RE: ACTON OF THE BOARD OF COUNTY COMMISSIONERS REGARDING VIOLATION VI
#0300318 AGAINST EDYTHE LYON AND VICKI HAITHCOAT FOR VIOLATION OF THE
WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Edythe Lyon and Vicki Haithcoat,VI#0300318,are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 13th day of January, 2004, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Edythe Lyon and Vicki Haithcoat were not present or represented at said
hearing,although all parties were notified of said hearing by Department of Planning Services staff,
and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
back to the Department of Planning Services for further consideration.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County,Colorado,that VI#0300318 be,and hereby is,referred back to the Department of Planning
Services for further consideration.

REMEDY
To bring the property into compliance a Zoning Permit for a Mobile Home shall be completed and
submitted to the Department of Planning Services or the mobile home shall be removed.
RECOMMENDATION
The Department of Planning Services recommends that this case be referred to the County Attorney's
Office for immediate legal action.

The property referenced above remains in violation of the Weld County Code. I have scheduled a
meeting with the Board of County Commissioners on January 13, 2004,at 10:00 a.m.,to consider the
violations occurring on the property. The above mentioned property remains in violation of the
following Section(s) of the Weld County Code:

To bring the property into compliance:
My records indicate that we have previously discussed the need for a Zoning Permit to
be completed and submitted to the Department of Planning Services;however, I can find
no evidence of such an application being received. Therefore, this hearing has been
scheduled. If the application is received prior to January 12, 2004, this hearing will be
cancelled. If not, you will be able to request an extension from the Board of County
Commissioners during the hearing. If you feel that this letter has reached you in error,
please contact me at your earliest convenience to discuss your concerns.
This meeting will take place in the County Commissioners' Hearing Room, First Floor, Weld County
Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a representative
be in attendance to answer any questions the Board of County Commissioners might have about the
violations.
Please also be advised that I will be taking video and/or pictures from the road or adjacent properties
the business day before or as soon as possible to the above mentioned Violation Hearing date.

Dear Ms. Lyon and Ms. Haithcoat:
The uses on the above described property are being considered as a zoning code violation of Sections of the
Weld County Code. Currently your property is in violation of the following Section(s)of the Weld County Code:
Chapter 23, Article Ill, Div 1 "A (Agricultural) Zone District"
Section 23-3-20 "Uses allowed by right."
Section 23-3-30 "Accessory uses."
Section 23-3-30.F "Mobile Homes subject to the additional requirements of Article IV, Division
3 of this Chapter."
To bring your property into compliance with the Weld County Code:
As we discussed, a Zoning Permit for the "Temporary Storage of a Mobile Home" can be
obtained. It requires the completion and submittal of a new Zoning Permit. For your
convenience, I have included a Zoning Permit application. For questions, I would suggest that
you speak to one of our"On-Call" Planners. We have to locations open to the public. Our
main office is located at 1555 N. 17`h Avenue, Greeley, Colorado. Where, we have an "on-
call" planner, Monday or Wednesday from 8:00 a.m.-4:00 p.m. or Friday from 12:00 -4:00
p.m. Our other office (the Southwest Weld Office) is located at 4209 CR 24.5, Longmont,
Colorado. At our Southwest office, a planner is available Tuesday or Thursday from 8:00 a.m.
- 4:00 p.m., excluding 12:30-1:30. You do not need to call to schedule an appointment,
because individuals are seen on a sign in basis. To better serve you, please bring this
letter with you.
It is the intention of this office to assist and cooperate with you without imposing undue hardships; however,
we have no discretion in this matter if you fail to correct this violation. You have 30 (thirty)days from
November 13, 2003, to correct this zoning violation. Failure to do so will result in this office scheduling the
violation before the Board of County Commissioners to consider whether to refer the violation to the County
Attorney's Office for legal action.

Dear Ms. Lyon and Ms. Haithcoat:
It has come to the attention of the Department of Planning Services'staff that the uses on your property may
not be in compliance with the Weld County Code, Chapter 23. The potential noncompliance with the Weld
County Code is the presence of a Multiple Dwelling Units. Our records indicate that a Zoning Permit for a
mobile home was obtained in 1994 (MHZP-160), but I can not find any evidence that this use has been
renewed annually as required for this type of permit.
Please contact myself or Wendi Inloes within five working days of the date of this letter to review these
concerns with me. Failure to close this violation or efforts to show progress,will result in a thirty-day violation

I have been requested by Joanetta Lyon and her husband to give a
summary of her medical condition .
She suffers from Parkinson' s disease with some early Dementia-type
symptoms as well . She also is experiencing some visual
hallucinations .
Her medical condition requires that she be supervised 24 hours/day.
At the present time , her husband is able to do this however they
are trying to establish a living situation in Gill where they would
be on the same property as their daughter which would facilitate
better supervision and assistance for her husband. I believe that
this is a medically necessary move for them and the only other.
alternative would be a Board and Care facility or skilled nursing.
I appreciate any assistance you can give this family.
