RESOLUTION NO.2003-012
A RESOLUTION OF THE CITY COUNCIL OF FORT LUPTON AMENDING SECTION
6.3 OF THE COORDINATED PLANNING AGREEMENT WITH WELD COUNTY TO
ALLOW AUTOMATIC RENEWAL OF THE AGREEMENT AND TERMINATION OF
THE AGREEMENT WITH 12-MONTHS NOTICE.
WHEREAS,the state of Colorado has authorized and encouraged local governments to
cooperate and contract with each other for the purpose of planning and regulating the
development of land by the joint and coordinated exercise of planning, zoning,
subdivisions, building and related regulatory powers; and
WHEREAS,existing and anticipated pressures for growth and development in areas
surrounding the City of Fort Lupton indicate that the joint and coordinated exercise by
Weld County and Fort Lupton of their respective planning, zoning, subdivision, building
and related regulatory powers in such areas will best promote the objectives of the
Intergovernmental Agreement
WHEREAS,the City Council has reviewed the proposed amendment to the IGA with
Weld County and maintains that the needs and concerns of the Fort Lupton City Council
are satisfied; and
WHEREAS, the Fort Lupton City Council has a commitment to orderly growth and
development through regional cooperation with Weld County; and
WHEREAS, the Fort Lupton Planning Commission recommended adoption of the
amendment as presented on April 22, 2003.
NOW THEREFORE BE IT RESOLVED that the Fort Lupton City Council
hereby adopts the amendment to Section 6.3 of the Intergovernmental Agreement with Weld
County regarding future growth areas.

Chris Gathman, Department of Planning Services, originally requested a continuance as a result of failure to -
notify mineral owners and lessees within thirty days of the Planning Commission hearing. However the
Planning Department recently received written statements from the mineral owners and lessees agreeing to
waive the thirty day notice requirement. As that was the only reason for the continuance request,and because
the applicants were present, Planning was prepared to proceed with the case at this hearing.
The Chair agreed to hear the case immediately following the hearing items. James Rohn said he had received
the information on Case USR-1431, but as it was likely to be continued, he had not prepared adequately to
vote on the case. The Chair said Case USR-1431 would then be heard after the consent items.

James Rohn asked to have the case heard. John Folsom questioned why the agenda lists the case as MF-
1042,and on the summary sheet it is MS-603? Mr.Gathman clarified that when it was originally set up it was
M F-1042,but our new numbering system has changed it to MS-603 and all of the surrounding property owners
have been notified. Mr. Folsom also didn't recall having final plat cases heard in the past. Mr. Gathman said
hearings are held for minor subdivision applications but not for PUD's. The Chair asked if there was anyone
in the audience that wanted this removed from the consent agenda? Seeing none, it remained.

John Folsom questioned verbage regarding the word"modification". Ms. Mika explained that the change is
to the automatic renewal date plus change the effective date because these old agreements had effective
dates, but did not include termination dates. The IGA remained the same except for the time parameters
associated with it.
Stephen Mokray moved that all five County Code cases on the consent agenda be recommended for approval.
John Folsom seconded the motion. Mr. Rohn voted against approval. Motion carried 4 to 1.

Upon consideration and review of the proposed Town of Kersey Coordinated Planning Agreement,
and after hearing testimony and reviewing all the evidence presented, motion was made by Commissioner

Chris Gathman, Department of Planning Services, originally requested a continuance as a result of failure to
notify mineral owners and lessees within thirty days of the Planning Commission hearing. However the
Planning Department recently received written statements from the mineral owners and lessees agreeing to
waive the thirty day notice requirement. As that was the only reason for the continuance request,and because
the applicants were present, Planning was prepared to proceed with the case at this hearing.
The Chair agreed to hear the case immediately following the hearing items. James Rohn said he had received
the information on Case USR-1431, but as it was likely to be continued, he had not prepared adequately to
vote on the case. The Chair said Case USR-1431 would then be heard after the consent items.

have been notified. Mr. Folsom also didn't recall having final plat cases heard in the past. Mr. Gathman said
hearings are held for minor subdivision applications but not for PUD's. The Chair asked if there was anyone

until June 30, 2004, with an annual automatic renewal, and a 12 month

RESOLUTION APPROVING THE INTENT TO CONTINUE WITH THE
CURRENT INTERGOVERNMENTAL PLANNING AGREEMENT WITH WELD
COUNTY
WHEREAS, the purpose of the Agreement is to establish procedures and standards
pursuant to which the parties will move toward greater coordination in the exercise of their land
use policies and related regulatory powers within unincorporated areas surrounding the Town;
and
WHEREAS, the Town of LaSalle and Weld County now desire to continue with the
spirit of the existing Agreement until a formal meeting of the Town Board and the Weld County
Planning Commission can be scheduled; and
WHEREAS, the objective of such efforts are to accomplish the type of development in
such areas which best protects the health, safety,prosperity, and general welfare of the
inhabitants thereof by reducing the waste of physical, financial, and human resources which
result from either excessive congestion or excessive scattering of population, and to achieve
maximum efficiency and economy in the process of development; and

County and the City of Fort Lupton has a termination provision in Section 6.3. The current
version of Section 6.3 says that the Agreement will terminate on June 30, 2004. We are now
updating all of the Coordinated Planning Agreements to which Weld County is a party to amend
Section 6.3 so that the Agreement continues without interruption,unless one of the parties
decides to terminate upon giving notice to the other party.

Chris Gathman, Department of Planning Services, originally requested a continuance as a result of failure to
notify mineral owners and lessees within thirty days of the Planning Commission hearing. However the
Planning Department recently received written statements from the mineral owners and lessees agreeing to
waive the thirty day notice requirement. As that was the only reason for the continuance request,and because
the applicants were present, Planning was prepared to proceed with the case at this hearing.
The Chair agreed to hear the case immediately following the hearing items. James Rohn said he had received
the information on Case USR-1431, but as it was likely to be continued, he had not prepared adequately to
vote on the case. The Chair said Case USR-1431 would then be heard after the consent items.

have been notified. Mr. Folsom also didn't recall having final plat cases heard in the past. Mr. Gathman said
hearings are held for minor subdivision applications but not for PUD's. The Chair asked if there was anyone

John Folsom seconded the motion. Mr. Rohn voted against approval. Motion carried 4 to 1.

Attached is the information referring to a review of the Coordinated Planning Agreement scheduled for June 3,
2003. The map attached is the map Weld County has on record; please indicate if the area affected is correct. If the map
is not correct or requires modification, please send a hard copy and digital copy of the updated map. Also please notify
Weld County Department of Planning Services of the need for modification. This will require additional notification time to
the process.
I, Monica Daniels-Mika, Director of Planning Services, will present this Coordinated Planning Agreement
modification to the Weld County Planning Commission. If there are any additional questions please do not hesitate to
contact me.
