HomeMy WebLinkAbout20042242.tiff 11_ RESOLUTION RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL FOR USE BY SPECIAL REVIEW PERMIT #1413 - ANTHONY NAVARRO, DBA ACTION PURSUIT PAINTBALL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated April 23, 2003, the Board approved the application of Anthony Navarro, dba Action Pursuit Paintball, 709 43rd Avenue, Greeley, Colorado 80634, for a Use by Right, an Accessory Use, or a Use By Special Review in the Commercial or Industrial Zone Districts (Commercial Recreational Facility - Paintball Park) on the following described real estate, to wit: Parcels B and C of Subdivision Exemption #745; being part of the SW114 of Section 14, Township 5 North, Range 65 West of the 6th P.M., Weld County, Colorado, and WHEREAS, on March 15, 2004, the Board of County Commissioners of Weld County, Colorado, approved an Improvements Agreement According to Policy Regarding Collateral for Improvements (Private Road Maintenance) for Use by Special Review Permit#1413, between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and Anthony Navarro, dba Action Pursuit Paintball, with terms and conditions being as stated in said agreement, and accepted Certificate of Deposit #100367, drawn on the New West Bank, 3459 West 20th Street, Ste. 114, Greeley, Colorado 80634, in the amount of $26,987.00, and WHEREAS, staff from the Weld County Departments of Planning Services and Public Works have conducted a visual inspection and recommend release of said collateral. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Certificate of Deposit#100367, drawn on the New West Bank, in the amount of$26,987.00 be, and hereby is, canceled and released. On July 15, 2004 we received a letter from Anthony Navarro (Action Pursuit Paintball) requesting release of collateral in its entirety. To date the following Off-Site improvements have been completed: Street Grading & Parking Area estimate $ 2,408.00 Street Base & Gravel estimate $ 5,063.00 Street Paving (gravel surface) estimate $ 5,670.00 Bumpers estimate $ 746.00 Landscaping (trees & seeding) estimate $ 13,100.00 After review of the site by the Department of Public Works and the Department of Planning Services, it has been determined that the work has been completed and recommends the full release of collateral in the amount of$26.987.00 for USR-1413 (Action Pursuit Paintball). The site grading, site base, gravel surface, and parking bumpers located throughout the parking area all have been completed. All the transportation items have been completed to my satisfaction. Planning Services shall verify the landscaping items such as trees and seeding prior to release of collateral. Suggestion: The applicant should consider placing downspout pans on the north side of the building to avoid erosion next to the foundation. Additional erosion control on both sides of the building is highly recommended. Planning Services will be looking for an ADA parking space associated with your requirements.
