My husband and I have recently purchased a piece of property, described above, on which Union Pacific owns the mineral rights. We are In the process of applying for a special use permit in order to build a personal residence. Our first meeting with the Weld County Planning Commission with regard r to our permit will be held on December 16. We are required by the Weld County Planning Code to notify you as the Agent for Union Pacific Railroad of all commission meetings regarding this permit. In order to facilitate and expedite the permitting process, I have prepared the attached waiver of right of notice of the Commission meetings. I request that you sign the attached waiver as agent for Union Pacific Railroad and return it to me in the enclosed envelope. Having this waiver completed will help us in our desire to quickly obtain a permit for building our new residence. Also attached is a site plan proposed for the subject property. We don't anticipate that our plans to build a personal residence will in any way effect the mineral rights owned by Union Pacific Railroad. However, in order to complete the special use permit requirements we will require a letter from you as agent for Union Pacific Railroad stating that our plans do not effect the current or future plans for mineral extraction on this property(as stated in Weld County Code Sec. 23-2-260(Bx14)).
