RE: APPROVE AMENDED PLANNED UNIT DEVELOPMENT FINAL PLAN, AMPF #420,
FOR LOT LINE ADJUSTMENT ONLY - DENNIS AND JO ANNE ADLER
WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 2nd day of
June, 2004, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the
application of Dennis and Jo Ann Adler, 520 Main Street, Suite A, Longmont, Colorado 80501, for
Amended PUD Final Plat,AMPF#420,for Lot Line Adjustment only,on the following described real
estate, to-wit:
Lots 8 and 9, Block 16, Meadow Vale Farm 2nd Filing;
located in the Southwest 1/4 of Section 4, Township
2 North, Range 68 West of the 6th P.M., Weld
County, Colorado
WHEREAS, Dennis and Jo Anne Adler, applicants, were present, and
WHEREAS,Section 27-8-40.B of the Weld County Code provides for minor modifications
to be made to final plans, utilizing the standards for review being those set forth in Section
27-7-40.D, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present,studied the request of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented in this matter and, having been
fully informed, finds that this request shall be approved for the following reasons:
1. The submitted materials are in compliance with the application requirements of
Section 27-7-30 of the Weld County Code.
2. It is the opinion of the Board of County Commissioners that the applicant has shown
compliance with Section 27-7-40.D of the Weld County Code,including specifically:
a. Section 27-7-40.C.1--That the proposal is consistent with Chapters 19, 22,
23, 24 and 26 of the Weld County Code and any intergovernmental
agreement in effect influencing the PUD. The proposed PUD Final Plan is
consistent with all the applicable chapters of the Weld County Code.The lot
line adjustment will not affect any existing utility easement(s) as no utility
easement is designated along this lot line.The proposed lot line adjustment
does not substantially change the subdivision. The site is located within the
Longmont IGA area. The City of Longmont indicated no conflict in their
referral response dated April 20, 2004.

b. Section 27-7-40.C.2--That the uses which would be allowed in the proposed
PUD will conform with the performance standards of the PUD Zone District
contained in Article II, Chapter 27 of the Weld County Code. The proposal
does not affect the performance standards as approved by the Board of
County Commissioners for the Meadow Vale Farm 2n° Filing Final Plan.
c. Section 27-7-40.C.3 --That the uses which would be permitted will be
compatible with the existing or future development of the surrounding area
as permitted by the existing zoning, and with the future development as
projected by Chapter 22 of the Weld County Code or master plans of
affected municipalities. This proposal is located within the referral
boundaries of the Towns of Frederick and Firestone and the City of
Longmont. The City of Longmont indicated no conflict with their interests.
The Towns of Frederick and Firestone have been contacted by planning
staff. The Town of Firestone indicated no conflict and no response has been
received from the Town of Frederick.
d. Section 27-7-40.C.4--That adequate water and sewerservice will be made
available to the site to serve the uses permitted within the proposed PUD in
compliance with the performance standards in Article II, Chapter 27 of the
Weld County Code.The site is serviced by Left Hand Water District and St.
Vrain Sanitation District.
e. Section 27-7-40.C.5-- That street or highway facilities providing access to
the property are adequate in functional classification, width, and structural
capacity to meet the traffic requirements of the uses of the proposed PUD
Zone District. The proposal does not affect transportation facilities.
f. Section 27-7-40.C.6 — In the event the street or highway facilities are not
adequate, the applicant shall supply information which demonstrates the
willingness and financial capacity to upgrade the street or highway facilities
in conformance with the Transportation Sections of Chapters 22, 24 and 26,
if applicable. The proposal does not affect transportation facilities.
g. Section 27-7-40.C.7-- That there has been compliance with the applicable
requirements contained in Chapter 23 of the Weld County Code regarding
overlay districts, commercial mineral deposits, and soil conditions on the
subject site. Issues regarding overlay districts,commercial mineral deposits,
and soil conditions were addressed during the original final plan, S-420(2nd
Filing).
h. Section 27-7-40.C.8--/f compatibility exists between the proposed uses and
criteria listed in the development guide, and the final plan exactly conforms
to the development guide. The proposed PUD Final Plan uses are
compatible with the criteria listed in the development guide.

NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application of Dennis and Jo Anne Adler, for Amended Planned Unit
Development Final Plan,AMPF#420,for Lot Line Adjustment only,on the hereinabove described
parcel of land be, and hereby is, granted subject to the following conditions:
1. Prior to recording the PUD Final Plat:
A. The applicant shall submit a digital file of all drawings associated with the Final Plat
application. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation);
acceptable GIS formats are .shp (Shape Files), Arclnfo Coverages and Arclnfo
Export files format type is .e00. The preferred format for Images is .tif(Group 4).
(Group 6 is not acceptable).
B. The applicant shall place the Certificate of Dedication Ownership and Maintenance,
Surveying Certificate and Certificate of Approval by the Board of County
Commissioners on the amended final plat. These certificates are located in
Appendix 24-C of the Weld County Code.
C. The application number (AMPF-420) shall be placed on the amended final plat.
D. The applicant shall notify the Meadowvale Homeowners'Association("HOA")of the
proposed boundary lot adjustment to determine if the HOA has any objections or
concerns.
2. The Final Plat is conditional upon the following and each shall be placed on the Final Plat as
notes prior to recording:
A. Both individual structures shall use the existing access points either to Meadow Vale
Road or to County Road 5.5.
B. This replat shall comply with the notes listed on the Second Filing Meadow Vale
Farm PUD plat (S-420) recorded 5/12/1997 under reception #2547525.
3. The Final Plat shall be submitted to the Department of Planning Services for recording within
30 days of approval by the Weld County Board of Commissioners.

THE DEPARTMENT OF PLANNING SERVICES'STAFF RECOMMENDS THAT THIS REQUEST
BE APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section 27-
7-30 of the Weld County Code.
2. The request is in conformance with Section 27-7-40.C of the Weld County Code, as
follows:
a. Section 27-7-40.C.1--That the proposal is consistent with Chapters 19, 22 ,23,24

This recommendation is based, in part, upon a review of the application materials submitted by the
applicant, other relevant information regarding the request, and responses from referral agencies.

We, Mr. & Mrs. Dennis and Joanne Adler, are the current owners of the referenced properties above. An
amended surveyed plat with copies shows our intentions for the proposed lot line change. The submitted
plat map includes existing as well as proposed lot lines including existing and proposed areas. The
Meadow Vale Farm Subdivision is platted with approximately 1 acre lots. Both of our properties are over
1 acre. The proposed lot line change will still keep lot 9 (43,344 square feet)within the subdivision feel
and guidelines.
The reason for the proposed lot line change is to enhance both of our properties. The existing barn closet
to the proposed lot line as well as a larger back yard from our home on lot 8, works well with our
property. The existing metal building belongs with the look of our home on lot 9.
We appreciate your attention to this proposed lot line change. Please let us know if any further

COMMENTS:
I am familiar with Meadow Farms, 2nd Filing, and WCR 5.5 at this location.
REQUIREMENTS:
Both individual structures shall use the existing access points either to Meadow Vale Road or to
WCR 5.5.
Lot Line Adjustment: If either one of the parcels sell to a different owner, we recommend
fencing or separating the two individual lots with no interconnectivity, which exists now.
The Weld County Public Works Department recommends approval of the lot line adjustment
between the two parcels.

We, Mr. &Mrs. Dennis and Joanne Adler, are the current owners of the referenced properties above. An
amended surveyed plat with copies shows our intentions for the proposed lot line change. The submitted
plat map includes existing as well as proposed lot lines including existing and proposed areas. The
Meadow Vale Farm Subdivision is platted with approximately 1 acre lots. Both of our properties are over
1 acre. The proposed lot line change will still keep lot 9(43,344 square feet)within the subdivision feel
and guidelines.
The reason for the proposed lot line change is to enhance both of our properties. The existing barn closet
to the proposed lot line as well as a larger back yard from our home on lot 8, works well with our
property. The existing metal building belongs with the look of our home on lot 9.
We appreciate your attention to this proposed lot line change. Please let us know if any further
information is required on this matter.
