RE: ACTION OF BOARD CONCERNING COMPLIANCE WITH CONDITION F OF
RESOLUTION DATED APRIL 9, 2003, AND TEMPORARY CERTIFICATE OF
OCCUPANCY - RJML, LLC, DBA LA MARAVILLA RESTAURANT
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution #2003-0955 on April 9, 2003, the Board of County
Commissioners lifted the Temporary Summary Suspension of the Hotel and Restaurant Liquor
License issued to RJML, LLC, dba La Maravilla, and
WHEREAS, Condition F of said Resolution states, "That a Temporary Certificate of
Occupancy be issued by the Weld County Building Inspection Department, for a period not to
exceed 180 days, with the requirement that by the end of such 180 day period, the Licensee
must receive a permit for and have installed a new septic system for the licensed premises,
sufficient to handle increased capacity and/or a requirement by the State of Colorado
Department of Public Health and Environment for the installation of a reverse osmosis system
on the water system, or have amended the Department of Planning Services Site Plan for the
licensed premises to reflect the limited occupancy for both the area where food service is to
occur and the dance hall portion of the license premises, and any other necessary service
capacity limitations, such as limited hours of operation and/or methods of food service", and
WHEREAS, by Resolution #2003-2887 on October 15, 2003, the Board of County
Commissioners extended the Temporary Certificate of Occupancy for 180 days, with the
conditions, requirements, and limits as stated in the original Temporary Certificate of
Occupancy, and
WHEREAS, on April 12, 2004, the Board deemed it advisable to extend Condition F of
said Resolution for 90 days, thereby extending the Temporary Certificate of Occupancy for 90
days, with the following conditions:
1. At no time shall the total seating capacity of the restaurant exceed 60 seats.
2. The occupancy for the dance hall must be held at or below 600 people per night.
3. At no time shall the restaurant serve more than 100 meals per day.
4. The hours of operation for the restaurant shall be maintained between 11:00 a.m.
and 7:00 p.m. daily.
5. The restaurant must use single service/single use articles (paper/plastic plates,
utensils and cups) for all meals.
6. The water system must meet all applicable requirements of the Colorado
Department of Public Health and Environment.

7. Any additional treatment to the water system required by the Colorado
Department of Public Health and Environment to meet drinking water standards,
that would increase the hydraulic load to the septic system, may require
additional evaluation of the septic system.
8. By the expiration date of this Temporary Certificate of Occupancy, the person to
which this Temporary Certificate of Occupancy is issued must receive a permit
for, and have installed, a new septic system for the premises, sufficient to handle
increased capacity, and/or a requirement by the Colorado Department of Public
Health and Environment for the installation of a Reverse Osmosis System on the
water system, or have amended the Department of Planning Services Site Plan
for the licensed premises to reflect the limited occupancy for both the area where
food service is to occur and the dance hall portion of the licensed premises, and
any other service capacity limitations, such as limited hours of operation and/or
methods of food service.
WHEREAS, on July 19, 2004, the Board again deemed it advisable to extend the
Temporary Certificate of Occupancy to August 2, 2004.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Temporary Certificate of Occupancy be, and hereby is,
extended to August 2, 2004, with the conditions, requirements, and limits stated above.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 19th day of July, A.D., 2004.
