THE DEPARTMENT OF PLANNING SERVICES'STAFF RECOMMENDS THAT THIS REQUEST BE
DENIED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section 23-2-260 of the
Weld County Code.
2. It is the opinion of the Department of Planning Services' staff that the applicant has not shown
compliance with Section 23-2-220 of the Weld County Code as follows:
A. Section 23-2-220.A.1 --The proposed use is consistent with Chapter 22 and any other applicable
code provisions or ordinance in effect.
The manufactured home was originally permitted under ZPMH-2232 as a"Medical Hardship".A
violation was initiated as a result of failure to re-justify the use. The application indicates that this
home will be used as a guest house but could become a permanent home when medical
assistance is needed for a family member. The applicant chose to proceed using the Use by
Special Review (USR) process although Planning Staff directed them to apply for a Recorded
Exemption. Recently, on similar applications, the Board of County Commissioners has required
applicants to apply for a Recorded Exemption as soon as they are eligible.Planning Staff agrees
that this USR should be denied and the applicants should proceed through the Recorded
Exemption process.
This recommendation is based, in part, upon a review of the application materials submitted by the applicant,
other relevant information regarding the request, and responses from referral entities.
USR-1463 Blaney 2
Should the Planning Commission choose to approve USR-1463,the Department of Planning Services'staff
recommends the following be included as conditions of approval:
1. Prior to recording the plat:
A. All pages of the plat shall be labeled USR-1463. (Department of Planning Services)
B. The mobile home was originally built as a temporary structure. The applicant must obtain a
building permit for a manufactured home and must comply with all installation standards of
Chapter 29 of the Weld County Code applicable to manufactured homes. The manufactured
home shall be placed on a permanent foundation to meet the requirements of a single family
dwelling. (Department of Planning Services)
C. The applicant shall provide the Weld County Department of Planning Services with a certificate
from the Weld County Treasurer showing no delinquent taxes exist for the subject parcel.
(Department of Planning Services)
D. The applicant shall submit two(2)paper copies of a plat which conforms to Section 23-2-260.D.
of the Weld County Code to the Weld County Department of Planning Services for review and
approval. The plat shall be amended to delineate the following:
1) The access from County Road 21. (Department of Public Works)
2) County Road 21 is designated on the Weld County Road Classification Plan as a local
gravel road, which requires 60 feet of right-of-way at full build out. There is presently 60
feet of right-of-way. A total of 30 feet from the centerline of County Road 21 shall be
delineated right-of-way on the plat. This road is maintained by Weld County.
E. The applicant shall submit a detailed plan for the removal of the residence to be enacted at such
time that the structure is being used for other than the permitted use. (Department of Planning
Services)

required as Conditions of Approval. The Mylar plat shall be recorded in the office of the Weld County
