FOR SINGLE FAMILY DWELLING UNIT, OTHER THAN THOSE PERMITTED UNDER
SECTION 23-3-20.A OF THE WELD COUNTY CODE (GUEST HOUSE), IN THE
A (AGRICULTURAL) ZONE DISTRICT - DARLENE BLANEY
A public hearing was conducted on May 26, 2004, at 10:00 a.m., with the following present:
Commissioner Robert D. Masden, Chair

The following business was transacted:
I hereby certify that pursuant to a notice dated May 7,2004,and duly published May 12,2004,in the
Fort Lupton Press, a public hearing was conducted to consider the request of Darlene Blaney for
a Site Specific Development Plan and Use by Special Review Permit#1463 for a Single Family
Dwelling Unit,other than those permitted under Section 23-3-20.A of the Weld County Code(guest
house), in the A(Agricultural)Zone District. Bruce Barker,County Attorney, made this a matter of
record. Sheri Lockman, Department of Planning Services, presented a brief summary of the
proposal and entered the favorable recommendation of the Planning Commission into the record
as written. Ms. Lockman gave a brief description of the location of the site and surrounding uses.
She stated eight referral agencies reviewed this proposal,five responded with comments that have
been addressed through the Conditions of Approval, and staff received no comments from
surrounding property owners. She explained the site originally had one home and a bunkhouse,
which had running water but no septic. At some point the bunkhouse was removed and the
applicants were not allowed to reconstruct a nonconforming use. They were granted a Zoning
Permit fora Mobile Home(ZPMH)to be used during a medical hardship;however,during the annual
evaluation it was discovered that the mobile home was being used more for a guest house for the
parents than for a medical hardship. Staff denied the renewal request and the applicant was
directed to apply for a Use by Special Review Permit to address two dwelling units on a single
parcel; however, when no action was taken, a violation was issued. Ms. Lockman stated staff
recommends approval of this permit; however, if the application is denied, staff requests the
violation be forwarded to the County Attorney's Office, with a delay in action for 30 days.

Char Davis, Department of Public Health and Environment,and Peter Schei, Department of Public
Works, stated they have no comments at this time.
Tom Honn represented the applicant and stated the applicants are the fourth generation to farm this
80-acre property, and over the years the family has purchased adjacent properties, as well. He
stated the parents live in Wyoming, but come to visit on a regular basis since they are co-owners
of the farm. Mr. Honn stated at some point the old bunkhouse was replaced with a good quality
mobile home, and a ZPMH was approved for use by elderly parents. He stated during the
reevaluation process it was determined that there is not a medical hardship, the permit was not
reissued, and the applicants were required to apply for a Use by Special Review Permit. He
explained they considered splitting off a portion of the parcel through the Recorded Exemption
process; however, this process will allow the second residence for family use without creating a
separate parcel. Mr. Honn referenced Condition of Approval#1.D and requested direction from the
Board. Commissioner Vaad commented that Condition requires the applicant to provide a written
plan of how the mobile home will be removed if the use changes to ensure it is not hauled and
abandoned somewhere. Mr. Honn concurred. He stated this has been a very lengthy process for
the applicants for a use that had been there for many years. He suggested the Board consider
adopting a much simpler and less expensive administrative process similar to one used in Larimer
County for uses like this where there is a history of family use. He explained the property owner
submits a letter describing the use and the letter is recorded.
No public testimony was offered concerning this matter. Responding to Chair Masden, Mr. Honn
stated he and the applicant have reviewed and concur with the Conditions of Approval and
Development Standards as proposed, and they concur with the non-rental uses.
Commissioner Vaad moved to approve the request of Darlene Blaney for a Site Specific
Development Plan and Use by Special Review Permit#1463 fora Single Family Dwelling Unit,other
than those permitted under Section 23-3-20.A of the Weld County Code (guest house), in the
A(Agricultural)Zone District,based on the recommendations of the Planning staff and the Planning
Commission, with the Conditions of Approval and Development Standards as entered into the
record. The motion was seconded by Commissioner Jerke. Due to a recommendation of approval
from the Planning Commission without citations of the appropriate Code criteria, Commissioners
Vaad and Jerke indicated their motion for approval is based on compliance with
Sections 23-2-230.6.1 through B.7 of the Weld County Code. There being no further discussion,
the motion carried unanimously and the hearing was completed at 11:45 a.m.
