I am a neighbor of the development and live west of and adjacent to the proposed Final Plat. This development is high-quality in design. These homes and the end use of the property will be very compatible with surrounding properties. This development will help me as an individual in the following ways: • The high quality design and nice stick-built houses will make my property more valuable and attractive. • The development will be controlled by Covenants and a Homeowners Association. • Two fire hydrants will be installed. These hydrants can be used for any property in the area. • The applicants are bringing in a North Weld County Water District line, saving me $40,000.00. If I were to bring in a line to serve my property, it would have cost $60,000.00. I am using a Cistern now and am looking forward to having North Weld County Water. • The irrigation design will provide me with another option to pull my irrigation water. We all share the lines used to pull water. It is often hard to find people who want to irrigate at the same time. I will now have another option. This development is a nice example of combined uses — existing agricultural under a center pivot and Lots 1 — 8. I support this application. The Board's decision shall consider the recommendation of the Planner, referral agency responses and the application case file to determine compliance with Subsections 2.a through 2.h: a. Consistent with Chapters 19, 22, 23, 24 and 26 and any applicable IGA. b. Proposed Uses conform to the performance standards outlined in Article II. c. The Weld County Planning Department case number for the Change of Zone was AMPZ-613. The affected property is described as follows: Lot C, recorded exemption, RE-2637; part of the SW/4 of Section 9, T6N,R66W of the 61h P.M., Weld County, Colorado. Bonanza Creek Operating Company, LLC (Bonanza) represents that it is the current Lessee under four(4)Oil and Gas Leases dated December 3, 1984, between Gutterson& Company as Lessor and Cache Exploration, Inc., as Lessee, covering all of Section 9, T6N, R66W containing 640 acres (Leased Lands). By letter dated September 1 I,2003, Bonanza advised the Weld County Department of Planning Services that Bonanza would not object to the Proposed Development assuming it will not hinder continued operations and maintenance of Bonanza's existing or future oil and gas wells and facilities Now therefore, Bonanza hereby agrees that Bonanza will not oppose or object to the proposed development as shown on Exhibit"A" attached hereto. Cattail, for itself, successors and assigns recognizes and agrees not to interfere in any way with Bonanza's rights of ingress, egress and operations including reworking, redrilling and deepening of Bonanza's existing wells and facility locations and Bonanza's rights to reasonable use of the surface to develop additional wells and facility locations in accordance with State of Colorado Rules and Regulations so long as Bonanza continues to have a legal right to do the same. Cattail shall not construct an occupied structure within 300' of Bonanza's existing well and facility locations. Additionally, Cattail agrees not to construct any occupied structures within the "Colorado Oil and Gas Construction Commission Rule 318A Drilling Window" identified in the SW'/< of Section 9 on Exhibit A attached hereto and made a part hereof without the written consent of Bonanza, which consent shall not be unreasonably withheld.
