receipt of this memorandum. If the Town has not received comments from your agency within this 30-day
review period, the Town will consider the lack of a response to be a positive response to the proposal in its
current form. However, for the purposes of having a complete file on this proposal, the Town would

Public Meeting: The Windsor Planning Commission will hold a public hearing at 7:00 p.m. on
Wednesday, April 21, 2004 and the Windsor Town Board will hold a public hearing at 7:00 p.m. on
Monday, April 26, 2004 to receive public comments on the enclosed annexation, both of these public
hearings will be held in Windsor Town Hall, 301 Walnut Street.

BEING A RESOLUTION MAKING CERTAIN FINDINGS OF FACT CONCERNING
THE RAINDANCE RIVER ANNEXATION TO THE TOWN OF WINDSOR,
COLORADO; DETERMINING SUBSTANTIAL COMPLIANCE WITH SECTION 31-
12-101, ET SEQ., C.R.S., "THE MUNICIPAL ANNEXATION ACT OF 1965"; AND
ESTABLISHING DATES FOR PUBLIC HEARINGS BEFORE THE PLANNING
COMMISSION AND THE TOWN BOARD OF THE TOWN OF WINDSOR,
COLORADO, WITH REGARD TO THE RAINDANCE RIVER ANNEXATION
WHEREAS, the Town Clerk has received a petition filed by Big Dog Development, LLC
to annex to the Town of Windsor certain real property known as the "Raindance River
Annexation"; and
WHEREAS, pursuant to The Municipal Annexation Act of 1965, the Town Board is
required to determine whether or not the aforesaid petition is in substantial compliance with the
requirements of said Act; and
WHEREAS, upon such determination, the Town Board is to set public hearing dates in
accordance with the requirements of said Act;
NOW, THEREFORE, IT IS FOUND AND RESOLVED BY THE TOWN BOARD OF
THE TOWN OF WINDSOR, COLORADO, AS FOLLOWS:
1. That pursuant to Section 31-12-107, C.R.S., a petition for annexation has been
filed with the Town Clerk for the annexation of certain real property known as the "Raindance
River Annexation," more fully and particularly described within said petition.
2. That the Town Board finds that the aforesaid petition is in substantial compliance
with Section 31-12-107(1), C.R.S.
3. That in accordance with the Town Board's determination, public hearings should
be held before the Planning Commission and the Town Board of the Town of Windsor,
Colorado, to determine if the proposed annexation complies with Sections 31-12-104 and 105,
C.R.S.
4. That a public hearing shall be held before the Planning Commission at 7:00 p.m.
on Thursday, May 6, 2004, at the Windsor Town Hall, 301 Walnut Street, Windsor, Colorado.
5. That a public hearing shall be held before the Town Board at 7:00 p.m. on
Monday, May 10, 2004, at the Windsor Town Hall, 301 Walnut Street, Windsor, Colorado.
6. That the Town Clerk, or her designee, shall give notice of the aforesaid hearings
in compliance with the Municipal Annexation Act of 1965.
Upon motion duly made, seconded and carried, the foregoing Resolution was adopted this
22nd day of March, 2004.

ANNEXATION PETITION
We the landowners of more than 50%of the territory, excluding public streets and alleys,
described as a portion of Section 29 and Section 30, Township 6N, Range 67W of the 6th
P.M., County of Weld, in the State of Colorado containing 223.72 acres more or less,
allege the following to be true and correct:
The perimeter of the proposed annexation has a distance of 13,038 feet, of which 9,156
feet are contiguous to the existing TOWN limits of the TOWN OF WINDSOR. A
minimum of 1/6 of the perimeter of the proposed annexation is contiguous to the TOWN
OF WINDSOR.
We further allege:
1. It is desirable and necessary that said territory be annexed to the TOWN OF
WINDSOR.
2. A community of interest exists between the said territory and the TOWN OF
WINDSOR.
3. Said territory will be developed in the near future.
4. Said territory is capable of being integrated with the TOWN OF WINDSOR.
5. No land held in identical ownership is divided into separate parcels unless the
owner of said tract has consented in writing or joins this Petition.
6. No proceedings for annexation of the territory have been commenced for
annexation to another municipality.
7. The signers hereof comprise the landowners of more than 50%of the territory
proposed to be annexed exclusive of streets and alleys, and are in fact owners
of 100%of the hereinafter described property.
Therefore, the undersigned hereby request that the TOWN OF WINDSOR approve the
annexation of the area described above and do herewith pay the required fees.
In addition to the annexation, the undersigned request the zoning of E-2 and I-PUD for
the above described property.

COLD ANNEXATION IMPACT REPORT
RAINDANCE RIVER ANNEXATION AND MASTER PLAN
The parcel proposed for annexation contains approximately 224 acres located
approximately 1/4 mile east of Weld County Road 13 (County Line Road); approximately '/
mile north of Weld County Road 64 (New Liberty Road); described as a portion of Sections
29 and 30, Township 6 North, Range 67 West of the 6`" P.M., Weld County, Colorado.
1) (a) Please see the enclosed master plan and vicinity map for current and proposed
municipal boundaries.
(b) Please see the enclosed utility map for current and proposed infrastructure.
(c) Please see the enclosed annexation map and master plan for the current and
proposed land use patterns of the proposed annexation.
2) The application materials did not include a draft or final pre-annexation agreement as
the Town of Windsor does not require a draft or final pre-annexation agreement at
this time.
3) Municipal services will be provided as follows:
➢ Water—The Town of Windsor will provide potable water service to the proposed
development and this potable water system will be constructed solely at the
developer's expense. A non-potable irrigation system will be required to be
constructed solely at the developer's expense in order to reduce the amount of
potable water required.
➢ Sewage Disposal — The Town of Windsor will provide sanitary sewer service to
the proposed development to be constructed by the developer solely at the
developer's expense.
Drainage Facilities— Drainage infrastructure per the Town's requirements is to be
constructed by the developer solely at the developer's expense.
➢ Fire Protection —Windsor-Severance Fire Protection District
➢ Police Protection —Town of Windsor Police Department
➢ School — Weld County School District RE-4 (enclosed please find an Impact
Statement from the School District)
4) Installation and financing of infrastructure extensions, as well as any applicable
reimbursements for previously oversized infrastructure to serve the subject property,
shall be the sole responsibility of the developer.
5) Enclosed please find a list identifying all existing districts within the area to be
annexed.
6) Enclosed please find an Impact Statement from Weld County School District RE-4.
All development proposals are required to comply with the Town of Windsor
Comprehensive Plan, Zoning and Subdivision Ordinances and applicable Corridor Plans.

Statement of Community Need
The following statement of community need is for the Raindance River
Annexation. The site is bounded by a combination of Town of Windsor and Weld
County residents. To the east,the site is bounded by an enclave Weld County resident
and the Poudre Heights Subdivision, to the south lies agricultural farmland, bluffs and
property previously annexed to the Town of Windsor, and to the west the site is bounded
by bluffs and farmland, and to the north the property is bounded by the B.H. Eaton Ditch
and the Poudre River. The Raindance River Annexation is intended to have mixed uses
from mining the aggregate deposits on-site to high-density estate residential
development. This development is beneficial to the Town of Windsor for several
reasons. The first of which is the reduction in the area that is currently an enclave within
the Town of Windsor. Secondly, the planned E-2 land use is intended to be developed in
a fashion that preserves the bluffs and the natural appearance that residents have enjoyed
for over a hundred years. Third,the Town sanitary sewer system shall be expanded west
along the Poudre River providing the opportunity for further growth to the west. Another
benefit to the Town of Windsor is the creation of a reservoir as a result of the mineral
extraction which shall be used for a non-potable water system within the proposed master
planned community. The Town of Windsor also benefits from the continuation of the
Poudre Trail system from the Poudre Heights Filing I through the property.
This project addresses the need to reduce existing enclaves and proposes a
community that blends in with the existing developments of the surrounding area. JCB
Engineering, LLC and the owners of this property look forward to working with the
Town of Windsor in providing a quality addition to the community.

ANNEXATION IMPACT STATEMENT
Raindance River is estimated to have 210 SF lots. Our current yield rate would
generate approximately 168 students to the school district. Using a class of 22
students per class this would generate the need for approximately 7.6 classroom
spaces. Using a value of about 800 sq. ft per classroom and a sq. ft build price of
$140 the capital impact is estimated to be $851,200. If students required bus
services the additional capital cost is estimated to be $187,850 for bus services.
Since this annexation would not be enough homes to support a land dedication the
district would request cash-in-lieu of land dedication fees at current rates which equal
$1214.57 per unit or$255,056.
