HomeMy WebLinkAbout20040444.tiff RESOLUTION RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION VI#0300017 ' AGAINST MARK HOUGH FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Mark Hough, VI #0300017, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 10th day of February, 2004, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Mark Hough was not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board deems it advisable to bring legal action against those individuals named above to correct said violation. I contacted him and was told Mark Hough now owns the property but is trying to sell it. He requested I send a building permit application and he will submit it. April 11, 2003 10-day letter to Mark Hough advising a building permit shall be submitted. I left messages on November 21 and December 3, 2003, at your office and received no response. I first contacted Mr. and Mrs. Schultis on February 19, 2003, regarding the uncompleted building permit at 45001 County Road 15. I received a call from Mrs. Schultis stating they no longer owned the property. In doing research, it was noted that New Frontier Bank purchased the property on November 25,2002,and you bought the property on January 8, 2003. I contacted Fred Allison and he told me you owned the property but were attempting to sell it. At his request, I sent him a building permit application to apply for a new building permit as there had been a change of ownership. After no response from him, I sent a letter addressed to you at 45001 County Road 15 which was returned. I mailed a letter to Mr.Allison on May 8,2003. I received no response so I again sent you a letter dated June 4, 2003, and again, it was returned. I spoke with Fred Allison on July 1, 2003, and he stated Erbes Construction purchased the property and would be in to get a new building permit. I contacted Ron Erbes of Erbes Construction and,as of October 2, 2003, he had not purchased the property and has not decided if he is going to purchase it. As of this date, the property known as Lot B of Recorded Exemption 1654, part of the SE4 of Section 18, Township 8 North, Range 67 West, 45001 County Road 15, remains under your ownership.
