This project falls primarily under the purview of the Use by Special Review, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS: WCR 1 (County Line Road) is designated on the Weld County Road Classification Plan (FHU) as a collector status road, which requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. The section of road is NOT maintained by Weld County. Larimer County maintains this section of County Line Road. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3- 50, the required setback is measured from the future right-of-way line. Traffic Counts: Our most recent average daily traffic count (ADT) reflects 2,288 vehicles taken in 2003. The ' affic count was taken on WCR 1 between WCR 32 and WCR 38. REQUIREMENTS: Access: There is only one access to the facility. There is wooden fencing on both sides of the access approach. I recommend cutting or mowing the weed/grass area in both directions at the entrance to provide additional sight distance. The opening of the site is a one-way configuration. Use caution and egress/ingress with the truck from the site. WCR 2 in Larimer County is an off-set intersection located directly south of the access point. The applicant should be aware that there are two locations that approaching cars from the south could appear. Off-Street Parking and Circulation: The applicant indicated in the questionnaire that the volume utilizing the site would be the residents. Circulation and parking is available on site. The applicant indicated that there will be a semi-truck approximately five times per year visiting the site. There is enough room to negotiate turning of the truck. Storm Water Drainage: The applicant indicated that no additional structures or paved parking is being proposed on the site. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application from the Air Pollution Control Division (APCD), Colorado Department of Health and Environment. Alternately, the applicant can provide evidence from the APCD that they are not subject to these requirements. 2. The applicant shall submit a dust abatement plan for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. 3. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan". 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan at all times. 6. The facility shall have sufficient equipment available to implement dust control as required by the Weld County Department of Public Health and Environment. 7. There shall be no open burning conducted on the site, with exception to burning defined as "agricultural open burning" as defined by Regulation No. 9 of the Colorado Air Quality Control Commission Regulations, 4. This facility shall adhere to the maximum permissible noise levels allowed in the Residential Zone as delineated in 25-12-103 C.R.S., as amended. 9. Adequate handwashing and toilet facilities shall be provided. 16.Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 11.The facility shall utilize the existing public water supply. COLORADO July 21, 2004 James Stepanek USR-1484 A Site Specific Development Plan and special Review permit for a use by right in the Industrial Zone Districts (sandblasting business) in the A (Agricultural) Zone District. 1. A building permit shall be obtained prior to the construction of any new building and change of use of the existing building. 2. A plan review is required for each building for which a building permit is required. Plans shall include a floor plan. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when applying for each permit. Provide a Code Analysis Data sheet provided by the Weld County -auilding Department with each Building permit application. 3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2003 International Building Code; 2003 International Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; and the 2002 National Electrical Code and Chapter 29 of the Weld County Code. 4. The change of use will probably be classified as a mixed use F (Sandblasting) and S-1 (storage) occupancy. Contact Berthoud Fire Protection District for their requirements for storage of diesel fuel. Fire resistance of walls and openings, construction requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning Ordinance. 5. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. The violation was initiated as a result of a commercial sand blasting operation without a Use by Special Review(USR)permit. The property owner has since submitted this Use by Special Review (USR-1484) application to the Department of Planning Services. This violation was presented to the Board of County Commissioners through the Violation Hearing process on October 14,2003. The Board of County Commissioners referred this case to the County Attorney's Office,but delayed legal action for 90 days (January 14, 2004). Should this Use by Special Review(USR-1484)application be approved,the plat shall be recorded within 30 days of approval to avoid revocation proceedings. As soon as the plat has been recorded,this violation will be closed. Should this Use by Special Review (USR-1484) application be denied, the applicant shall have 30 days to remove all commercial equipment and associated activity prior to proceeding with the violation process. The sheriffs office would however be willing to provide a program entitled Crime Prevention Through Environmental Design to the developer. This program reduces the likelihood of criminal activity at a specific location by"hardening" it to crime. The Sheriffs Office lacks the ability to absorb any additional service demand without the resources recommended in the multi-year plan provided to the Board of County ~ Commissioners or as indicated by growth not considered at the time the plan was developed. I have no other comments on this proposal. ea. Hello
