RE: Estate of Kenneth Craig Newsom
Ladies and Gentlemen:
I have been retained by the family of Mr. Kenneth Craig Newsom. Please be advised that
pursuant to C.R.S. 24-10-109, (and generally C.R.S. 24-10-101 through-120. Notice is hereby given
that Mr. Newsom's family intends to file a claim for damages resulting from negligent acts and
omissions by the combined city and county dispatch and City of Greeley Police Department, which
acts resulted in Mr. Newsom's death.
The name and the address of the claimant is: David A. Newsom, 1401 19'h Avenue, #27,
Scottsbluff,Nebraska 69361.
The name and the address of the claimant's address is: Brenda L. Bartels, Douglas, Kelly,

Factual basis of the claim: On October 27, 2003,Kenneth Newsom called a family member
from his cell phone, and claimed to be experiencing mental health problems. At the time he was a
resident of Greeley,Weld County,Colorado. The family member called Weld County/Greeley 911
and reported his name and address and that he was having problems. An hour later, she called the
police and was assured that the call had been recorded and a response was being initiated. An hour

and one-half later, she was contacted and requested to meet the police at the house because an
ambulance was being sent at that time. Mr.Newsom was transported to the hospital. Mr.Newsom
died.
On or about October 31, 2004, the Weld County Coroner informed the family that Mr.
Newsom had died as a result of asphyxiation, and that they should consider action.
Statement of the amount of monetary damages that is being requested: $150,000.00.
