for this facility at all times. Non-ambulatory/Ambulatory parking spaces shall be
identified and shown on the plat. This site will be required to meet all requirements of the
Americans with Disabilities Act. At least one space must be van accessible. A certain portion
of the structure will also be required to meet the accessibility requirements. The parking
spaces must be the closest possible to the entrance. Signing will be required. Curb cuts,
ramps and other methods of providing accessibility shall be required to reasonably attempt to
meet the requirements of this Act.
The applicant shall delineate curb stops for the parking spaces to be delineated on the Use by
Special Review Permit Plan Map. One curbs stop for each space is the standard, however, staf
will accept one curb stop for every two parking spaces if curb stop is equally spaced on parking
stripe between every two stalls.
The applicant shall demonstrate a safe and approved access. The proposed access into the
facility appears to be adequate. Points of ingress and egress to this parcel shall be clearly
identified. Appropriate language shall be included on the drawing delineating the access to this
parcel. The Department of Public Works shall be contacted in an effort to address points of
ingress and egress, as applicable. Should the .Department of Public Works not maintain this
section of County Road 1, the appropriate government entity shall review, comment and provide
written evidence of an approved access permit for this facility.
The internal circulation within the property is clearly delineated, however the ability to effectively
turn-around at the end of the easternmost parking area will require an amendment to the
parking area. The Department of Public Works shall be contacted in an effort to resolve this
situation.
The trash collection area was identified on the drawing. Areas used for storage or trash
collection shall be screened from adjacent public rights-of-way and adjacent properties. These
areas shall be designed and used in a manner that will prevent wind or animal scattered trash.
The applicant shall address the issue of on-site lighting, including security lighting if applicable.
Any lighting ... shall be designed, located and operated in such a manner as to meet the
following standards: sources of light shall be shielded so that beams or rays of light will not
shine directly onto adjacent properties.
The applicant has delineated any on-site sign. The property identification sign shall adhere to
Section 23-4-90.A and Section 23-4-90.B of the Weld County Code. One identification sign per
principal use shall be allowed, provided that the sign does not exceed sixteen (16) square feet
in area per face. Further, the location of the sign, shall be delineated on the Use by Special
Review Permit Plan Map. All structures, including signs, on site must obtain the appropriate
building permits.
The applicant shall be required to address the issue of the floodplain as delineated on the FIRM
Community Panel Map 080266 0960 D. The existing Flood Hazard Development Permit
number FHDP-383 for a barn shall be amended to include the residential structure that is
proposed to be converted from a residential structure to a structure with an occupancy load.
Building Department issues specific to foundation type and floor loading will be reviewed for
compliance with the FEMA regulations..
The application materials stated that there is an on-site well located on premises. There was
no evidence of water, specific to a commercial water tap in the referral request. It is noted that
the property is located within the 208 District Boundary for the Left Hand Water District. The
applicant shall provide evidence of adequacy of water prior to scheduling the PC Hearing.
The applicant shall provide written evidence from the Mountain View Fire Protection District
stipulating that the approved point of ingress and egress, emergency access and circulation
pattern meet the requirements of the District.
The applicant shall enter into an Improvements Agreement according to policy regarding
collateral for improvements and post adequate collateral for all transportation (access drive,
parking areas, etcetera) and non-transportation (plant materials, fencing, screening, etcetera).
The agreement and form of collateral shall be reviewed by County Staff and accepted by the
Board of County Commissioners prior to recording the USR plat.

Dear Mr. Gatlunan:
I have reviewed the submitted material pertaining to the site specific development plan and special review
permit for the Bible Baptist Church, located south of Highway 52 and east of Weld County Road 1 (Case
Number: USR-1487). The Fire District does not object to the proposal provided the requirements of the
Fire District are met. Based on my review, I have the following comments:
• It appears the building with the addition will be approximately 3,500 square foot of type V-N or type
V-B construction. The required water supply for fire protection is 1,500 gallons per minute, measured
at a residual pressure of 20 pounds per square inch. The site plan submitted did show the location of
any proposed fire hydrants. At least one will need to be provided.
• Fire appears adequate as indicated on the plans submitted. Apparatus access road shall be designed
and maintained to support the imposed loads of fire apparatus (75,000 pounds). Roads must have a
surface that provides all-weather driving capabilities at the time renovation/construction begins.
• Building construction/renovation plans and a final site plan showing the location of proposed fire
hydrant(s)must be submitted to the Fire District for review and approval before building permits may
be issued.
A final inspection of the occupancy will be required by a member of the Fire District before a
Certificate of Occupancy is issued from Weld County.
