HomeMy WebLinkAbout20040948.tiff HEARING CERTIFICATION DOCKET NO. 2004-33 RE: SITE SPECIFIC DEVELOPMENT PLAN AND AMENDED USE BY SPECIAL REVIEW PERMIT #851 FOR A CHILD CARE CENTER IN THE A (AGRICULTURAL) ZONE DISTRICT -ALTERNATIVE HOMES FOR YOUTH A public hearing was conducted on April 14, 2004, at 10:00 a.m., with the following present: Commissioner Robert D. Masden, Chair Commissioner William H. Jerke, Pro-Tern Commissioner M. J. Geile Commissioner David E. Long Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Chris Gathman Health Department representative, Char Davis Public Works representative, Donald Carroll The following business was transacted: I hereby certify that pursuant to a notice dated March 31,2004,and duly published April 3,2004, in the Fort Lupton Press,a public hearing was conducted to consider the request of Alternative Homes for Youth for a Site Specific Development Plan and Amended Use by Special Review Permit#851 for a Child Care Center in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Mr. Gathman stated the facility will house 22 youths, and he gave a brief description of the surrounding uses and the location of the site,which is completely surrounded by the City of Longmont. He stated 14 referral agencies reviewed this proposal,and 11 responded with comments that have been addressed in the Conditions of Approval and Development Standards. He further stated the property is within the Longmont Intergovernmental Agreement (IGA) area, and although Longmont is not opposed, it does recommend the applicant be required to provide pedestrian access. Mr.Gathman stated the original Use by Special Review Permit was granted on August 19, 1988, for 18 youths; however, the applicant is in the process of constructing a modular building for additional living space and classrooms which would be allowed under this amendment. He stated staff determined that"Child Care Center"is the appropriate classification,although some of the residents are over the age of 16, because they do receive child care funds from the state. Mr. Gathman requested Condition of Approval#1.D be moved to Condition#5.C because the site does have an existing tap,and that the language be modified to state"The applicant shall address all requirements of the Left Hand Water District." He stated the applicant has satisfied Condition #1.C, therefore, it can be deleted. In response to Commissioner Geile, Mr. Gathman stated currently 11 youth live in the house,the old modular shown on the left of the aerial photograph has been removed, and there is a modular on the north end of the site located behind the house. He further stated there will only be two structures with classrooms and a house with 22 residents. Char Davis, Department of Public Health and Environment, stated she has no comments. /5/(67') ,l/,) 2004-0948 PL1711 5 L'y HEARING CERTIFICATION -ALTERNATIVE HOMES FOR YOUTH (AMUSR #851) PAGE 2 Donald Carroll,Department of Public Works,stated the facility is accessed from Highway 119,and there is adequate parking space for all of the structures. Jean Osborn,Project Coordinator,represented the applicant. In response to Commissioner Geile, Ms.Osborn stated 11 boys will reside in the main house,there are classrooms on the top floor,and the facility has staff present 24 hours a day,seven days a week. She stated two years ago McStain donated a one-story structure that has a basement,which will house 11 girls. The modular will only be used for arts, crafts, and classes. Responding further to Commissioner Geile, Ms. Osborn stated they have a lot of on-call staff,there are typically 10 to 12 employees on the site at any given time, the staff rotates shifts, and none of the employees live on the site. No public testimony was offered concerning this matter. In response to Chair Masden,Ms.Osborn stated she has reviewed and concurs with the Conditions of Approval and Development Standards as proposed and modified. She further stated LaFarge is currently preparing a proposal for paving the parking areas. Responding to Commissioner Geile, Ms. Osborn stated Alternative Homes for Youth is 501(c)3,they have a treatment center, one facility in Greeley with 24 boys,two homes in Golden, and this facility in Longmont. Commissioner Geile moved to approve the request of Alternative Homes for Youth for a Site Specific Development Plan and Amended Use by Special Review Permit#851 for a Child Care Center in the A(Agricultural)Zone District,based on the recommendations of the Planning staff and the Planning Commission,with the Conditions of Approval and Development Standards as entered into the record. His motion also included deleting Condition of Approval#1.C, moving Condition of Approval#1.D to Condition#5.C and modifying the language to state,"The applicant shall address all requirements of the Left Hand Water District",and renumbering or relettering as appropriate. The motion was seconded by Commissioner Long,and it carried unanimously. There being no further discussion, the hearing was completed at 10:25 a.m. This Certification was approved on the 19th day of April 2004.
