The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
Use by Special Review, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and
requirements are as follows:
COMMENTS:
WCR 43 is designated on the Weld County Road Classification Plan (FHU) as a collector status road, which
requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. The road is
maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23,
Article III, Section 23-3-50, the required setback is measured from the future right-of-way line.
-'`fur most recent traffic counts reflect 800-1600 vehicles taken between WCR 50 and WCR 66.
REQUIREMENTS:
Access: In researching adjacent parcels the access to the Duke Energy site Pan Energy Field Services, do
Pan Handle Eastern Corporation owns the adjacent parcels plus the access area to the site. Utilize this
access road from WCR 43. The access drive including circulation and parking on site shall be surfaced with
gravel, recycled asphalt, or the equivalent and shall be graded to prevent drainage problems.
Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent property damage of the
type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned
ponding of storm run-off.
I am referring a portion of this site to the Department of Health and Environment, as it deals with oil and gas
production.
Long Term Road Maintenance and Improvements Agreement: The applicant indicated that approximately
two to three people will utilize the site. The type of vehicles being used will be pickups for employees, one to
three semis, approximately three per day. If the volume dramatically changes at this facility, the Weld County
Public Works Department will require this improvements agreement to accommodate heavy hauling to this site.

Dear Mr. Ogle,
The Greeley-Weld County Airport Authority has reviewed this subject referral and offers the
following comments.
The Greeley-Weld County Airport Authority has no conflicts with the proposed land use in this
referral. However,this parcel of land is located in the Airport Zoning Overlay District for the airport,
and lies withing the Airport Influence Area. The Greeley-Weld County Airport Authority requests
an opportunity to review the referral again if the land development changes to anything other than
its current use. The Greeley-Weld County Airport Authority would also recommend that if there are
any future plans for the construction of tall structures, a Federal Aviation Administration 7460-1
airspace study be performed.

Environmental Health Services has reviewed this proposal for a mineral resource
development facility including a Natural Gas Processing Facility. We have no
objections to the proposal, however, we do recommend that the following conditions be
part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit evidence of an Air Pollution Emission Notice
(A.P.E.N.) and Emissions Permit application from the Air Pollution Control
Division (APCD), Colorado Department of Health and Environment. Alternately,
the applicant can provide evidence from the APCD that they are not subject to
these requirements.
2. Submit a dust abatement plan to the Environmental Health Services, Weld
County Department of Public Health & Environment, for approval prior to
operation.
3. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
development standards:

We recommend that the following requirements be incorporated into the permit as
"development standards":
4. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
5. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
6. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, blowing debris, and other potential nuisance conditions.
7. Fugitive dust shall be controlled on this site. The facility shall be operated in
accordance with the approved dust abatement plan at all times.
8. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in 25-12-103 C.R.S., as amended.
9. All potentially hazardous chemicals must be stored and handled in a safe manner
in accordance with product labeling.
10.The applicant shall operate in accordance with the approved "waste handling
plan".
11.Adequate handwashing and toilet facilities shall be provided for employees of the
facility.
12.Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
13.The facility shall utilize the existing public water supply.(North Weld County
Water District)
14.The operation shall comply with all applicable rules and regulations from the
Weld County Code, State of Colorado-Air Pollution Control Division and the
Environmental Protection Agency.

Description; Addition of a compressor and a structure to house the compressor .
1 A plan review is required for each building. Plans shall bear the wet stamp of a Colorado
registered architect or engineer. Two complete sets of plans are required when applying for
each permit.
2. Buildings shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 2003
International Building Code, 2003 International Mechanical Code, 2003 International Plumbing
Code, 2002 National Electrical Code and Chapter 29 of the Weld County Code.
3. Each building will require an engineered foundation based on a site-specific geotechnical
report or an open hole inspection performed by a Colorado registered engineer. Engineered
foundations shall be designed by a Colorado registered engineer.
4 Building height, setbacks and offset distance shall be determined by the Zoning Ordinance.
Separation of buildings of mixed occupancy classifications shall be in accordance with
Table 302.3.3 2003 International Building Code.
5. Plans shall be submitted to Eaton Fire District for review and approval. A Final Inspection
shall be conducted by The Fire District prior to occupancy of structure.

Dear Mr. Ogle:
I have reviewed the documents regarding the subject site and have the following comments:
1) Number 7 of the Responses to Use By Special Review Questionnaire indicates that no
reclamation procedures will be necessary. Reclamation should be required upon closure
of the proposed facility.
,^ 2) Number 10 of the Responses to Use By Special Review Questionnaire indicates that all
wastes will be removed by truck or other appropriate method. The Plot Plan of the site
shows five (5)"sump pits" for waste water. The Colorado Oil &Gas Conservation
Commission(COGCC)has regulatory authority over Exploration & Production (E&P)
wastes. The waste water presumably would be considered an E&P waste. Should this be
the case,the subject sumps must have structural integrity for fluid containment. In the
event, the sumps do not have structural integrity, they would be considered special
purpose pits requiring a permit approved by the COGCC.

Thank you for the opportunity to review this Site Specific Development Plan and Special Review
Permit for a Mineral Resource Development Facility including a Natural Gas Processing Facility
in the A (Agricultural) Zone District. The City of Greeley Planning staff has reviewed the
application for this USR from Duke Energy located 1/2 mile north of WCR 64 & 1/4 mile west of
WCR 43 and wish to forward the following comments.
This proposal is outside the City of Greeley 2020 Growth Area. It is suggested that landscaping
be provided along both the south and the east to screen the facility.

Subject: AmUSR-552
The sheriffs office has no concerns with this Special Use Permit. The sheriff's office
would however be willing to provide a program entitled Crime Prevention Through
Environmental Design to the developer. This program reduces the likelihood of criminal
activity at a specific location by"hardening" it to crime.
The Sheriff's Office lacks the ability to absorb any additional service demand without the
.-� resources recommended in the multi-year plan provided to the Board of County
Commissioners or as indicated by growth not considered at the time the plan was
developed. I have no other comments on this proposal.
