Subject: USR-1442 Referral CICS
Upon review of my computer and files,a Zoning Violation (VI-0300026)was noted. The violation was initiated
as a result of receiving complaints regarding a metal cutting operation located within a structure on the
property. Subsequently, we have received numerous complaints regarding a possible commercial roping
operation. The complaints were initially placed as a result of some lighting that Mr. Moser installed in
accordance with the Weld County Code by first obtaining an Electric Permit (ELN-031075).
Please be advised that this violation has not been presented to the Board of County Commissioners. Typically
violations are placed on hold upon the receipt of any special use permit; however, due to the overwhelming
number of phone calls that the County Attorney's Office has been receiving, I have been directed to proceed
with the Violation process.
This application, if approved, will correct the metal cutting aspect of the violation, but does not address the
reported commercial roping operations.

The Department has reviewed the request for selling, manufacturing, and the outdoor storage of
metal products. Currently there is a residence and shop on site that are served by a septic system
(G19950073). No new structures are proposed as a part of this request. A waste handling plan has
been submitted (received September 9, 2003) and approved. The septic system has been reviewed
for adequacy for the proposed 3 employees and incidental visitors and has been found to be
adequately sized. The following Development Standards, Conditions of Approval, and Operation
Standards for the special use permit are intended to mitigate any adverse impacts to surrounding
areas.
The Department recommends approval of this application with the following conditions:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act,
30-20-100.5, C.R.S., as amended)shall be stored and removed for final disposal in a manner
that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include
those wastes specifically excluded from the definition of a solid waste in the Solid Wastes
Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended.
Waste materials shall be handled, stored, and disposed in a manner that controls fugitive
dust, blowing debris, and other potential nuisance conditions.
,4. Fugitive dust shall be controlled on this site.
A. This facility shall adhere to the maximum permissible noise levels allowed in the Light
Industrial Zone as delineated in 25-12-103 C.R.S., as amended.
ie. Adequate toilet and hand washing facilities shall be provided for the public.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Section 23, Article II, Division 4. Our
comments and requirements are as follows:
COMMENTS:
WCR 29 is designated on the Road Capital Improvement Plan in the County Wide Impact Fee Code
Ordinance, Section 20-1-30, as a local gravel road, which requires a 60-foot right-of-way at full build out.
There is presently a 60-foot right-of-way. The road is maintained by Weld County. Pursuant to the definition of
SETBACK in the weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback measured
from the future right-of-way line.
'Traffic Counts: The average daily traffic (ADT) count for WCR 29 between WCR 70 and WCR 72 reflect 129
ahicles taken in a 24-hour period on 8/11/1999.
REQUIREMENTS:
Access: The applicant shall utilize the existing 20-foot gravel drive access from WCR 29 to the proposed USR
facility.
Off-Street Parking and Circulation: The off-street parking spaces, loading and unloading areas around the
shop area including the access drive shall be surfaced with gravel or the equivalent and shall be graded to
prevent drainage problems.
Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a
manner that will reasonably preserve natural character of the area and prevent property damage of the type
generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding
of storm run-off.

USR-1442
The only active or historical building permits on record for this parcel or address are BP44921
for a dwelling and BP45263 for a barn/storage building. Both permits received final approval.
An electrical permit was issued and received final approval for an irrigation pump and outside
lighting. An electrical permit was issued for the addition of 277/480 volt service to the shop.
This permit is on hold pending approval of this USR application.
1. A building permit will be required for a change of use from a barn/storage building to a metal
fabrication building. The permit application shall include a plot plan showing distances between
all buildings and from buildings to property lines. A floor plan for buildings used in the metal
fabrication business listing and describing the equipment used and types metal fabrication
processes shall be submitted as well.
2. A plan review is required for the building. Two complete sets of plans are required when
applying for each permit.
3. Changes in the character or use of existing buildings shall conform to the requirements of
Section 3405 of the 1997 Uniform Building Code.
4. Building height shall be limited to the maximum height allowed per UBC Table 5-B. Wall and
opening protection and limitations shall be in accordance with UBC Table 5-A. Separation of
buildings of mixed occupancy classifications shall be in accordance with UBC Table 3-B and
Chapter 3. Setback and offset distances shall be determined by the Zoning Ordinance.
5. Building height shall be measured in accordance with the 1997 Uniform Building Code for
the purpose of determining the maximum building size and height for various uses and types of
construction and to determine compliance with the Bulk Requirements from Chapter 27 of the
Weld County Code. Building height shall be measured in accordance with Chapter 23 of the
Weld County Code in order to determine compliance with offset and setback requirements.
Offset and setback requirements are measured to the farthest projection from the building.

The Department of Planning Services reviewed the above referenced Use by Special Review
Landscape Plat and offers the following comments:
Section 23-3-250.A.4 and Section 23-3-250.A.5 of the Weld County Code addresses the
required yards and required landscape areas. Section 23-3-250.A.5.a states "No more than
eighty-five percent (85%) of the total area of a Lot shall be covered. Land shall not be deemed
covered if it is used for growing grass, shrubs, trees, plants or flowers or if covered by
decorative gravel or wood chips, or if it is otherwise suitably landscaped."
Section 23-3-250.A.5.a states "That portion of a Lot which abuts a public or private street right-
of-way shall be landscaped for a distance of ten (10) feet, measured at a right angle from the
Lot line towards the interior of the Lot. Driveways may pass through the required landscaped
areas."
The applicant states that the on-site landscape treatment exists. However, Planner Katyruniuk
should make an educated determination as to whether additional plant materials are required to
meet or exceed the landscape requirements and to effectively mitigate the required screening
and buffering of the proposed use to the adjacent roads and property owners. That being
stated, the coniferous and deciduous plant material is delineated on the drawing, however, the
plants are not labeled. Future plans shall address the type of plant material presently on-site
and whether this material will be supplemented with additional materials.
Landscaping materials as indicated in the Approved Landscape Plan shall be maintained at all
times. Dead or diseased plant materials shall be replaced with materials of similar quantity and
quality at the earliest possible time.
The applicant shall demonstrate how the proposed plant material will be watered, thus ensuring
adequate growth and established of the feeder root system. Further, the applicant shall provide
evidence that existing North Weld County Water District tap is able to provide irrigation water to
all proposed landscaped areas.
V he parking area is not delineated. Given the nature of this facility the following parking
requirements outlined in Appendix 23-B of the Weld County Code shall be met. The shop/
shed parking requirement, shall provide six spaces, or one space for each 1000 square feet of
space. Any other uses associated with this proposed facility shall utilize the parking available
on-site for the previously discussed use. Total on-site parking for this facility shall be six
spaces, of which one shall be a van accessible handicapped parking stall meeting all of the
requirements as set forth in the Americans with Disabilities Act. Further, the applicant shall
delineate curb stops for the parking spaces shown on the USR plat. One curb stops for each
space is the standard, although one curb stop per two parking spaces is permissable.
Per Section 23-3-350.B, the applicant shall delineated sufficient screened off street paved
parking areas. All parking and loading areas shall be screened from adjacent properties and
road rights-of-way. The applicant shall delineate an opaque visual screen on all sides of the
property to mitigate the potential negative impact and aesthetic concerns on surrounding
properties.
I, Section 23-3-350.D provides for adequate street access. The applicant shall demonstrate a
safe and approved access. Appropriate language shall be included on the plat delineating the
access to this parcel.
Section 23-3-350.H addresses the issue of trash collection areas. Areas used for storage or
trash collection shall be screened from adjacent public rights-of-way and adjacent properties.
These areas shall be designed and used in a manner that will prevent wind or animal
scattered trash.
(Section 23-3-260 addresses operation standards for Commercial uses. The applicant shall
address the issue of on-site lighting, including security lighting in applicable. Subsection B.6
states "any lighting ... shall be designed, located and operated in such a manner as to meet the
following standards: sources of light shall be shielded so that beams or rays of light will not
shine directly onto adjacent properties...."
^/The applicant has not delineated any on-site sign. If an on-site sign is desired, the signs shall
adhere to Section 23-4-90.A and .B of the Weld County Code. One identification sign per
principal use shall be allowed, provided that the sign does not exceed sixteen (16) square feet
in area per face. Further, the location of the sign, if applicable shall be delineated on the
Landscape / Site Plat. All structures, including signs, on site must obtain the appropriate
building permits.
1The applicant shall enter into an Improvements Agreement according to policy regarding
collateral for improvements and post adequate collateral for all transportation (access drive,
parking areas, etcetera) and non-transportation (plant materials, fencing, screening, etcetera).
The agreement and form of collateral shall be reviewed by County Staff and accepted by the
Board of County Commissioners prior to recording the USR plat.

Thank you for the referral for the above-referenced USR for a metal-cutting shop in an existing
building in an Agricultural Zone District. The City of Greeley Planning staff has reviewed the
application and wishes to forward the following comments:
1. Outdoor storage should not be permitted within any applicable setback, public right-of-
way, or in landscaped areas.
2. Items not customarily used or stored outside or made of material that is resistant to
damage or deterioration from exposure to the outside environment should not be
placed, stored, or maintained outside for a period in excess of 24 consecutive hours.
3. Outdoor storage of all materials stored or to be stored in an unenclosed area must be
screened from the view of the public right-of-way. Screening should be accomplished
through the use of a solid fence or wall of sufficient height to fully screen all stored
materials, or through the use of landscaping (including plant materials and/or berms)
which provides year-round screening of a sufficient height to fully screen all stored
materials, or through a combination of fencing, walls and landscaping.
4. Fifty feet from the centerline of WCR 29 should be reserved for possible future
development in the area.

As of the date of this correspondence,Bonanza Creek Oil Company has not seen a plat describing the
above referenced development. Before giving our opinion on this development and the influence on
Bonanza Creek Oil Company right's to develop the oil and gas under lease, a detailed plat of the project
would be required. Bonanza Creek Oil Company would not object to the development assuming it will
not hinder continued operations and maintenance of existing or future oil and gas wells. This observation

Bonanza Creek Oil Company,which among other items,recognizes Bonanza Creek Oil
Company's rights of ingress and egress to the existing wells and facility locations and Bonanza
Creek Oil Company's rights to develop additional well and facility locations per State of
Colorado regulations.
• All structures are located in accordance with State of Colorado regulations concerning setback
distances from existing and future well and facility locations.
