MINUTES
WELD COUNTY COUNCIL
December 2, 1982

The Weld County Council met in regular session in full conformity with
the Weld County Home Rule Charter at 915 Tenth Street, Greeley, Colorado,
December 2, 1982, at 1 :30 p.m.
ROLL CALL
The following members were present in person: President DeAnn Emerson,
Patricia Anderson, Donald Elliott and Ralph Waldo. Vice President Howard Foster
was absent. Also present for all or part of the meeting were newly elected council-
man Bill Rupp, commissioners Bill Kirby and John Martin, Don Warden, Dick Barrett,
two members of the press, one member of the public, and the council secretary.
MINUTES APPROVED
Patricia Anderson made a motion to approve the minutes of November 4, 1982,
as written. The motion was seconded by Don Elliott and carried unanimously.
ADDITIONS AND/OR DELETIONS
Added to the agenda was an additional payment of $21 .74 to Carol-Lynn's Flowers.
Deleted from the agenda was a report from Bob Ray regarding special tax
districts.
APPOINTMENTS
Council members were reminded by the President of their upcoming appointments.
CORRESPONDENCE
The President either read correspondence received by the council or made the
correspondence available for their individual review.
OLD BUSINESS
The November 4, 1982, resolution regarding the county budget was read to the
council and signed by those members in attendance.
NEW BUSINESS
A legal opinion from Bob Ray has been pending since the October 7, 1982,
council meeting as Mr. Ray has not had time to complete the research. He suggested
that the council secure the legal services of another attorney, preferably one
specializing in municipal law. Ralph Waldo moved that DeAnn Emerson and Don Elliott
try to locate an attorney who would be interested in serving the council . Patricia
Anderson seconded the motion and it passed unanimously. It is hoped that the new
attorney will be able to render an opinion regarding the legality of special tax
districts as well as the issue of what authority the council has to audit county
agencies.
The President welcomed Bill Rupp who will begin serving on the council in
January 1983.
Patricia Anderson moved that the November council bills be paid. This motion
was seconded by Ralph Waldo and carried unanimously. The council agreed to transfer
$25.00 from account 6350 to account 6229.
DeAnn Emerson commented that she was pleased to hear that the courts had ruled
in favor of Sheriff Andrews respecting a recent lawsuit.

The council expressed their concern over the recent raising of the daily
room and board rates by the North Colorado Medical Center.
Commissioner Bill Kirby addressed the council , thanking them for approving
the 1983 budget. He also commended the council for doing a difficult job well
and stated that he had enjoyed working with the council members while serving as
a commissioner.
Dick Barrett and Don Warden presented information requested by the council
regarding the salary benchmark system used by the county.
ADJOURNMENT
There being no further business, Don Elliott moved that the meeting be
adjourned. Ralph Waldo seconded the motion and it carried unanimously. The time
of adjournment was 2:45 p.m. , December 2, 1982.
The next scheduled meeting is Thursday, January 6, 1982, at 1 :30 p.m.

RESOLUTION
RE: 1983 BUDGET
WHEREAS, on November 3, 1982, the Board of County
Commissioners adopted the 1983 final budget; and
WHEREAS, the County Council has been asked to approve
the budget, including an additional $483,742 excess mill levy;
NOW THEREFORE, BE IT RESOLVED, that the Weld County
Council wishes to approve the 1983 budget, including the additional
$483,742.
The above and foregoing Resolution was, on Motion duly
made and seconded, adopted by the following vote on the fourth
day of November, 1982.
