Yesterday, representatives from Pickett Engineering, the Town of Windsor and I met
concerning the Champion Chevrolet. Based upon that meeting, we agreed to the following:
* Champion Chevrolet will obtain a new access permit for the change of use of the
property. (ag to car dealership)
* In this interim condition, the access shall remain full-movement.
* The access will not require any highway improvements other than the surfacing of the
access.
* The permit will be written with Terms and Conditions that enable CDOT to re-evaluate
the permit should traffic congestion or safety be impacted as a result of this access.
Re-evaluation could result in the relocation, limitation of movements, or possible closure
of the access.
* At such time as the property changes use, CDOT will re-evaluate for possible highway
improvements.
* The Town of Windsor will consider the relocation of the cemetary access to align
with this access should that ever become a possibility.

2. Prior to recording the Change of Zone plat:
A. All pages of the plat shall be labeled CZ-1049.
The pages have been revised.
B. The vicinity map shall be amended on the plat to adhere to Section 23-2-
50.C of the Weld County Code.
The vicinity map has been revised.
C. The Property Owners Certificate on the plat shall be amended to read "I
(We), the undersigned, being the sole owners in fee of the above described
property, do hereby certify the zoning as shown on the attached map.
The certificate has been revised.
D. The boundary(perimeter)of the proposed Change of Zone shall not include
Lot A of RE-358. The Change of Zone area must be shown distinctly on the
Change of Zone plat.
The Lot A boundary is no longer shown as a thick line.
E. Easements shall be shown in accordance with County standards and shall
be dimensioned on the Change of Zone plat.
All easements known to currently exist on the property are shown on the plat.
New easements are not being dedicated on the Change of Zone Plat.
F. State Highway 392 is classified by the County as a state highway. The
applicant shall coordinate with CDOT the requirements for right-of-way and
access on State Highway 392 and provide a letter of confirmation to Public
Works. The applicant, on the Change of Zone plat, shall show and label the
right-of-way recognized by CDOT. This state highway is paved.
CDOT has requested 100 feet of right-of-way from the centerline of the
highway. See attached email. There are no new access points requested by
this development, and no change in the existing use is proposed, therefore,
CDOT is not requiring a change in the current driveway permits.

G. State Highway 257 is classified by the County as a state highway. The
applicant shall coordinate with CDOT the requirements for right-of-way and
access on State Highway 257 and provide a letter of confirmation to Public
Works. The applicant, on the Change of Zone plat, shall show and label the

There are no railroads adjacent to the requested change of zone.
The applicant shall address the issues previously outlined to the satisfaction
of the Weld County Department of Public Works. Any issues of concern
must be resolved with the Department of Public Works prior to recording the
Change of Zone plat. Written evidence of approval shall be submitted to the
Department of Planning Services.
There are no known issues of concern from Public Works. See attached e-
mail dated March 23, 2004.
J. The applicant shall address the requirements (concerns) of the Town of
Windsor, as stated in the referral response dated November 7, 2003.
Evidence of such shall be submitted in writing to the Weld County
Department of Planning Services.
There are no concerns listed in the letter from the Town of Windsor.
K. The applicant shall submit evidence of who has the authority to sign for CC
Land, LLC.
The articles of incorporation for CC Land, Inc. are attached.
L. The property is in violation of Chapter 23 of the Weld County Code
(VI #0200198). The applicant shall submit a Site Plan Review to the
Department of Planning Services for the existing car dealership.
The Site Plan Review submittal package is being submitted herewith.

Staff received a letter from Weakland's stating that their new access will be off of 17th Street north
of SH 392. (The SH 392 access is to be closed for their use. Weakland continues, stating at
present the remaining 120 feet is not in place and the design and construction of the access to the
property is unknown.

As you are aware, Champion Chevrolet has entered into an agreement with the Town of
Windsor that states that they must annex to Windsor if a Vehicle Use Tax is implemented.
The Town of Windsor will be deciding this issue by public vote on April 6,2004. Therefore,
we are requesting an extension:to the sixty-day limit (set by the Board of County
Commissioners) for the submittal of Change of Zone 1049.
We request an additional sixty(60) days' extension to await the outcome of the vote and for
us to complete our work in the event that the vehicle use tax is not adopted. If you would

CC Land LLC, c/o Edwin J. Chamberlain has applied for a Change of Zone from Agricultural to C-3
on a property located 250 feet south of Hwy 392 and west of and adjacent to Hwy 257. The site is
currently in violation for operating a car dealership without the proper permits. This Change of Zone
along with a Site plan review will be required before the violation will be closed.
The Town of Windsor is either adjacent to the site or in close proximity on all sides. To address
concerns raised by the Town of Windsor, the applicant has requested to amend his original
application to include only a portion of the original property. The property to be included will only be
that which the car dealership located on the lot to the north has expanded onto.
Surrounding properties include a baseball field and cemetery to the west, Agricultural and residential
uses to the north and east and Industrial uses to the south.
11 referral agencies reviewed this case, 8 responded favorably or included conditions that have been
addressed through development standards and conditions of approval. The applicant currently has a
water and sewer agreement with the Town of Windsor. The agreement is conditioned so that the
properties would be annexed by May 1, 2015 or earlier should the car dealership be changed to a
different use or the Town would adopt a use tax on motor vehicles. The applicant is being required to
update the existing agreement.
Our department has received no correspondence from surrounding property owners.
The Weld County Planning Commission recommends approval of Change of Zone 1049
At this time I will be happy to answer any questions the Commission may have.
