RE: AUTHORIZATION FOR WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST MICHAEL J. STEPANICK FOR VIOLATION OF THE
WELD COUNTY ZONING ORDINANCE
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , on the 26th day of October, 1983 , the Board of
County Commissioners denied the request of Michael J. Stepanick
for a Use by Special Review Permit to maintain a dog kennel in
an A-Agricultural Zone District, and
WHEREAS, because of the denial for said Use by Special Re-
view Permit, the Board has determined that Michael J. Stepanick
is in violation of Section 31 . 2 of the Weld County Zoning Ordi-
nance, maintaining a dog kennel without proper permits in an
A-Agricultural Zone District, and
WHEREAS , the property on which said violation is occurring
is described as Lot 6 , Block 31 , Aristocrat Ranchettes Subdivi-
sion, Weld County, Colorado, and
WHEREAS, the Board deems it necessary to refer this matter
to the Weld County Attorney for proper legal action to correct
said zoning violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that Thomas 0. David, Weld
County Attorney, be, and hereby is , authorized to take appropri-
ate legal action against Michael J. Stepanick for maintaining
a dog kennel without proper permits in an A-Agricultural Zone
District on the hereinabove described real estate.

The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 31st day of
October, A.D. , 1983 .
