WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statutes and the Weld County Home ° Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, <a Colorado, has reviewed the request of Paul and Pearl Schmidt c/o Amoco Production Company for an exemption from the definitions of "subdivision" and "subdivided land" in Section 30-28-101 (10) , CRS 1973, as amended, and Section 2-1 of the Weld County Subdivision Regulations, and WHEREAS, the Board of County Commissioners finds that Paul and Pearl Schmidt are owners of a certain parcel of land located in part of the Northwest Quarter of the Northeast Quarter of Section 20, Township 2 North, Range 66 West of the 6th P.M. , Weld County, Colorado, being more particularly described as follows: Beginning at the N/4 corner of said Section 20 and assuming the N line of said Section to bear N 90°00 ' 00" E with all bearings contained herein being relative thereto; thence N 90°00 ' 00" E along said line a distance of 588 . 78' to a point on said line; thence south 08°14 ' 49" E, 30. 31' to the S ROW line of Weld County Road 20, said pt also being the TPOB; thence about said parcel by the following four courses : N 90°00 ' 00" E, 175. 02 ' ; S00°00 ' 00" E, 664. 01' ; N 90°00 ' 00" W, 78. 78 ' ; N 08°14 ' 49" W, 670 . 95 ' to TPOB. WHEREAS, the Department of Planning Services staff recommends that the subdivision exemption be conditional with an expiration co-terminus with the lease between Amoco and Paul & Pearl Schmidt for the duration of the waterflood project on the subject parcel.
