A public hearing was conducted on July 14, 2004, at 10:00 a.m., with the following present:
Commissioner Robert D. Masden, Chair
Commissioner William H. Jerke, Pro-Tem
Commissioner M. J. Geile
Commissioner David E. Long - EXCUSED
Commissioner Glenn Vaad
Also present:
Acting Clerk to the Board, Esther Gesick
Assistant County Attorney, Lee Morrison
Planning Department representative, Kim Ogle
Health Department representative, Char Davis
Public Works representative, Donald Carroll
The following business was transacted:
I hereby certify that pursuant to a notice dated June 18,2004,and duly published June 23,2004, in
the Fort Lupton Press, a public hearing was conducted to consider the request of UIV Land, LLC,
do Nolan Ulmer for Change of Zone #1032 from the A (Agricultural) Zone District to the PUD
(Planned Unit Development)Zone District for nine(9)residential lots with E(Estate)Zone uses,two
(2)lots with A(Agricultural)Zone uses, and 13.63 acres of Common Open Space. Lee Morrison,
Assistant County Attorney, made this a matter of record. He explained staff is requesting a
continuance to July 28,2004; however,two Commissioners will be absent that day,so the applicant
has the option of requesting a subsequent continuance to a day when a full quorum of the Board will
be present. Kim Ogle, Department of Planning Services, stated a sign has been posted on the
property providing notice of a July 28, 2004, hearing. In response to Commissioner Vaad, Mr.
Morrison stated a revised notice can also be mailed to the property owners if the applicant requests
another continuance. The board directed staff to notify the surrounding property owners of any
future hearing dates that may be arranged with the applicant.
No public testimony was offered concerning this matter.
Commissioner Vaad moved to continue the request of UIV Land, LLC,do Nolan Ulmer,for Change
of Zone#1032 from the A(Agricultural)Zone District to the PUD(Planned Unit Development)Zone
District for nine(9)residential lots with E(Estate)Zone uses,two(2)lots with A(Agricultural)Zone
uses, and 13.63 acres of Common Open Space, to July 28, 2004, to allow adequate time for sign
posting. The motion was seconded by Commissioner Geile, and it carried unanimously. There
being no further discussion, the hearing was completed at 1:45 p.m.
