THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS
REQUEST BE APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section 23-
2-260 of the Weld County Code.
2. It is the opinion of the Department of Planning Services'staff that the applicant has shown
compliance with Section 23-2-220 of the Weld County Code as follows:
A. Section 23-2-220.A.1 -- The proposed use is consistent with Chapter 22 and any
other applicable code provisions or ordinance in effect. Section 22-2-60 (A.Goal 4)
states, "Conservation of agricultural land to nonurban residential, commercial and
industrial uses will be accommodated when the subject site is in an area that can
support such development. Such development shall attempt to be compatible with
the region." The proposed location was established to lie outside of an existing
pivot sprinkler on land that is designated "irrigated land not prime framland" by the
USDA Soil Conservation Services. The homes adjacent to the site will be screened

by proposed landscaping planted along the property line. The proposed location
has easy accessability to existing off site oil and gas facilities.
The proposed development would be serviced by Central Weld County Water
District.
B. Section 23-2-220.A.2 -- The proposed use is consistent with the intent of the A
(Agricultural) Zone District. Currently the property is in violation (VI-0300042) for
operating a commercial trucking facility without an approved and recorded Use by
Special Review (USR). Upon approval of the USR the violation will be closed.
Section 23-3-40.A.2 and Section 23-3-40.0 of the Weld County Code provides for
oil and gas support and services and Semi-Trailer and Cargo Containers Situated
as Permanent Storage Units in the A (Agricultural) Zone District.
C. Section 23-2-220.A.3--The uses which will be permitted will be compatible with the
existing surrounding land uses. The surrounding property to the east is primarily
agricultural. The surrounding properties to the north,south and west are residential.
The development standards and conditions of approval will ensure compatibility with
adjacent properties. The Weld County Department of Public Works has also
requested that the applicants apply dust suppressant chemicals on County Road
48 between the applicant's west property line and County Road 53.
D. Section 23-2-220.A.4 -- The uses which will be permitted will be compatible with
future development of the surrounding area as permitted by the existing zoning and
with the future development as projected by Chapter 22 of the Weld County Code
�^ and any other applicable code provisions or ordinances in effect, or the adopted
Master Plans of affected municipalities. The subject property does not lie within the
three mile referral area of any municipalities.
E. Section 23-2-220.A.5 —The site does not lie within any Overlay Districts. Building
Permits issued on the Lot will be required to adhere to the fee structure of County
Wide Road Impact Program (Ordinance 2002-11).
F. Section 23-2-220.A.6--The applicant has demonstrated a diligent effort to conserve
prime agricultural land in the locational decision for the proposed use. The
proposed uses will only occupy 5 acres which have already been developed
substantially limiting its agricultural value.
G. Section 23-2-220.A.7 -- The Design Standards (Section 23-2-240, Weld County
Code), Operation Standards (Section 23-2-250, Weld County Code), Conditions
of Approval and Development Standards ensure that there are adequate provisions
for the protection of health, safety, and welfare of the inhabitants of the
neighborhood and County.

This recommendation is based, in part, upon a review of the application materials submitted by the
applicant, other relevant information regarding the request, and responses from referral entities.
The Department of Planning Services' staff recommendation for approval is conditional upon the
following:

1. Prior to scheduling a Board of County Commissioners hearing:
A. The applicant has not delineated any on-site sign(s). If any on-site sign(s) are
desired the Department of Planning Services shall be notified in writing. The signs
shall adhere to Section 23-4-90.A and .B of the Weld County Code. One
identification sign per principal use shall be allowed, provided that the sign does not
exceed sixteen (16) square feet in area per face. Further, the location of the sign,
if applicable shall be delineated on the USR plat. (Department of Planning

2. Prior to recording the plat:
A. The plat shall be labeled USR-1447 (Department of Planning Services)
B. The plat shall be amended to delineate the following:
1) The attached Development Standards. (Department of Planning Services)
2) The approved Landscape/Screening Plan. (Department of Planning
Services)
3) Any approved signage. (Department of Planning Services)
4) County Roads 48 is designated on the Road Capital Improvement Plan in
the County Wide Impact Fee Code Ordinance, Section 20-1-30 as local
gravel road, which requires 60 feet of right-of-way at full build out. There is
presently 60 feet of right-of-way. A total of 30 feet from the centerline of
County Road 48 shall be delineated right-of-way on the plat. This road is
maintained by Weld County. (Department of Public Works)
5) Lot B of RE-2820 shall use the existing residential access points as no
additional accesses shall be granted.(Department of Public Works)
C. The applicant shall submit a Landscape/Screening Plan for review and approval
which includes the following information:
1) The applicant shall demonstrate how the proposed and existing plant
material will be irrigated.
2) The applicant shall delineate on-site lighting, including security lighting if
applicable.
3) The applicant shall delineate the location of any proposed and existing plant
material. Existing shall be delineated as a circle with a dot in the middle,
proposed shall be delineated as a circle with a "+" in the middle.
4) The Landscape Plan shall indicate a site for a trash collection that is
sufficiently screened from adjacent public rights-of-way and adjacent
properties. These areas shall be designed and used in a manner that will

prevent wind or animal scattered trash.
5) All outdoor storage shall be screened. (Department of Planning Services)
D. The applicant shall submit written evidence to the Department of Public Works that
one access from County Road 48 has been closed. Evidence of such shall be
submitted to the Department of Planning Services. (Department of Public Works)
E. The applicant shall enter into an Improvements Agreement according to policy
regarding collateral for improvements and post adequate collateral for all required
materials. The agreement and form of collateral shall be reviewed by County Staff
and accepted by the Board of County Commissioners prior to recording the USR
plat. The improvements agreement will not be needed if the necessary
improvements are done to the satisfaction of the Department of Public Works and
the Department of Planning Services. (Department of Planning Services)
F. This facility, shall adhere the number of on-site parking spaces in Appendix 23-B
of the Weld County Code. The total number of on-site parking for this facility shall
be twenty (14) spaces, of which one (1) shall be a van accessible handicapped
parking stall meeting all of the requirements as set forth in the Americans with
Disabilities Act. Further, the applicant shall delineate curb stops for the parking
spaces shown on the USR plat. (Department of Planning Services)
G. The applicant shall address and adhere to the American with Disabilities Act and
ADA standards for this facility at all times. Non-ambulatory / Ambulatory parking
spaces shall be identified and shown on the plat. This site will be required to meet
all requirements of the Americans with Disabilities Act. At least one space must be
van accessible. The parking spaces must be the closest possible to the entrance.
Signing will be required. Curb cuts, ramps and other methods of providing
accessibility shall be required to reasonably attempt to meet the requirements of
this Act. Should the applicant elect to not adhere to the previously discussed
Federal Standards,this office requests that the applicant outline how their proposed
site design mitigates the requirements of the American's with Disabilities Act.

H. The applicant shall attempt to address the requirements (concerns)of the Sheriffs
Office as stated in the referral response dated September 25, 2003. Evidence of
such shall be submitted in writing to the Weld County Department of Planning
Services. (Weld County Sheriff)
The applicant shall apply for an Underground Injection Control (UIC) Class V
Injection Well permit through the Environmental Protection Agency(EPA)or provide
evidence that the applicant is not subject to the EPA Class V requirements.

J The applicant intends to connect the proposed shop/office to the septic system
currently serving the home. The septic system shall be reviewed by a Colorado
Registered Professional Engineer. The review shall consist of observation of the
system and a technical review describing the systems ability to handle the proposed

hydraulic load. The review shall be submitted to the Environmental Health Services
Division of the Weld County Department of Public Health and Environment. In the
event the system is found to be inadequately sized or constructed the system shall
be brought into compliance with current Regulations or a separate system shall be
installed to serve the shop/office. Evidence of the Weld County Department of
Public Health and Environment approval shall be submitted to the Department of
Planning Services. (Department of Public Health and Environment)
K. The applicant shall submit a manure and stormwater management plan to the Weld
County Department of Public Health and Environment for review and approval. The
plan should describe how manure generated on site will be stored, managed,
removed, land applied, etc. The plan should also describe the fate of any
stormwater that may come into contact with manure. Evidence of the Weld County
Department of Public Health and Environment approval shall be submitted to the
Department of Planning Services. (Department of Public Health and Environment)
L. The applicant shall submit a waste handling plan,for approval,to the Environmental
Health Services Division of the Weld County Department of Public Health &
Environment. Evidence of the Weld County Department of Public Health and
Environment approval shall be submitted to the Department of Planning Services.
The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number). (Department of Public

M. The applicant shall verify that the legal description is accurate. The Assessors
office describes this parcel as Lot B of RE-2820; being part of the N2 NE4 Section
8, Township 4 North, Range 64 West of the 6th P.M., Weld County. Written
evidence of such shall be submitted to the Department of Planning Services.

N. The internal circulation within the site is unclear. Future drawings shall delineate
the proposed circulation pattern. (Department of Planning Services)
O. The applicant shall contact the Department of Public Works to verify a safe and
adequate access for this facility. (Department of Planning Services)
P. The applicant shall submit two (2) paper copies of the plat for preliminary approval
to the Weld County Department of Planning Services. (Department of Planning

3. Upon completion of 1. and 2. above the applicant shall submit a Mylar plat along with all
other documentation required as Conditions of Approval. The Mylar plat shall be recorded

in the office of the Weld County Clerk and Recorder by Department of Planning Services'
Staff. The plat shall be prepared in accordance with the requirements of Section 23-2-
260.D of the Weld County Code. The Mylar plat and additional requirements shall be
submitted within thirty (30) days from the date of the Board of County Commissioners
resolution. The applicant shall be responsible for paying the recording fee. (Department of

4. The Department of Planning Services respectively requests the surveyor provide a digital
copy of this Use by Special Review/. Acceptable CAD formats are .dwg, .dxf, and .dgn
(Microstation); acceptable GIS formats are ArcView shapefiles, Arclnfo Coverages and
Arclnfo Export files format type is .e00. The preferred format for Images is .tif (Group 4).
(Group 6 is not acceptable). This digital file may be sent to mapsaco.weld.co.us.

5. Prior to issuance of the Certificate of Occupancy:
A. The applicant shall provide dust suppressant chemicals (magnesium chloride or
calcium chloride)on County Road 48 between the applicant's west property line and
County Road 53. The chemical shall be applied no less than twice a year or as
needed and/or directed by the Weld County Public Works Department.

6. The Special Review activity shall not occur nor shall any building or electrical permits be
issued on the property until the Special Review plat is ready to be recorded in the office of

2. Approval of this plan may create a vested property right pursuant to Section 23-8-10 of the
Weld County Code. (Department of Planning Services)
3. The applicant shall remove, handle, and stockpile manure from the livestock area in a
manner that will prevent nuisance conditions. The manure piles shall not be allowed to
exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or
pollutant runoff. The manure storage site shall have a water-tight surface which does not
permit seepage or percolation of manure pollutants into the ground. (Department of Public

4. The facility shall maintain compliance with the Best Management Practices outlined in the
Confined Animal Feeding Operation Regulations (5 CCR 1002-19). (Department of Public

5. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act,
30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a
manner that protects against surface and groundwater contamination. (Department of

6. No permanent disposal of wastes shall be permitted at this site.This is not meant to include
those wastes specifically excluded from the definition of a solid waste in the Solid Wastes
Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. (Department of Public

7. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive
dust,blowing debris, and other potential nuisance conditions. (Department of Public Health

8. Animal and feed wastes, bedding, debris and other organic wastes shall be disposed of so
that vermin infestation,odors,disease hazards,and nuisances are minimized. (Department

9. Fugitive dust shall be controlled on this site. (Department of Public Health and

10. The facility shall adhere to the maximum permissible noise levels allowed in the Light
Industrial Zone District as delineated in 25-12-103, C.R.S. (Department of Public Health and

11. The applicant shall operate in accordance with the approved "waste handling plan."

12. The facility shall utilize the existing public water supply (Central Weld County Water

13. Adequate hand washing and toilet facilities shall be provided for all employees and patrons

14. Any septic system located on the property must comply with all provisions of the Weld
County Code, pertaining to Individual Sewage Disposal Systems. (Department of Public

15. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado
Department of Public Health & Environment, Water Quality Control Division. (Department

16. A permanent, adequate water supply shall be provided for drinking and sanitary purposes.

17. The facility shall be operated in a manner to control flies. (Department of Public Health and

18. Except for pole type structures, each building will require an engineered foundation based
on a site-specific geotechnical report or an open hole inspection performed by a Colorado
registered engineer. Engineered foundations shall be designed by a Colorado registered

19. A plan review is required for each building for which a building permit is required.

20. Buildings shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 1997
Uniform Building Code; 1998 International Mechanical Code; 1997 International Plumbing
Code; 2002 National Electrical Code and Chapter 29 of the Weld County Code.

21. Building height shall be measured in accordance with the 1997 Uniform Building Code for
the purpose of determining the maximum building size and height for various uses and
types of construction and to determine compliance with the Bulk Requirements from
Chapter 23 of the Weld County Code. Building height shall be measured in accordance
with Chapter 23 of the Weld County Code in order to determine compliance with offset and
setback requirements. Offset and setback requirements are measured to the farthest

23. The historical flow patterns and run-off amounts will be maintained on site in such a manner
that will reasonably preserve the natural character of the area and not prevent property
damage of the type generally attributed to run-off rate and velocity increases, diversions,

24. The off-street parking spaces including the access drive shall be surfaced with gravel or the

27. The hours of operation for the constructions company will be limited to 7:00 am - 5:30 pm

Board of County Commissioners. This restriction shall not apply to operation of
administrative and executive offices or repair and maintenance facilities located on the

r- 28. As indicated by the applicant the number of employees shall be limited to twelve (12).

29. The property owner or operator shall be responsible for complying with the Design
Standards of Section 23-2-240, Weld County Code.
30. The property owner or operator shall be responsible for complying with the Operation
Standards of Section 23-2-250, Weld County Code.
31. Personnel from the Weld County Government shall be granted access onto the property
at any reasonable time in order to ensure the activities carried out on the property comply
with the Development Standards stated herein and all applicable Weld County regulations.
32. The Special Review area shall be limited to the plans shown hereon and governed by the
foregoing standards and all applicable Weld County regulations. Substantial changes from
the plans or Development Standards as shown or stated shall require the approval of an
amendment of the Permit by the Weld County Board of County Commissioners before such
changes from the plans or Development Standards are permitted. Any other changes shall
be filed in the office of the Department of Planning Services.
33. The property owner or operator shall be responsible for complying with all of the foregoing
Development Standards. Noncompliance with any of the foregoing Development Standards
may be reason for revocation of the Permit by the Board of County Commissioners.

2003. This case was inadvertently scheduled for todays hearing. The referral agencies have
not had the appropriate time to review the application materials and return comments.

1. We want to run water and sewer to the office/shop. We currently have 6
employees. Only 1 uses the restroom facilities. She is the bookeeper, our
daughter and works part-time. The rest are the truckdrivers. They come, start
the trucks and leave the yard. When their job is done, they park their trucks
and leave. They very seldom work in the yard. We want to use the current
septic system.
2. Animal units - We want 8 horses, 3 cows, 20 pigs, 10 chickens, 2 dogs
and 3 cats.
3. There will be minor repairs done in the shop.

As we discussed I have a few questions that need a bit more clarification before we can submit our
referral. Here they are:
1) The map submitted in the application materials shows a proposed office/shop. Does the applicant
intend to provide water and sewer to the structure or make the restrooms available in the home to
employees? They have to do one or the other. There are 10 employees so I'd assume they'd want water
and sewer in the office/shop. In the event they do intend to add water and sewer to the office/shop, will
they install a new septic system to serve it?
2) How many animal units are they requesting? Is the use-by-right units adequate?
3) Do they intend to do maintenance on the vehicles in the shop?
Thanks Michelle. Once I get an answer to these questions, I'll try to make quick work of the referral.

Your application and related materials for the request described above are being processed. I have scheduled a meeting
with the Weld County Planning Commission for November 4,2003,at 1:30 p.m. This meeting will take place in Room
210,Weld County Planning Department, 1555 N. 17th Avenue,Greeley, Colorado. It is recommended that you and/or
a representative be in attendance to answer any questions the Planning Commission members may have.
It is the applicant's responsibility to comply with state statutes regarding notice to mineral estate owners. Colorado
Revised Statute,C.R.S.24-65.5-103(adopted as part of H.B.01-1088)requires notification of all mineral estate owners
30 days prior to any public hearing. The applicant shall provide the Weld County Planning Department with written
certification indicating the above requirements have been met.
It is the policy of Weld County to refer an application to any town or municipality lying within three miles of the property
or if the property is located within the comprehensive planning area of a town or municipality. Therefore,our office has
forwarded a copy of the submitted materials to the Planning Commission for their review and comments. Please call
for further details regarding the date,time,and place of this meeting. It is recommended that you and/or a representative
be in attendance at the Planning Commission meeting to answer any questions the Commission members may have
with respect to your application.
A representative from the Department of Planning Services will be out to the property a minimum of ten days prior to the
hearing to post a sign adjacent to and visible from a publicly maintained road right-of-way which identifies the hearing
time, date, and location. In the event the property is not adjacent to a publicly maintained road right-of-way, one sign
will be posted in the most prominent place on the property and a second sign posted at the point at which the driveway
(access drive)intersects a publicly maintained road right-of-way.
The Department of Planning Services'staff will make a recommendation concerning this application to the Weld County
Planning Commission. This recommendation will be available twenty-four(24)hours before the scheduled hearing. It
is the responsibility of the applicant to call the Department of Planning Services'office before the Planning Commission
hearing to make arrangements to obtain the recommendation.
