RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST GLEN AND HAZEL HILL, DBA: GALETON GARAGE FOR
VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,Glen and Hazel Hill,VI#0300205, are allegedly in violation of the Weld County
Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 14th day of September, 2004, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Glen and Hazel Hill, property owners, were present at said hearing, and
WHEREAS,the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until December 14, 2004, to allow adequate time for the property owners to complete
the screening on the two east property sites, and to submit a Use by Special Review application,
to bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that VI #0300205 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Glen and Hazel Hill to remedy the violation of the Weld County Code,
and any other persons occupying the properties, any persons claiming an interest in the properties,
and any persons acting in active concert with the identified parties, with an instruction for delay of
action upon such referral until December 14, 2004, to allow adequate time for the property owners
to complete the screening on the two east property sites, and to submit a Use by Special Review
application, to bring the subject property into compliance.

Currently the property is in violation of Chapter 23,Article 111(3), Division 1 of Sections 23-3-20, 23-3-30,

REMEDY
To bring the property into compliance, the property owner shall submit evidence substantiating a
Nonconforming Use exists, remove all commercial activity or a complete and submit a Use by Special
Review application to the Department of Planning Services.
RECOMMENDATION
The Department of Planning Services recommends that this case be referred to the County Attorney's
Office, but to delay legal action for 3 months.

August 19, 2004 Letter sent to property owner indicating that the violation case was scheduled
before the Board of County Commissioners.
August 20, 2004 Property inspected. Property remains in violation. Also, I met with some of the
complainants in Galeton.
September 9, 2004 Mr. & Mrs. Hill came to the office to discuss the violation and how to correct it.
DEAR BETHANY,
I AM WRITING YOU BECAUSE I AM CONCERNED ABOUT THE CORNER OF
WCR 51 AND 74 IN GALETON, CO. THE HILL'S, WHO OWN THE GALETON TIRE ARE
ALWAYS PARKING THEIR SEMI TRUCKS, TRACTOR LOADS OF TIRES AND OTHER
EQUIPMENT ON THE CORNER. THE VEIW TO THE WEST IS OBSTRUCTED TO THOSE
WHO STOP AT THE STOP SIGN COMING FROM THE NORTH. I'M AFRAID THERE
WILL BE AN ACCIDENT AND ONE OF THE VEHICLES WILL CRASH INTO MY YARD
WHERE MY GRANDCHILDREN PLAY.
THE HILL'S ALSO PARK THEIR VEHICLES ALONG WCR 51 ON COUNTY
PROPERTY. I COUNTED 8 OF THEM TODAY (9-9-2004). THEY ARE PARKED AROUND
A CURVE ON WCR 51 AND ARE VERY DANGEROUS AT NIGHT.
I HAVE GIVEN YOU AN AIREAL PICTURE OF MY PROPERTY AND THE HILL'S
CORNER. AS YOU CAN SEE THERE WERE NO TIRES WHEN THE PICTURE WAS
TAKEN, NOW THEY HAVE ROWS OF TIRES. THEY ARE UGLY AND BETWEEN THE
OLD IRON, REFER BOXES AND TIRES IT MAKES OUR TOWN LOOK LIKE A JUNK
YARD. THIS DECREASES THE VALUE OF ANY PROPERTY AROUND THEM. I HOPE
YOU CAN DO SOMETHING ABOUT THESE VIOLATIONS. THANK YOU.

Dear Bethany:
This letter is in reference to the complaints against the Galeton Tire business and the Hill
family. It is our desire to formerly file a complaint as well against the Hill's because of
the constant collection of, (I'm not quite sure what the right word to use is), "junk!" We
live a mile north of Galeton and travel through the town of Galeton numerous times
throughout the day. In doing so it not only is dreadful to look at the sight on the corner of
WCR 74 and WCR 51 but is a serious danger. When facing South on the intersection of
WCR 51 and WCR 74 it is very difficult to see the oncoming Westbound traffic from that
stop sign, not only is their quite a collection but they have also parked a semi trailer right
in front which makes it very difficult to see, and believe me people do not always follow
the speed limit. I also have children who occasionally ride a school bus which travels
that direction and I think it is just a matter of time before we have an unfortunate accident
at the intersection. Being a big part of the Galeton Community and School employee I
would really like to see that corner of Galeton be cleaned up, and I would think the Hill
family would want the same for the community, it is sad to see our small town
represented in such a way, especially if it is the cause of an automobile accident. Lastly,
we have also noticed that the Hill's have started to move their unsightly collection to a
sight on WCR 51 about 'A mile on the West side of the road, this is also disheartening,
not only for the people who live near but for all who have to drive by on a daily basis and
look at it, we need to draw the line some where.
Thank you for hearing our plea, if there is anything that can be done to stop this, it would
be greatly appreciated, and just so you know we won't stop trying.

BACK, AND SEMIS PARKED A FEW FEET FROM THE ROAD WHICH MAKE IT
IMPOSSIBLE TO SEE ON COMING TRAFFIC FROM THE WEST. I HAVE TO COME TO
A STOP AT THE STOP SIGN AND THEN PULL OUT HALF WAY INTO THE
INTERSECTION TO SEE IF THERE IS ANY CARS COMING. MY CHILD RIDES THE
SCHOOL BUS AND COMES TO THAT INTERSECTION MONDAY THRU FRIDAY. WITH
THE OBSTRUCTION OF VIEW, AND THE AMOUNT OF TRAFFIC AT THIS
INTERSECTION SOMETHING NEEDS TO BE DONE.

My husband John and I lived at 25017 WCR 74 Galeton, Colorado for 5 years from
August 1979 to June 1984.
The picture that Carolyn has was taken while we were living at the above address. The
blue vehicle, the red feed grinder, and the children's swing set were ours. Our son was
born in April 1980 and this is where we brought him home for the hospital.

Dear Mr. & Mrs. Hill:
The property referenced above remains in violation of the Weld County Code. I have scheduled a
meeting with the Board of County Commissioners on September 14,2004,at 10:00 a.m.,to consider
the violations occurring on the property. The above mentioned property remains in violation of the
following Section(s) of the Weld County Code:
Chapter 23, Article III, Div 1 "A(Agricultural)Zone District"
Section 23-3-20 "Uses allowed by right."
Section 23-3-30 "Accessory uses."
Section 23-3-40 "Uses by special review."
Section 23-3-40.R "Any use permitted as a Use by Right, an Accessory Use, or a Use
by Special Review in the Commercial or Industrial Zone Districts, provided that the
property is not a Lot in an approved or recorded subdivision plat or lots parts of a map or
plan filed prior to adoption of any regulations controlling subdivisions. PUD development
proposals shall not be permitted to use the special review permit process to develop."
Chapter 23, Article VII "Nonconforming Lots, Uses and Structures."
Section 23-7-30 "Nonconforming uses of land."
To bring the property into compliance:
Upon review of my case files,records and computer, I was unable to locate any permits
allowing the operation of the 'Galeton Garage'. While I understand that your business
has been located on the property for quite some time, for your protection as well as to
bring the property into compliance, a "Nonconforming Use" application shall be
completed and submitted to the Department of Planning Services. It is our belief that you
are exceeding the boundaries that would have been established prior to Zoning,which
occurred in 1972. Additionally, several complaints have been received regarding items
located on the corner which can cause visual impairment of oncoming traffic. These
items will need to be relocated in a manner so they do not obstruct any traffic views.
This meeting will take place in the County Commissioners' Hearing Room, First Floor, Weld County
Centennial Center,915 10th Street, Greeley, Colorado. It is recommended that you or a representative
be in attendance to answer any questions the Board of County Commissioners might have about the
violations.

Please also be advised that I will be taking video and/or pictures from the road or adjacent properties
the business day before or as soon as possible to the above mentioned Violation Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the violation. Our
records indicate that you were made aware of the nature of the violation including the action necessary
to correct the violation, and that you were given sufficient time to remedy this violation. If you have any
questions concerning this matter, please call me.

Dear Mr. & Mrs. Hill:
The uses on the above described property are being considered as a zoning code violation of Sections of the
Weld County Code. Currently your property is in violation of the following Section(s)of the Weld County Code:
Chapter 23, Article III, Div 1 "A(Agricultural)Zone District"
Section 23-3-20 "Uses allowed by right."
Section 23-3-30 "Accessory uses."
Section 23-3-40 "Uses by special review."
Section 23-3-40.R "Any use permitted as a Use by Right, an Accessory Use, or a Use by
Special Review in the Commercial or Industrial Zone Districts, provided that the property is not a
Lot in an approved or recorded subdivision plat or lots parts of a map or plan filed prior to
adoption of any regulations controlling subdivisions. PUD development proposals shall not be
permitted to use the special review permit process to develop."
Chapter 23, Article VII "Nonconforming Lots, Uses and Structures."
Section 23-7-30 "Nonconforming uses of land."
To bring your property into compliance with the Weld County Code:
Upon review of my case files, records and computer, I was unable to locate any permits allowing
the operation of the 'Galeton Garage'. While I understand that your business has been located
on the property for quite some time, for your protection as well as to bring the property into
compliance, a"Nonconforming Use"application(see enclosed)shall be completed and submitted
to the Department of Planning Services. It is our belief that you are exceeding the boundaries
that would have been established prior to Zoning, which occurred in 1972. Additionally, the
current relocation of vehicles and items on the corner have caused a traffic impairment. These
items will need to be relocated in a manner so they do not obstruct any traffic views.

It is the intention of this office to assist and cooperate with you without imposing undue hardships; however,
we have no discretion in this matter if you fail to correct this violation. You have 30 (thirty) days from
September 18, 2003, to correct this zoning violation. Failure to do so will result in this office scheduling the
violation before the Board of County Commissioners to consider whether to refer the violation to the County
Attorney's Office for legal action.

It has come to the attention of the Department of Planning Services'staff that the uses on your property may
not be in compliance with the Weld County Code, Chapter 23. The potential noncompliance with the Weld
County Code is the expansion of a possible"Nonconforming Use". Upon a visual inspection of the property,it
was noted that a commercial auto repair and/or storage is being operated on the above mentioned property;
however,no permits have been located substantiating such a use. In addition to that,we have been receiving
numerous complaints regarding visibility to the County Roads. For your convenience, I am enclosing a
"Nonconforming Use" application, which is free, but, if approved, would authenticate your business as a
"Nonconforming Use." The vehicles and/or equipment obstructing view of on-coming traffic will need to be
corrected as soon as possible.
Please contact me within five working days of the date of this letter to review these concerns with me. Failure
to close this violation or efforts to show progress,will result in a thirty-day violation notice being issued. Feel
