RESOLUTION
RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT #891 - MICHAEL
ARRINGTON
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,by Resolution dated November 22, 1989,the Board did approve Use by Special
Review Permit#891 for an Agricultural Service Establishment (decorative rock sales and ditch
cleaning business) for Thomas and Peggy Fisher on the following described real estate, to-wit:
Part of the S1/2 SE1/4 of Section 33, Township 5
North, Range 65 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board has received a request from the current property owner, Michael
Arrington, 4638 23rd Street, Greeley, Colorado 80634, to vacate said Use by Special Review
Permit#891, since the use is no longer being performed on the property and said vacation is a
Condition of Approval for Use by Special Review Permit#1454, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendations of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said vacation.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit#891 be, and hereby is, vacated.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 19th day of July, A.D., 2004.

SUBJECT: Vacation of USR-891
The Department of Planning Services has received the attached letter dated June 18, 2004
from Michael K. Arrington. Mr. Arrington is requesting that USR-891 be vacated from his
parcel, 0961 33 000054, since the use is no longer being performed on the property and is a
condition of approval, #1.E, of USR-1454.
Background information:
Legal Description: Lot A of RE-735; being part of the SE4 Section 33, T5N, R65W of the 6th
P.M., Weld County, CO.
Location: North of and adjacent to County Road 50 and %2 mile West of County
Road 43
USR-1000: USR-891 was approved by the BOCC on November 22, 1989, for a Site
Specific Development Plan and Special Review Permit for an Agricultural
Service Establishment (Decorative Rock Sales and Ditch Cleaning
Business) in the Agricultural Zone District.
