Questionnaire
Response to Staff Comments raised at Change of Zone
The following information is being submitted in conformance with Section 24-3-50.C through G
and Section 24-3-60.I.1 through 16 of the Weld County Code.
24-3-50.C A description of the type of uses proposed for the subdivision.
The Stamp Minor Subdivision proposes a non-urban residential subdivision, as defined by
Section 24-1-40 of the Weld County Code. This subdivision is located north of and adjacent to
Weld County Road 38 and approximately '/2 mile west of Weld County Road 13. According to
maps recognized by the Weld County Department of Planning Services, the site is not located in
an overlay district.
The general concept of the development is to create a non-urban scale minor subdivision that
provides for single-family residential and agricultural uses. The Stamp Minor Subdivision
consists of nine single-family estate lots. One lot is 2.49 acres,two lots are 2.5 acres, and one lot
is 2.51 acre in size. Lot 5 is 16.22 acres, Lot 6 is 14.12 acres, Lot 7 is 5.39 acres, Lot 8 is 4.36
acres, and Lot 9 is 5.01 acres in size. The proposed Estate zoning meets the density requirements
of Section 24-1-40 of the Weld County Code and the Weld County Department of Public Health
and Environment. Uses on each lot will meet the requirements of the Estate zone district as
outlined in Section 24-3-400 of the Weld County Code. Industrial uses and open storage areas
are not proposed in this application.
The arrangement of the lots has been made in accordance with existing site features and
surrounding property uses. The specific architectural styles of the principal and accessory
residential structures will be selected by the individual lot owners within standard limitations
outlined in the covenants. The development of the site will be compatible with the architectural
style of the surrounding land-uses and with the overall character of the area. A.Goal 3, Chapter
22 of the Weld County Code states, "Discourage urban-scale residential, commercial and
industrial development which is not located adjacent to existing incorporated municipalities."
This proposal is for a non-urban minor subdivision.
24-3-50.D A summary of any concerns identified during the Minor Subdivision sketch
plan application process with an explanation of how the concerns will be addressed or
resolved.
A letter to the St. Vrain Valley, RE-1J School District indicating a bump-out will be provided for
school bus delivery is included. In conversations with the St. Vrain School District, buses will
not enter a subdivision. By dong so, the applicant ensures service provision will be met. The
standard Cash-in-Lieu of Land Dedication fee of $645.00 per new residential building permit
will be provided at the time a building permit is issued by the individual land owner. A letter
submitted with the sketch plan application confirming conversations with Mr. Rick Ring,
Transportation Manager for St. Vrain Valley School District is included with this application.
Letters dated July 16, 2002, December 5, 2003 and December 17, 2003 are included with
application materials. These letters confirms prior conversations with the School District.
In a referral response from the Weld County Department of Public Works during the Sketch Plan
phase of review, Mr. Schei noted, "The County's GIS mapping data base shows this property
listed as State Land. The applicant shall address this issue." Todd Hodges Design, LLC
contacted Mr. Dan Huerter with the Weld County GIS Department on February 10, 2003. Mr.
Huerter confirmed that the 1995 data layer the Department of Public Works may have been
referring to is incorrect information. Mr. Huerter also confirmed that the parcel in question is in
fact owned by Mr. Jeff Stamp.
The applicant and his representative have met with LuAnn Penfold of the Mountain View Fire
Protection District to insure the proposed design meets the Fire District standards. A.Goal 6,
Chapter 22 of the Weld County Code indicates Weld County has a goal of efficient and orderly
development by not placing a burden on existing service providers. Letters dated February 28,
2003, March 24, 2003, May 9, 2003, August 20, 2003, December 5, 2003 and December 18,
2003 are included with application materials regarding a meetings between the applicant, Todd
Hodges Design, LLC and Ms. Penfold. The letter dated December 5, 2003 is from the applicant
and confirms addresses of lots within the proposed Subdivision. The letter dated December 18,
2003 from Ms. Penfold has been forwarded to Planning Services for assistance with revising
addresses. A transmittal and receipt confirmation of this request to Planning Services is included
in application materials.
In a referral response from the Colorado Geologic Survey, it was noted that individual on-site
percolation tests and geotechnical investigation be completed prior to construction. Individual
on-site percolation tests are required by Weld County, according to Tom Finley with Church and
Associates. In addition, the individual on-site geotechnical investigations are currently
recommended by Weld County. These tests will be a responsibility of the lot owner and be
completed prior to construction activities on site.
The applicant has been proactive in meeting with the Mountain View Fire Protection District and
the St. Vrain Valley School District prior to any formal application being submitted to Weld
County. By dong so, the applicant ensures service provision will be met. As stated previously,
past correspondence is included in application materials documenting past discussions and
agreements.
A letter dated December 5, 2003 has been mailed along with a plat and listing of addresses to the
Platteville Post Master, the Weld County Department of Paramedic Services, and the Weld
County Sheriff's Office for their review and approval. Letters from the Sheriff's Office dated
January 8, 2004 and the Post Office dated December 17, 2003 are included with application
materials.
24-3-50.E The total number of lots proposed.
Nine single-family Estate Zoned lots are proposed.
243-50.F A description of the minor subdivision circulation system, including sidewalk
width, school bus stop turnaround areas, road width, type and depth of road surface, curb
and gutter, valley pan, or width and depth of borrow ditches, and vehicle parking
arrangement.
The vehicular circulation system is proposed to be gravel. The width, depth of the roadway, and
the radius of the cul-de-sac has been designed to meet regulations and standards of the Weld
County Department of Public Works. Sketch Plan and Change of Zone Comments
recommended approval of the proposed street design as submitted with previous applications and
herein.
The internal roadway is proposed to be gravel and a roadway cross section has been included
with this application. The primary access to the subdivision is from Weld County Road 38, a
gravel road. Loading zones are not proposed as the use will be residential and agricultural in
nature. Additionally, no off-street parking areas have been depicted as the ample lot sizes will
adequately accommodate residential needs. However an eyebrow pull off has been designated
for emergency access use and is shown on the plan.
The applicant is willing to discuss a reasonable proportionate share of improving the roads if
necessary through this review.
24-3-50.G A statement describing the ownership, function and maintenance of any school
site, open space or park within the proposed minor subdivision.
The school access bump out will be owned and maintained by the Homeowner's Association.
24-3-60.L1 Compliance with this Chapter, Chapter 23 of this Code, the zone district in
which the proposed use is located, and any adopted intergovernmental agreements or
master plans of affected municipalities.
Section 23-2-50.E.10 specifies development within overlay districts identified and officially
adopted by Weld County shall adhere to regulations regarding such District. This application is
not within an Overlay District as identified in the following manner: (1) A map titled, Weld
County Sand Gravel Resources and dated July 1, 1975 confirms this property does not contain
sand and gravel resources. (2) This property is not affected by the flood plain. (3)This
particular property is not located in a Geologic Hazard Overlay District, per maps on file with
the Department of Planning Services. (4)This particular property is not located in the
Greeley/Weld County Airport Overlay District per Sketch Plan referral from the Greeley/Weld
County Airport Overlay District. (5) This application is not located in the I-25 Mixed Use
Development area. (6)This application is not within an Intergovernmental Agreement area per
Weld County Code Chapter 19.
The application and approval criteria outlined in Chapters 23 and 24 of the Weld County Code
ensure this application has met the intent of both Chapters. The review and referral process
further strengthens this process to ensure compliance.
24-3-60.L2 That provisions have been made to preserve prime agricultural land.
The property is classified as "Prime, If Irrigated" by the USDA map on file with the Department
of Planning Services. The water currently associated with the property is not adequate for a
viable farming operation.
24-3-60.L3 That the provisions have been made for a public water supply sufficient in
terms of quantity,dependability and quality to provide water for the minor subdivision,
including fire protection.
The potable water source for this development will be provided by Little Thompson Water
District. A line extension agreement from this water district is included with application
materials indicating availability and intent to serve this development proposal. Approval of the
form of commitment has been obtained from the County Attorney's Office and submitted with
the Change of Zone application.
The applicant and his representative have met with LuAnn Penfold of the Mountain View Fire
Protection District to insure the proposed design meets the Fire District standards.
Correspondence regarding such conversations was included in the Change of Zone application
materials.
24-3-60.I.4 That, if a public sewage disposal system is proposed, provision has been made
for the system and, if other methods of sewage disposal are proposed, evidence that such
systems will comply with state and local laws and regulations which are in effect at the time
of submission of the minor subdivision.
Individual septic systems will serve each lot. The lots are designed to meet the density
requirements of Section 24-1-40 of the Weld County Code and the Weld County Department of
Public Health and Environment. Septic permits will be applied for with each building permit on
the site. The individual lot owners will be responsible for obtaining septic permits and for the
construction of the individual systems.
24-3-60.I..5 That all areas of the minor subdivision which may involve soil or topographical
conditions presenting hazards or requiring special precautions have been identified by the
subdivider and that the proposed uses of these areas are compatible with such conditions.
A Geologic Report was included in the sketch plan application. Additional information from the
Soil Conservation Service has been included in all applications. These materials, along with
referral responses from appropriate agencies will be available for use by each homeowner when
making development decisions.

24-3-60.L6 That streets within the minor subdivision are adequate in functional
classification, width and structural capacity to meet the traffic requirements of the minor
subdivision. Standards are established in Appendicies 24-D and 24-E to this Chapter.
AND
24-3-60.L.7 That off-site street or highway facilities providing access to the proposed
minor subdivision are adequate in functional classification, width and structural capacity
to meet the traffic requirements of the minor subdivision.
The Department of Public Works has reviewed this application at the Sketch Plan and Change of
Zone. This review ensures the streets within the minor subdivision, and those County Roads
providing access to the minor subdivision, are adequate in functional classification, width and
structural capacity to meet the traffic requirements of this Minor Subdivision. The applicant has
stated he is willing to enter into an agreement to proportionately share improving county roads
impacted by this subdivision.
24-3-60.L8 That the construction, maintenance, snow removal and other matters
pertaining to or affecting the road and rights-of-way for the minor subdivision are the sole
responsibility of the landowners within the minor subdivision.
The Homeowners Association and Covenants will address these matters. A copy of which is
attached herein.
24-3-60.L9 That the minor subdivision in not part of or contiguous with a previously
recorded subdivision or unincorporated townsite.
Review of this application and materials on file with the Department of Planning Services has
ensured this statement to not apply.
24-3-60.L10 That there will be no off-street parking permitted within the subdivision.
The Homeowners Association and Covenants will address this matter. A copy of which is
attached herein.
24-3-60.L11 That no additional access to a county, state or federal highway will be created.
This application does not proposed to create an additional access to a county, state or federal
highway.
24-3-60.L12 That the ingress and egress to all lots within the minor subdivision will be to
an internal road circulation system.
The ingress/egress from Weld County Road 38 will be to an internal road.
24-3-60.L13 That facilities providing drainage and stormwater management are adequate.
Attached documents prepared by a licensed engineer in the State of Colorado, and review by the
Department of Public Works address this issue.
24-3-60.L14 That the maximum number of lots within the minor subdivision will not
exceed nine(9)lots.
Nine single-family Estate Zoned lots are proposed.
24-3-60.L15 That the minor subdivision will not cause an unreasonable burden on the
ability of local governments or districts to provide fire and police protection or other
services.
The referral process included sending referral notices to appropriate police and fire protection
agencies. All comments received thus far in the subdivision process have been incorporated.

24-3-60.L16 That the subdivision will not have an undue adverse effect on wildlife and its
habitat,the preservation of agricultural land and historical sites.
This application is consistent with the policies of Chapter 22 of the Weld County Code. Section
22-2-60 of the Weld County Code specifies Agricultural goals and policies for unincorporated
Weld County. Section 22-2-60.D.1 is A.Policy 4.1 as follows, "Applications for the division of
land which is zoned agricultural to non-urban uses shall be reviewed in accordance with all
potential impacts to the surrounding properties and referral agencies. The criterion shall include,
but not be limited to:
a. 22-2-60.D.1.a Soil Classifications
b. 22-2-60.D.1 .b Availability, location and accessibility to existing
infrastructure and utilities.
c. 22-2-60.D.1.c Ensure safe and adequate access onto County roads or State
highways.
d. 22-2-60.D.1.d The level of development associated with the site.
e. 22-2-60.D.1.e Consideration of existing improvements or structures.
f. 22-2-60.D.1.f The impacts on services such as fire protection, law
enforcement, school districts, etc."
The applicant has taken into consideration the impact to the land when making the decision to
subdivide his property. The applicant currently lives on the proposed Lot 5. Therefore, the
applicant does not wish to cause negative impacts to the property proper or surrounding
properties. The Geologic Report findings will be used for septic and home construction
activities. The availability and cost associated with service extension was considered throughout
this process. The referral from the Department of Public Works at the time of sketch plan
submittal illustrates the proposed internal streets and the external roads are adequate to handle an
increase of traffic.
Any landscaping improvements within this development will be the decision of each lot owner as
common open space is not a requirement for a Minor Subdivision. All species selected should
be drought tolerant and suitable to the site's climate and soil types. Entry improvements will be
planted in drought-tolerant grasses and will be maintained by the Home Owners Association. An
on-site improvements agreement will be submitted with future applications. Future Covenants
shall endorse WA.Goal 1 and WA.Policy 1. Both discuss the importance of conserving water
and using native plant material and utilizing water conservation techniques. To the applicant's
knowledge, endangered species do not exist on site.
The existing seasonal ditch will be relocated and piped to serve the project. One-half share of
Highland will be transferred to the Homeowner's Associated to establish grass on each lot. The
larger lots will also have the opportunity to establish farming activities.
The proposed Estate zoning meets the density requirements of Estate Zone District, Section 23-
3-400 of the Weld County Code. Uses on each lot will meet the requirements of the Estate zone
district as outlined in Section 24-3-400 of the Weld County Code. Industrial uses and open
storage areas are not proposed in this application. The existing lighted arena is non commercial.
Covenants will address this use. New lot owners will agree to the unfettered non commercial use
of the arena.

I received approval of my Change of Zone application in July, 2003. The next and final review
step for this subdivision is to submit the Final Plat. The Board of County Commissioners
Resolution for Change of Zone case number MZ-1017, Condition of Approval 3A specifies I
must provide"written evidence from the St. Vrain Valley School District which indicates that all
district requirements regarding a bus pull-out and cash-in-lieu fee have been met prior to
recording the Final Plat." In addition, Condition of Approval 3J indicates I must have approval
from the School District regarding the bus pull-out area.
I am aware of current fees associated with this development and the local School District. These
fees will be paid at the appropriate time.
The bus pull-out will occur as we discussed in your July 16, 2003 meeting with my
representative Todd Hodges. A small bus pull-off has been placed along Weld County Road 38
to accommodate school bus delivery access. A copy of the recorded Change of Zone plat is
attached for your reference. I understand the bus will not enter the subdivision.
Please provide me with a written response to this letter indicating you are in agreement with the

Dear Ms.Lockman:
I have reviewed the submitted material pertaining to the sketch plan for the Stamp Minor
Subdivision, located north and adjacent to Weld County Road 38; approximately V2 mile west of
Weld County Road 13 (Case Number: MK-1017). The property named is within the boundaries
of the Mountain View Fire Protection District and receives service from the District. The Fire
District does not object to the proposed development, provided the development is able to meet
the'requirements of the Fire District. All applicable codes as they pertain to water supply, fire
hydrant locations, street designs,and fire department access must be met. Based on my review, I
have the following comments regarding the sketch plans submitted:
r• • All construction shall be in accordance with the provisions of Uniform Fire Code, as ratified
by the Weld County Commissioners,and all applicable codes and ordinances, as enforced by
Weld Caurty.
• A minimum fire flow of 1,000 gallons per minute(g.p.m.),measured at a residual pressure or
20 pounds per square inch,is required for one-and two-family dwellings not exceeding 3,600
gross square feet. Larger residences require a minimum fire flow of 1,750 gallons per minute
and may require more depending on the building size and type of construction as per
Appendix III-A of the Uniform Fire Code. In the event the required fire flow is not available
to the property,the Fire District will accept a water system designed to provide a minimum of
500 g.p.m. provided each home is also protected by a residential fire sprinkler system. This
information must be specified in the recorded covenants for the subdivision or recorded on
the final plat.
• Construction plans for the utilities, showing the configuration of streets, the location of fire
hydrants,the size of water mains and available fire flows will need to be submitted to the Fire
District for review and approval. The maximum spacing between Ere hydrants on public
streets and along fire apparatus access roads is 500 feet in residential portions of subdivisions.
Fire hydrants, water mains and access roads must be provided and approved prior to the
issuance of any building permits within the subdivision.
• Typically the Fire District does not accept dead-end access roads in excess of 750 feet in
length. The proposed roadway is approximately 1,450 feet in length as measured from Weld
. County Road 36 to the front property line of Lot 6. The Fire District understands that an

road being 1,450 feet in length provided: 1. All homes are provided with fire sprinkler
systems. 2. No natural gas lines are installed along the roadway(i.e.)individual
lots will be
supplied by individual propane tanks. 3. The driveable surface of the road is oversized in
width (at least 24 fleet wide). The width of the road as shown on the typical road cross
section on the plans does not appear to be sufficient. If the above requirements cannot be
met,a secondary access road must be provided.
• Fire apparatus roads must be designed and maintained to support the imposed loads of fire
apparatus (60,000 pounds). Roads must have a surface that provides all-weather driving
capabilities and be free from obstructions which includes locked gates. The private access
roads to the individual homes must be at least 14 feet in width and must also meet the design
criteria outlined above.
• The street intersection must be marked with a sign showing the street name and address
range. If standard street signs are used,then the signs do not need to be submitted to the Fire
District for approval. If non-standard street signs are used,the signs do need to be submitted
to the Fire District for approval.
• All residences shall have a legible address that is clearly visible from the street fronting the
property. Address numbers or letters shall contrast with their background.
0", • As soon as the final plat is approved,the applicant must provide to District an eight
and one half by eleven map of the subdivision showing the street configuration,Fat
street names,
hydrant locations and addresses of the lots if available.
The Fire District reserves the right to make further comments as development proceeds. Nothing
in this review is intended to authorize or approve of any aspect of this project that does not
