RE: SETTING OF JAIL RATES
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado Statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, Section 17-26-119 CRS 1973 specifies that when there is no
sufficient jail in any county wherein any criminal offense has been committed,
the prisoner can be sent to a jail of the county nearest having a sufficient
jail and all the expenses of keeping such person shall be paid by the county
from which such person was sent, and
WHEREAS, Section 17-26-123 CRS 1973 requires that a county jail shall
receive into its jail every person duly committed thereto for any offense
against the United States and to confine every such person in jail until he is
duly discharged with the United States paying all the expenses of the
confinement, safe-keeping, and custody of such person, including the keeper's
fees, at the rates established by the Board of County Commissioners of the
county where such jail is situated, and
WHEREAS, Section 27-16-119 CRS 1973 indicates when a county houses
another county's prisoners, the Board of County Commissioners of that county
shall establish the fees to recover the expenses of the confinement,
safe-keeping, and custody of such prisoner, including the keeper's fees, at
the rate established by the Board of County Commissioners of the county where
such jail is situated, and
WHEREAS, the Sheriff and the Director of Finance and Administration have
studied the cost of the jail and the current entities that are requesting
housing of prisoners and have determined that it would be in the best interest
of Weld County to continue to charge the THIRTY-FIVE DOLLARS ($35.00) per day
fee for the remainder of fiscal year 1982, and that, beginning January 1,
1983, the rate should fully recover the cost of housing a prisoner at the rate
of FORTY-FIVE DOLLARS ($45.00) per day.
WHEREAS, the term "day" as used in this resolution, shall start at time
of entry and end 24 hours later with outside agencies being charged for a day
for any time period less than 24 hours, and
WHEREAS, the agency requesting housing for their prisoners will be
charged a full day's fee on day of entry to the Weld County Jail and will not
be charged for the day of release.

WHEREAS, any such person being confined in Weld County Jail and prior to
being lawfully released, Weld County, in return for the daily fee, shall pay
all expenses incident to providing housing, food, clothing, supervision and
ordinary health care for said persons and shall maintain such persons as
required by law, and
WHEREAS, when any extraordinary health care expenses are required, the
Sheriff shall notify the agency for which Weld County is housing the prisoner
and the cost of the extraordinary health care expenses shall be the
responsibility of the agency for which Weld County is providing the jail
service.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County that in accordance with CRS 1973, Section 17-26-119 and Section
17-26-123, the Board of Commissioners hereby establishes the per diem rate of
THIRTY-FIVE DOLLARS ($35.00) per day for each prisoner housed in the Weld
County Jail for another public entity outside of Weld County and for any
federal prisoner until December 31, 1982, and beginning January 1, 1982, the
rate should fully recover the cost of housing a prisoner at the rate of
FORTY—FIVE DOLLARS ($45.00) per day with the above cited conditions.
BE IT FURTHER RESOLVED that any medical expenses incurred in excess of
normal medical care offered at the jail site on behalf of a person confined
in the Weld County Jail, for another agency, shall be reimbursed by said
agency.
The above and foregoing resolution was, on motion duly made and seconded,
adopted by the following vote on the 30th day of August, A.D. , 1982.
