A copy of roadway construction plans was included in the application and consequently there were no plat notes available for review. The Department recommends approval with the following conditions: 1. Water service shall be obtained from the North Weld County Water District. 2. A Weld County Septic Permit is required for each proposed septic system and shall be installed according to the Weld County Individual Sewage Disposal System Regulations. Each septic system shall be designed for site-specific conditions, including but not limited to maximum seasonal high groundwater, poor soils, and shallow bedrock. 3. If required, the applicant shall obtain a storm water discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and the Environment. Silt fences shall be maintained on the down gradient portion of the site during all parts of the construction phase of the project. 4. During development of the site, all land disturbances shall be conducted so that nuisance conditions are not created. If dust emissions create nuisance conditions,at the request of the Weld County Health Department, a fugitive dust control plan must be submitted. 5. In accordance with the Regulations of the Colorado Air Quality Control Commission any development that disturbs more than 5 acres of land must incorporate all available and practical methods that are technologically feasible and economically reasonable in order to minimize dust emissions. 6. If land development creates more than a 25-acre contiguous disturbance,or exceeds 6 months in duration,the responsible party shall prepare a fugitive dust control plan, submit an air pollution emissions notice, and apply for a permit from the Colorado Department of Public Health and Environment. 7. "Weld County's Right to Farm" as provided in Appendix 22-E of the Weld County Code shall be placed on any recorded plat. Farms Estates LLC COLORADO I have reviewed the Improvements Agreement According to Policy Regarding Collateral for Improvements (private road maintenance) utilizing the plat drawing to verify quantities and unit cost for the estimated construction. All the transportation items appear to be adequate to . complete the project. I have verified with Jim Rawson, representative for the developer, that the street base item is included in the street grading estimate. I have verified these numbers and agree with Mr. Rawson. I indicated that a stop sign and a street name signs are required at the entrance and intersection to the development. Mr. Rawson agreed to place the signs. . The second agreement for Improvements to WCR 80 for Road Stabilization and Dust Control was reviewed. In verified the approximate road length on WCR 80 and the 25% of the cost towards stabilizing the road. The developer agrees to escrow monies as each lot is sold for $1812.50, and the total for all lots if $14,500. I have verified the number of lots per the escrow sales. The Weld County Public Works Department recommends acceptance of both agreements. F states Estates Minor Subdivision(Final Plat) Weld County Public Works Department has reviewed final plan materials and has the following development referral comments. Comments ❑ The Public Works Department has accepted the Geotechnical Engineering Report for Proposed W.B. Farms 8-Lot Development dated October 10, 2003,by Northern Colorado Geotech. ❑ The Public Works Department has accepted the Drainage Report for W.B. Farms Estates Subdivision dated April 2003,by Diane Houghtaling, P.E. ❑ A correction must be made to the easement call-out on the north Outlot on Sheet 1 of 1 for the Final Plat MZ-1001. The easement should read: "20' UTILITY& ACCESS EASEMENT". ❑ A modification must be made on Sheet 1 of 1 for the Cover Sheet. The Typical Section (roadway) shall note the gravel-surfaced roadway requires an 8-inch aggregate base course as reflected in the geotechnical report. ❑ A revision must be made on the Street Plan and Profiles drawings. The internal road (edge of roadway radius) shall be shown and dimensioned as 50-feet for all cul-de-sacs. ❑ Sight distance triangles at all entrances (including CR 80) and intersections shall be shown on the roadway plans. All landscaping within the triangles must be less than 31/4 feet in height at maturity as a note on the final plat. ❑ A note shall be placed on the final plat stating that the homeowners association will accept and provide uninterrupted maintenance of WB Farms Road and Hill Road. ❑ The applicant shall submit to Public Works stamped, signed and dated final plat drawings and roadway/construction plan drawings for review and approval. This is consistent with County Code: Sec. 24-3-50, "The minor subdivision final plat submitted shall contain the original signatures and seals of all parties required." The submitted final plan sheets dated July 7, 2003, were not signed. Certified drawings will remain in the department's file for use during construction. ❑ The applicant shall prepare a construction detail for typical lot grading with respect to drainage to be included with the construction plans. Front, rear and side slopes around building envelopes must be addressed. In addition, drainage for rear and side lot line swales shall be considered. Building envelopes must be planned to avoid storm water flows,while taking into account adjacent drainage mitigation. The submitted final plan drawings dated October 31, 2003,did not include this detail. ❑ The applicant has submitted on-site and off-site Improvements Agreements, which are being currently reviewed by Public Works. An agreement shall be approved by the BOCC prior to recording the final plat. Recommendation ❑ The above comments are prerequisites and shall be fulfilled prior to recording the final plat. Any issues shall be resolved with Public Works prior to recording of the final plat.' B. Farm Estates Minor Subdivision Final Plan for eight (8) Estate Zoned Lots (WB Farm Estates) MF-1001 1. A separate building permit shall be obtained prior to any construction. Bus shelters, entrance gates and similar structures, if provided, require permits. 2. A plan review is required for each building. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when applying for each permit. 3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 1997 Uniform Building Code, 1998 International Mechanical Code, 1997 International Plumbing Code, 2002 National Electrical Code and Chapter 29 of the Weld County Code. (Weld County intends to adopt the 2003 International Building, Residential, Mechanical, Plumbing and Fuel Gas Codes in the first quarter of 2004). 4. Each building will require an engineered foundation based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. 5. Building height, wall and opening protection and limitations and separation of buildings of mixed occupancy shall be in accordance with the Building Code. Setback and offset distances shall be determined by the Zoning Ordinance. 6. Building height shall be measured in accordance with the 1997 Uniform Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. When measuring buildings to determine offset and setback requirements, buildings are measured to the farthest projection from the building. Property pins shall be located and identified and property lines sufficiently identified by strings so as to positively verify all setback and offset distances. Water Division 1,Water District 3 Dear Mr. Ogle: We have reviewed the above referenced proposal to subdivide a 28.42-acre parcel described as Lot A of the Recorded Exemption RE-3473, into 8 single-family residential lots of approximately 2.5 acres in size. The proposed water source for the residential lots is listed as the North Weld County Water District (District). A letter of commitment from the District was included in the referral material. The letter indicates that, the District is able and intends to serve the proposed lots in the subdivision per terms and conditions of the District. The developer will be responsible for the extension of the water line to the subdivision. Based on current records on file in this office, the District currently has an adequate uncommitted water supply to provide the water associated with this project. A Water Supply Information Summary was not included in the referral material. Pursuant to Section 30-28-136(1)(h)(II), C.R.S., it is the State Engineer's opinion that with the District being the proposed water supplier, there is expected to be satisfactory water supply and can be provided without causing material injury to existing water rights. The sheriff's office requests that builders and developers designate an area by the entrance of the sub-division in which to place a shelter for school children awaiting the school bus. This area should also include a pull off for the school bus which enables it to safely load and unload children out of the roadway in the event the bus is unable to drive down the street due to road conditions. 2. Either a mail distribution within the sub-division or a central drop off location within the sub-division should be developed so that residents do not have to cross a county roadway to obtain their mail. 3. The name of the street within the sub-division should be presented to the sheriffs office for approval. This will eliminate duplication of street names within the county. . 4. A permanent sign should be placed at the entrances to the sub-division detailing the name of the sub-division, and address. There should be a plan developed to maintain this sign. 5. If the roadways within this sub-division are not maintained or adopted by the county, individuals purchasing property in this sub-division should be notified that the sheriffs office will have limited traffic enforcement powers. 6. A plan should be developed to maintain roadways within the sub-division especially during inclement weather conditions for emergency vehicles. 7. The sheriffs office is very supportive of homeowner funded homeowners associations. These associations provide a contact for the sheriffs office and a means for maintaining common areas. 8. The plans for this sub-division show roadway with no sidewalks. The sheriff's office requests that sidewalks be provided. The Sheriffs Office lacks the ability to absorb any additional service demand without the resources recommended in the multi-year plan provided to the Board of County Commissioners or as indicated by growth not considered at the time the plan was developed. I have no other comments on this proposal. When developing a new subdivision, we ask that the developer consider the following: a. The road leading to the subdivision must be maintained so that a school bus can safely drive down that road in all weather conditions, which includes the stability of that road and making sure that the width is enough for two vehicles to pass safely. b. We prefer that instead of a pull-off that there be a turn-around big enough for a bus to maneuver safely and not back up. We find that this is safer for the children that are loading or unloading. c. Here are the dimensions for a bus to be able to turn around without backing up...
