Patina owns oil and gas leases that provide the right to drill additional wells on the Property. Patina is concerned about the impact the Amendment will have on Patina's ability to drill future wells and install related pipelines, access roads and production facilities on the Property. Patina has not had any direct discussions with Aggregate Industries-WCR Inc. ( the "Owners") relative to this matter. There is currently no agreement with the Owners and Patina has received no written confirmation from the Owners that Patina's real property rights to use a reasonable portion of the surface for oil and gas operations and development are being r preserved. Patina requests assurance from the Weld County Department of Planning Services that the Amendment will not preclude Patina from drilling, producing, operating, and maintaining future wells and related facilities. Until this matter is resolved by agreement with the Owners, Patina is not waiving its rights as a leasehold owner. Any approval of the Amendment should be conditioned upon the preservation of Patina's real property rights that allow it to make reasonable use of the surface of the lands for oil and gas development and operations. The Amendment must take into account and provide adequate setbacks from Patina's future well sites, pipelines and production facilities as well as continuous access to these facilities. Until such time as an agreement is reached between Patina and the Owner, Patina respectfully requests that the Weld County Department of Planning Services withhold approval of the Amendment or grant conditional approval subject to Patina and the Owner reaching an agreement. Patina requests that these comments he entered into the record for the Amendment and that we continue to be provided with advance notice of all other hearings affecting the Property.
