RE: APPROVAL OF CONDITIONAL USE PERMIT NO. 53 :80 :1 FOR CUTTING,
SPLITTING, STORAGE AND SALE OF FIREWOOD ON A TRACT OF LAND
LOCATED IN PART OF SECTION 14 , TOWNSHIP 6 NORTH, RANGE 66
WEST OF THE 6TH P.M. , WELD COUNTY, COLORADO.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado held a public hearing on the 27th day of February, 1980
at the hour of 9 :00 o 'clock a.m. for the purpose of hearing the
application of Sharon Pickrell for the granting of a Conditional
Use Permit for Cutting, Splitting, Storage and Sale of Firewood
on the following described real estate, to-wit:

The Weld County Planning Commission held a regularly scheduled meeting
on February 14 , 1980, in the Weld County Centennial Center County
Commissioners Hearing Room, first floor, 915 10th Street, Greeley, Colorado.

As a quorum was present, the meeting was called to order by Chairman
Carlson . He asked if there were any corrections or additions to the
February 5, 1980, meeting minutes. '- 'Hearing none, he called for a motion
to accept the minutes as presented. Bette Kountz made a motion to accept
them as submitted. Her motion was seconded by Jerry Kiefer. A unanimous
vote was cast by all to accept the minutes as submitted.

LEGAL DESCRIPTION: Pt. S1 SW4, Section 14, T6N, R66W
LOCATION: 16277 Highway 392, 21 miles west of Lucerne, north side
of Highway 392
APPEARANCE : Sharon Pickrell
DISCUSSION: Ms . Pickrell stated that this wood would be obtained from
private property near Red Feathers Lakes. There is approximately 1 , 000
cords of wood on the property presently. The cutting and splitting of
the wood will be done on her property and most of the wood will be
delivered. One other person will be helping her With.. the ' operation with
the possibility of part-time workers later on. She also stated that she
hopes to obtain a buzz saw which would cut down some of the noise of the
operation. John Hall of the Weld County Health Department stated that
a noise reading was taken on the property and is slightly above that
required by State Statute. Discussion followed regarding the hours of the
operation as presented in the Development Standards. -Ms : Pickrell_. stated
she would have no objection to an amendment to the Development Standards
for the operation to run until 7: 00 p.m. A motion was made by Jerry
Kiefer and seconded by Bette Kountz to amend the Development Standard
for the operation to run until 7 : 00 p.m. A unanimous vote was cast by •
all members to approve the amendment. Discussion followed regarding
the construction of a fence on the site. Ms. Pickrell asked if there
was a possibility that construction of the fence could be extended from
90 days to 120 days . It was generally- felt that the fence could be
constructed within a reasonable amount of time and 120 days would pose
no problem. A motion was made by Jerry Kiefer, seconded by Frank Suckla
to amend the Development Standard to extend construction of the fence to
120 days. A unanimous vote was cast by all members to approve this amendm nt
MOTION: Be it therefore resolved to recommend approval with the
Development Standards and amendments based on the Planning Staff ' s
recommendation to the Board of County Commissioners. Motion by Jerry

Kiefer, seconded by Bette Kountz. A vote of "aye" was cast by Bette
Kountz, Frank Suckle, Jerry Kiefer, Bob Ehrlich, Don Billings, and
Chuck Carlson. A "no" vote was cast by Fred Otis. He stated he had
no objection to the operation itself, . but feels the hours of the
operation should be limited to 5: 00 p.m. instead of 7 : 00 p.m. It would
give adequate time to do that kind of work and would be less painful
for the people in the neighborhood. Motion carried for approval.

SUBJECT: Open Cut Mining Permit for Sand and Gravel
LEGAL DESCRIPTION: .Pt. Section 17 and the Nz NE4, Sec. 20, T11N, R67W
LOCATION: 11 miles northwest of Carr
APPEARANCE: Steve Schermerhorn
DISCUSSION: Mr. Schermerhorn, by use of a map presentation, showed the
general location of the proposed gravel operation and stated that this
property is presently under lease involving approximtely 220 acres.
Terry Grazing has leased the gravel rights to the applicant. Mining of
the gravel will actually involved approximately acres . He also
discussed access to the site. There are approximately 15, 400 cubic yards
per acre of gravel or 2, 800 tons per acre. Mr.. _Schermerhorn also discussed
the water to be used from the Fox Hills. A great deal of discussion
followed regarding the water to be used for the operation and water rights
on the property. Mr. Schermerhorn stated it is anticipated the Fox Hills
will yield approximately 2/10 of an acre foot per year. Roger Houtchens
representing his client's Lazy D Grazing Association asked several questions
of concern on behalf of his clients regarding the operation. Tom Honn
then read the Planning Staff ' s recommendation for approval with an addition
to to the conditions of the recommendation that the plat be amended to
show the access as recommended by the County Engineering Department.
Tom also stated that there is a discrepancy of the submitted materials
regarding where the exact mining of the operation would be. This matter
was brought to the attention of the Planning Staff earlier. The staff
understood it was. for 40 acres (Units 1-3) instead of the 220 acres . The
felt that perhaps referral agencies , surrounding property owners, etc.
may not be aware of this situation and wanted the Planning Commission to
be aware of what had occurred. Discussion followed in this regard.
Chairman Carlson then asked for any audience participation regarding the
request. At this time Les Bolter and Richard Gardner stated they see no
problem with the request and do not entirely understand the concern for
the water when they feel they have adequate water.
MOTION: Be it therefore resolved to table the request to the March 4,
1980 Planning Commission meeting in order to obtain a responsive legal
decision as to whether the Planning Commission has the authority to
. consider the matter as it regards the water situation and if so, they
would request that a representative from the State Engineer' s Office be
at the meeting or that they get a detailed letter, more descriptive than the
one previously referred to. Also that proper surrounding property owners
be notified. Motion by Bon Billings, seconded -by Otis. A vote of "aye" was

LOCATION: West of Aims College, 59th Avenue at 18th Street
APPEARANCE: Carrell Deacon
DISCUSSION: Mr. Deacon stated that they are requesting that the side-
yard setbacks be reduced from 10 ' to 5 ' to conform with the City of
Greeley regulations.- . He stated they are requesting this because some
of the' lots are 65 ' wide and some of the houses to be built take up
50-55 ' . This property is anticipated to be annexed to the City this
year. Mr. Otis requested that the recommendation of the Staff be incor-
porated into the minutes of the meeting along with the Memorandum of
Standards. He made this request in the form of a motion. His motion
was seconded by Mr. Kiefer. All present cast a vote of "aye" to
incorporate the staff ' s recommendation.
MOTION: Be it therefore resolved to recommend approval to the Board of
County Commissioners based on the Planning Staff ' s recommendation and
incorporating the Memorandum of Standards. Motion by Fred Otis, seconded
by Jerry Kiefer. A vote of "aye" was cast by Bette Kountz, Frank Suckla,
Jerry Kiefer, Fred Otis , Don Billings, Bob Ehrlich, and Chuck Carlson.
Discussion regarding proposed amendments to the Weld County Zoning
Resolution followed as presented by Allen Jost of the Planning
Department concerning Geologic Hazards and Floodplains and the adoption
of regulations pertaining to the Flood Hazard Overlay District and
the Flood Hazard Overlay District Development Permit. The discussion
involved Section 53 concerning floodplains and Section 25 regarding
the Flood Hazard Overlay District Development Permit. and questions
pertaining to such. Allen stated that he would request the Planning
Commission table this request until the next meeting as he will .be
meeting with the Attorney General, Colo. Water Conservation Board and
the Federal Insurance Administration to discuss regulating Zone A or
the areas of approximately floodplain studies. this week.
MOTION: Be it therefore resolved to recommend tabling the request to
the March 4 , 1980 Planning Commission meeting. Motion by Jerry Kiefer,
seconded by Frank Suckla. All present cast a unanimous vote of "aye"
to continue the request. .
There being no further business, the meeting was adjourned.

be fenced with a solid wooden fence at least 6 feet in height .
• The Conditional Use Permit plat shall be amended to define the
area intended to be used for the cutting, andl.Aplitting of the
firewood. In addition, a note on the plat shall indicate the
location, type and height of the fencing. The Conditional Use
Permit plat shall be amended and submitted to theDepartment of
Planning Services staff office prior to schednlina this case
before the Board of County Commissioners.

PLANNING STAFF RECOMMhh _ 1TION
Feb. 19, 1980
2. The applicant shall provide -a pated apron at the existing driveway
so that the asphalt edge on state Highway 392 will not deteriorate.
The apron should be provided between the property line and the high-
way with a minimum turning radii of 20 feet . ' The apron shall be
constructed in accordance with' the requirements and/or recommendations
of the Colorado Dept . of Highways. This was requested by the Colorado
Division of Highways in a letter dated February 5, 1980.
3. The attached Development Standards being recommended and approved for
the Conditional Use Permit .
4. No building or electrical permits. shall be issued on the Conditional
Use Permit area until the Development Standards for the_ Conditional _ _
Use Permit and amendments to the plat_have been place 'on" the Condi-
tional Use_Permit plat-and •said plat has been -delivered to the Office
of the Department of Planning Services.
5. The applicant shall reserve 75 feet from the centerline of state
highway 392 on the south side of the property under consideration
for additional right-of-way. This has been requested by the Colorado
Division of Highways in a letter dated February 5 , 1980 . The CUP
plat shall be amended to show the 75 feet of additional right-of-way
from the centerline before this case is scheduled before the Board
of County Commissioners.

DEVELOPMENT STANDARDS
1. The permitted uses on the hereon described parcel may include
the cutting, splitting, storage and sale of firewood and all uses
permitted by right under Section 3. 3B of the Weld County Zoning
Resolution.
•
2. Hours for the cutting and splitting portion of the operation shall
be between 7 :00 a.m. and 7 :00 p.m.
3. A solid wooden fence at least 6 feet in height shall enclose the
area intended for the cutting and splitting of firewood as shown
hereon. The property owner shall be responsible for maintaining
the fence in good repair and free from debris. The fence shall
be installed no later than 120 days after the date of approval by
the Board of County Commissioners.
4. A sign advertising the sale of firewood may be permitted on the
Conditional Use Permit area. The sigh shall be in compliance with
the sign regulations listed in the Weld County Zoning Resolution.
5. The Conditional Use Permit area shall be maintained in such a !L
manner so as to prevent soil erosion, fugitive dust, and the growth
of noxious weeds.
6. All phases of the operation shall comply with all County and '
State Health Standards and Regulations pertaining to air quality,
water quality, and Sewage disposal :systems. The applicant shall be
responsible for compliance with noise standards as listed in
25-12-103, CRS 1973.
7. The appearance of the Conditional Use Permit area shall be
maintained in a neat and orderly condition. In addition, stored
firewood shall be stacked in a neat and orderly condition on the
property.
8. The applicant shall provide a pained apron at the existing drive-
way so that the asphalt edge on state Highway 392 will not I.
deteriorate. The apron should be provided between the property
line and the highway with a minimum turning radii of 20 feet .
The apron shall be constructed in accordance with the requirements
and/or recommendations of the Colorado Dept . of Highways. The
paved apron shall be constructed no later than 120 days after the
date of approval by the Board of County Commis toners.
9. The Conditional Use permit shall be limited to the plans shown
hereon and governed by the Development Standards stated above and
all applicable Weld County Regulations. Any material deviations
from the plans and/or Development Standards as shown or stated
above shall require the approval of an amendment to the Conditional

Use Permit by the Planning Commission and Board of County
Commissioners before such changes from the plans and/or
Development Standards shall be permitted. Any other changes
from the plans and/or Development Standards shall be filed in
the office of the Department of Planning Services.
10: The property owner and/or operator of this operation shall be
responsible for complying with all of the above stated Development
Standards. Non-compliance with any of the above stated Development
Standards shall be reason for revocation of the Conditional Use
Permit by the Board of County Commissioners.

Dear Mrs. Pickrell:
This letter is to advise you that Ed Berlier has submitted the revised
and corrected plat to our office. The plat must have your signature,
however, before we can record it. I have been unable to contact you by
phone prior to this letter. If you could drop in to the office to sign
the plat we can get it recorded.
Also, I wished to inform you about requirements for building permits for
fences. I am concerned that you may not have been advised during the
hearings that certain fences do require building permits. As you are
aware, one of the development standards required a fence on the north,
east and west sides of the cutting area. The fence was to be at least
six feet in height. The Zoning Resolution requires building permits for
structures but excludes fences under six feet in height. Therefore, if
you plan to erect a fence taller than the six foot minimum, it will
require a building permit to erect.

Our office has reviewed a letter dated October 20, 1980 from the Colorado Division
of Highways regarding the above described request. Our office has no objections
to deleting the requirement for a paved apron approach to State Highway 392 based
upon the information provided by the Highway Department in its letter of October
20, 1980. Furthermore, the staff feels that the deletion of the paved apron is
not a material deviation from what was originally approved. No futher action
is required on your part regarding the issue of the paved apron requirement.

Conditional Use Permit
The application for this use permit is for cutting, splitting,
and supplying of firewood. The cutting of the wood is being
done at this time with a chainsaw, however in the near future
I would like to purchase a buzz saw for cutting of the wood.
The splitting is done with either a gas or electric log splitter.
Wood is being delivered to the site by one vehicle with trailer
on almost a daily basis now. In the future Plans are to bring wood
to the site with two vehicles, either one truck and one vehicle
with trailer or two vehicles with trailers. There may be times
that there will be more vehicles bringing wood, however this would
be very few occassions. Plans are to bring wood in on weekends
during the Spring, Summer and Fall and occassionally during the
Winter if weather permits.
There is nne other person working on the wood other than myself.
There may be time that I will employ other people on a part time
basis. Their hours would be from $:OOAM to 5:00PM. I would like
the hours of business from 7:00AM to 10:00PM, six days a week.
If I am available on Sundays I would like to be able to deliver
wood or be open for peiple to pick up the wood. Very few people
pick up their own wood„ becf}use of the difference in price they
prefer to have it delivered and stacked. Plans are to have
facilities which will deliver three cords of wood at one time
with a maximum of nine or ten cords per dayWood will be, delivered
to customers in cord boxes which will bolt down on trailer.
Most sales are done by phone in the home, however there is a
phone in unattached garage so if I am outside the phone can be
answered from there. Advertising will be done by local paper,
business cards, and Yellow pages of telephone book.
Water is supplied to present resident by North Weld County Water
District. There is neither any addition water or facilities needed
for this process.
In the future I may want to build a storage shed or barn so that
after the logs have been cut and split they can be stored insid,$
where they will remain dry.

Dear Ms. Gerstberger:
It has come to our attention that Weld County approved a Conditional Use Permit
for Sharon Pickrell with the requirement that a paved apron approach to State Highway 392
be provided. This requirement was apparently the result of a letter (copy attached)
which we sent to your department.
In that letter, we expressed a concern with regard to the type and amount of
traffic which would use the existing driveway. Our concern was based upon the
attached copy of a January 17, 1980, letter from Ms. Pickrell to your department.
That letter gives the impression that a large number of heavily loaded vehicles
would be using this driveway.
Through contact with Ms. Pickrell , it has been learned that only a couple of
loads of wood have been sold since the approval of the Conditional Use Permit. It
does not seem that the traffic generation from this`firewood supply operation is
•
as great as we had expected. We therefore retract'our comment regarding the provision
of a paved approach to the highway.

Dear Mr. Cunliffe:
We have reviewed the application from Sharon Pickrell for a Conditional Use
Permit and we have the following recommendations.
1 . Projected traffic volumes on S.H. 392 indicate the need for a total of 150
feet, 75 feet each side of centerline. We ask that additional right of way
to meet this need be protected by reservation or dedication, preferably the
latter, as local zoning laws and regulations permit.
2. The proposed use could result in significantly increased traffic at what is
now a residential driveway. Over a period of time, the heavily loaded
vehicles using this driveway would tend to break down the edge of the pave-
ment on S.H. 392.
It would therefore be desirable to provide a paved apron at the existing
driveway so that the asphalt edge will not deteriorate. This apron should be
provided between the property line and the highway with minimum turning radii of
20 feet. A permit for this work should be obtained from Mr. David Fraser, Dis-
trict IV Maintenance Superintendent.

In response to your letter concerning a conditional use permit for Sharon
Pickrell, we wish to say that we have no objection to said permit except for
the noise factor. If there were regulations governing the hours that said
business could operate that were reasonable, perhaps it would be tolerable.
We have found it necessary to call the sheriff 2 times late at night, and there
were many more times that we should have called him, but one hates to call
the law on your neighbor.
I realize that with the price of firewood so high selling same is quite profit-
able, but one should have such a noisy interprise away from anotherielhome.
If we had wanted to listen to chain saws and the noise of loading and unloading
of wood most of the time we would have purchased a home next to a sawmill or
lumber yard. People buy homes in the country for relative peace and quiet,and
the firewood business as it has been operating is not very condusive to either
one.
Perhaps if some guidelines could be set down as to hours of operation we could
approve of this permit. Reasonable hours during weekdays and quiet weekends
might be all right. Perhaps an electric chain saw which is much quieter to
operate might also be a good idea. The level of noise made by a gas chain saw
can be quite hard to listen to after an extended length of time.

This is a deep, well drained soil on smooth planis and alluvial fans
at elevations of 4900 to 5250 feet. It formed in mixed eolian'deposits
'and parent sediments from a wide variety of bedrock.
Included in this unit are some soils that have sandy- loam or loamy
sand underlying material. •

. Typically the surface layer is a brown tb pale brown loam about 12 inches
• thick. The underlying material is a light clay loam or loam about 28
inches thick. The substratum, to a depth of 60 inches is a loam or
fine sandy loam.
d� stx�i Permeability is moderate. Available water capacity is high. Effective
rooting depth is 60 inches or more. Surface runoff is medium and erosion
hazard is low.
Where irrigated this soil is suited to all crops adapted to this area,
(M EKE II)
including corn, sugar beets , beans , alfalfa, small grains , potatoes
and onions. An example of a suitable cropping system is alfalfa 3 to
4 years followed by corn, corn for silage , sugar beets , small grain,
beans and back to alfalfa. Some conservation practices such as land
leveling, ditch lining and pipelines may be needed for proper water
•
applications.
All methods of irrigation are suitable with furrow irrigation themost
common type used. Barnyard manure and commercial fertilizers are, needed
for top yields along with maintaining good organic matter content.

In nonirrigated areas this soil is suited to winter wheat , barley and
sorghum. Most of the area is devoted to winter wheat which is alter-
nated with summer fallow to allow moisture accumulation. , Normally,
' precipitation is too low to make beneficial use of fertilizers.
Good cultural practices such as stubble mulch farming; strip cropping •
, and minimum tillage are needed to combat wind and water erosion. -. .
Terracing may also be needed to control water erosion. " . _
The potential native vegetation on this soil is dominated by blue grama.
Several midgrasses such as western wheatgrass and needle and thread are
also present. Potential production ranges from 1600 pounds per acre in
favorable years to 1000 pounds per acre in unfavorable years. When range
condition deteriorates, the midgrasses decrease, blue grama, buffalograss,

snakeweed, yucca and fringed sage increase and productionrdrops. • , Undesir-

able weeds and annuals invade the site as range condition becomes poorer.
Management of vegetation on this soil should be based on ,taking half
and leaving half of the total annual production. Seeding is advisable if
range is in poor condition. Sideoats grama , little bluestem, western
wheatgrass , blue grama, pubescent wheatgrass and crested wheatgrass are
• suitable for seeding. The grass selected should meet the seasonal
requirements of livestock. For successful seeding, a clean, firm, sorg-
hum stubble -- prepared the growing season prior to seeding -- or a
a
. firm, prepared seedbed and grass drill should be used. Early spring '
seeding has proven most successful.
Windbreaks' and environmental plantings are generally well suited on
this soil. Generally all trees and shrubs adapted to this area will

This Kim soil has a good potential for urban and recreational develop-

ment, Increased population growth in the area (county) has resulted
. in increased home site construction. The primary limiting soil feature
for urban development and road construction is the soils limited ability
to support a load. Septic tank absorption fields will function properly,
however, community sewage systems should be provided if the population
density is increased. The permeability of the substratum may require
sewage lagoons to be sealed. Lawns , shrubs and trees for beautification
C. will do well.

4600 to 5200 feet. It formed in mixed outwash deposits .
Included in this unit are some soils with dark surface layers:. Stine :},;`,. .
leveled areas were also included in mapping. -
Typically the surface layer is grayish brown fine sandy loam about 10 -
inches thick. The subsoil is yellowish brown to very pale--brown fine
sandy clay loam about 14 inches thick. The substratum, to a depth of
• 60 inches , is calcareous fine sandy loam.
Permeability is moderate. Available water capacity is moderate.
<;:;e Effective rooting depth is 60 inches or more. Surface runoff is medium
and erosion hazard is low. •
Where irrigated this soil is suited to all crops adapted to this area,

including corn, sugar beets , beans , alfalfa; small grains , potatoes
and onions. An example of a suitable cropping system is alfalfa 3
to 4 years followed -by corn, corn for silage , sugar beets , small grain,
beans and back to alfalfa. Some conservation practices such as land
leveling, ditch lining and pipelines may ae needed for proper water
application.
All methods of irrigation are suitable with furrow irrigation the most
common type used. Barnyard manure and commercial fertilizers are
needed for top yields along with maintaining good organic matter content.

production ranges from 2200 pounds per acre in favorable years to 1800
y pounds per. acre in unfavorable years. When range condition deteriorates,Ogi ' sand bluestem, sand reedgrass and switchgrass decrease and blue grama, ,
sand dropseed and sand sage increase. Annual weeds and grasses invade
the site as range condition becomes poorer.
Management of vegetation on this soil should be based on taking half and

leaving half of the total annual production. Seeding is advisable if
range is in poor condition. Sand bluestem, sand reedgrass ; switchgrass ,

sideoats grama, blue grama, pubescent wheatgrass are suitable for seeding.
The grass selected should meet the seasonal requirements of livestock.
For successful seeding, a clean firm, sorghum stubble -- prepared the
growing season prior to seeding -- or a firm prepared seedbed and grass '
drill should be used. Early spring seeding has proven most successful
Windbreaks and environmental plantings are generally suited to this soil.
, Soil blowing is the principal hazard to establishing ,trees and shrubs. ;

Rapid expansion of the Greeley and surrounding area has resulted in
urbanization of much of this Olney soil. It has a good potential for
urban and recreational development. Its only limiting feature is the
moderately rapid permeability in the substratum and the hazard of con-
tamination of ground water from sewage lagoons. Lawns , shrubs and trees
for beautification will do well.

This is in answer to your request for soil survey information for a portion
of the SZSW' of Section 14, Twp. 6N, Range 66W, two miles west of Lucerne,
for the cutting, splitting and supply of firewood.
The area in question has the presence of two soil types. They are Kim
loam, 1 to 3 percent slopes (X53-B), and Olney fine sandy loam, 1 to 3
percent slopes (55-B). Copies of the description for each soil type and
a soils map are attached for your reference and information.
Both soil types have characteristics which are compatible with the intended
use. However, the Kim loam does have a moderate limitation for the construc-
tion of small commercial buildings due to a low strength characteristic in
the subsoil. Both soils have a moderate wind erosion hazard which indicates
the need to maintain surface soil protection. They both have a slight water
erosion hazard, however, this is not a problem on the site.
