In a memorandum dated March 30, 2000, addressing Condition of Approval 2.1, "...the Department of Planning Services and the Department of Public Works indicated that paving for [The Windsor Gardener] does not need to be in place until four (4) years from the date of approval for this application." For the purposes of this discussion, the date of recording the plat was May 23, 2000 and was utilized to establish the present timeline for completion of the pavement for this facility. The memorandum further stipulates that "if the paving is not completed within four (4) years, the County may require an approved form of collateral." Discussion with the Town of Windsor indicates that 17th Street through the Jacoby Farms annexation has been designed and has a centerline layout for location. Please refer to the attached sketch provided to this office from the Town of Windsor. As you are aware, the road has not been constructed and there is not a definitive timeline for construction. It is the understanding of this office that the access to this retail facility will continue to remain off of State Highway 392 until such time that 17th Street is constructed. Given that the pavement required was part of the conditions of approval for this land use application, it is the determination of staff that collateral is required to guarantee that the paving of the access and parking area will be completed. Should collateral not be received or other arrangement agreed to prior to Friday May 21, 2004, staff will refer the application, supporting documents and the February 2, 2004 Weakland letter request back to the Board of County Commissioners for immediate action. Staff has enclosed an Improvements Agreement with this letter for your use. Staff is also enclosing the Board of County Commissioners Resolution, and memorandum of record for this application. Since we last spoke I have been in contact with C'ieorge Sisneros of the Windsor Land Company as well as the engineer for the project and have also received feedback from the Town's attorney, John Fry. Based on that information, the Weaktands arc comfortable with the plans for the access street connecting 171h Street to their parcel and waive any objections to the proposed reimbursement agreement that the Town and the developer are finalizing, This waiver is based upon the understanding and assurance by Mr. Fry and Windsor Land Company of the following: 1, The developer will be obligated to stub utilities to the Weakland property line or create easements providing reasonable access to public utilities; 2. Reimbursement will be triggered as outlined in your December 27, 2002 letter; and 3. As stated on our USR 1251,we are required to install a paved parking lot and access off of Hwy 392. There have been major changes in this area of Windsor since our USR was issued. The City of Windsor has moved the location of future 17th street 120 feet to the east of our property line. This will cause us to have to give up our access off of 392 and use an access to our property off of 17th street to the east. (Please see map). The exact placement and design of our access road has yet to be determined. With these changes in mind we are asking for an extension to our requirement for a paved parking lot and access for another three years or until 17th street is in place.
