Dear Mr. Kirby:
Thank you for the presentation from Weld County of the tax credit request
before the February 26, 1981 meeting of the State Impact Assistance Advisory
Committee. In October, 1979 Weld County requested a $200,000 grant to con-
struct this road and that request was recommended for denial by the State
Committee on the grounds that because of limited grant funds relative to
need and direct industry benefit from this project it should be funded
from county taxes on the mine and industry contributions.
As you know, at its February, 1981 meeting the Committee again recommended
against approval of using limited grant funds on this project. Approval of
the tax credit would result in $900,000 being deducted from grant funds
available to impacted local governments. We had $8 million in grant requests
at our last meeting and less than $2 million in funds available. This ratio
is not likely to improve.
By Section 39-29-107.5 of the Colorado Revised Statutes I am required to
certify the eligibility for tax credit of the proposed project upon the
recommendation of the State Impact Assistance Advisory Committee. Following
the Committee's recommendations I cannot approve this tax credit request.
