The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center,
Greeley, Colorado, January 14, 2004, at the hour of 9:00 a.m.
ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were
present, constituting a quorum of the members thereof:
Commissioner Robert D. Masden, Chair

MINUTES: Commissioner Long moved to approve the minutes of the Board of County Commissioners
meeting of January 12, 2004, as printed. Commissioner Jerke seconded the motion, and it carried
unanimously.
AMENDMENTS TO AGENDA: There were no amendments to the agenda.
CONSENT AGENDA: Commissioner Vaad moved to approve the consent agenda as printed.
Commissioner Jerke seconded the motion, and it carried unanimously.
PRESENTATIONS:
RECOGNITION OF SERVICES, RICHARD CONDREAY: Chair Masden read the certificate recognizing
Richard Condreay for 25 years of service with the Weld County Sheriff's Office. Sheriff John Cooke
presented a retirement pin to Mr. Condreay.
RECOGNITION OF SERVICES,ALAN PRICE: Chair Masden read the certificate recognizing Alan Price
for 23 years of service with the Weld County Sheriff's Office. Sheriff Cook presented Mr. Price with his
retirement pin,who stated Mr. Price will be awarded the Homicide Detective of the Year Award this year,
by the Colorado Homicide Investigation Association.

COMMISSIONER COORDINATOR REPORTS: There were no Commissioner Coordinator Reports.
PUBLIC INPUT: Evelyn King of Loveland, presented the attached letter regarding the MPO Council
membership and voting results. She requested Weld County's Resource Allocation information to help
her understand how it ties to the projects being submitted and how the allocation of dollars impact the next
five years as they are allocated.
WARRANTS: Donald Warden, Director of Finance and Administration,presented the following warrants
for approval by the Board:
All Funds $493,685.89
Commissioner Vaad moved to approve the warrants as presented by Mr. Warden. Commissioner Geile
seconded the motion, which carried unanimously.
BIDS:
PRESENT MOTORGRADERS BID, PUBLIC WORKS: Pat Persichino,Director of General Services,read
the names of three vendors who submitted bids into the record. Said bid will be considered for approval
on January 28, 2004.
PRESENT TIRE ROLLER COMPACTOR BID, PUBLIC WORKS: Mr. Persichino read the names of five
vendors who submitted bids into the record. Said bid will be considered for approval on January 28,2004.
PRESENT TANDEM TRUCK TRACTOR BID, PUBLIC WORKS: Mr. Persichino read the names of three
vendors who submitted bids into the record. Said bid will be considered for approval on January 28,2004.
PRESENT TANDEM TRUCK TRACTOR WITH SNOW PLOW & MATERIAL SPREADER BID, PUBLIC
WORKS: Mr. Persichino read the names of five vendors who submitted bids into the record. Said bid will

new bid will be sent out.

PRESENT PATROL VEHICLES BID,SHERIFF'S OFFICE: Mr. Persichino read the names of four vendors
who submitted bids into the record. Said bid will be considered for approval on January 28, 2004.
PRESENT CIVILIAN VEHICLES BID,SHERIFF'S OFFICE: Mr.Persichino read the names of six vendors
who submitted bids into the record. Said bid will be considered for approval on January 28, 2004.
Responding to Commissioner Long, Mr. Persichino stated all vehicles are replacements, except for one
in the Sheriff's Office.
NEW BUSINESS:
CONSIDER TASK ORDER OPTION TO RENEW LETTER #3 FOR IMMUNIZATION PROGRAM AND
AUTHORIZE CHAIR TO SIGN: Mark Wallace, Director of Public Health and Environment,stated this is a
renewal of the immunization program task order,in the amount not to exceed$47,387. Dr.Wallace stated
the program will provide community education regarding the rules of the Colorado Board of Health pertaining
to the immunization of students attending school and rules pertaining to the infant immunization program,
as well as conduct reminder/recall activities,collaborate with the State's Supplemental Nutrition Program,
serve as a resource for the Weld County Immunization Coalition,and provide walk-in immunization clinics
each month for persons of all ages. Commissioner Long moved to approve said renewal and authorize the
Chair to sign. Seconded by Commissioner Jerke, the motion carried unanimously.
CONSIDER LETTER OF AGREEMENT FOR SUBCONTRACT OF STEPS GRANT AND AUTHORIZE
CHAIR TO SIGN - NORTH COLORADO HEALTH ALLIANCE: Dr. Wallace stated Weld County was
awarded$1.35 million for the period of October 1,2003,through September 30,2008,with this first year's
amount being$269,994. He stated the subcontract with the North Colorado Health Alliance is to support
grant management,and$10,000 is the maximum amount to be paid fora one-year period. Responding to
Commissioner Jerke, Mr.Warden stated the funds are in the 2004 budget. Commissioner Jerke moved
to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Geile,the motion
carried unanimously.

CONSIDER TEMPORARY CONSTRUCTION EASEMENT FOR WCR 51 AND AUTHORIZE CHAIR TO
SIGN - B & B FAMILY TRUST: Leon Sievers, Department of Public Works, stated this easement is
necessary for a culvert installation for the Weld County Road 51 project, specifically from Highway 52 to
the 1-76 Frontage Road. Mr. Sievers stated the County is paying the standard $350. Responding to
Commissioner Jerke, Mr. Sievers stated this is part of the Calpine project, and they are paying a
proportionate share. Commissioner Jerke moved to approve said easement and authorize the Chair to
sign. Seconded by Commissioner Geile, the motion carried unanimously.
CONSIDER TEMPORARY CONSTRUCTION EASEMENT FOR WCR 51 AND AUTHORIZE CHAIR TO
SIGN-ROBERT AND DAWNA GUDKA: Mr. Sievers stated this is for the same project just discussed,on
the opposite side of the road,and the County is paying the standard$350 for an easement. Commissioner
Jerke moved to approve said easement and authorize the Chair to sign. Seconded by Commissioner Geile,
the motion carried unanimously.
CONSIDER APPLICATION FOR LICENSE TO CONDUCT PUBLIC DANCE OR DANCES-THE FORT 21,
LTD: Bruce Barker, County Attorney, stated this is an application for a license to conduct dances for the
calendar year, in conjunction with a liquor license which expires August 8, 2004. Commissioner Geile
moved to approve said application. The motion, which was seconded by Commissioner Vaad, carried
unanimously.
CONSIDER AGREEMENT TO PROVIDE PROFESSIONAL CONSULTING SERVICES AND AUTHORIZE
CHAIR TO SIGN- MAXIMUS, INC.: Mr.Warden stated this agreement is for the Indirect Cost Allocation
Plan,which is required by the Federal government and is used in grant accounting and apportionment of
costs to departments. Responding to Commissioner Geile, Mr. Warden stated Maximus, Inc., takes all
indirect departments, such as Finance, and Buildings and Grounds, and allocates the costs based upon
a prescribed methodology provided by the Federal government. The amount is then allocated
systematically to various departments for detail of indirect costs to every department within the County.
Commissioner Long moved to approve said agreement and authorize the Chair to sign. Seconded by
Commissioner Jerke, the motion carried unanimously.
AUTHORIZE CHAIR TO SIGN PROXY FOR VOTING STOCK FOR THE ANNUAL MEETING OF THE
LUPTON BOTTOM DITCH COMPANY: Mr. Barker stated this is for the annual meeting on January 31,
2004. Commissioner Vaad moved to authorize the Chair to sign. Seconded by Commissioner Jerke, the
motion carried unanimously.
AUTHORIZE CHAIR TO SIGN PROXY FOR VOTING STOCK FOR THE ANNUAL MEETING OF THE
LUPTON MEADOWS DITCH COMPANY: Commissioner Vaad moved to authorize the Chair to sign.
Seconded by Commissioner Geile, the motion carried unanimously.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
consent agenda. No Ordinances were approved.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by
the Acting Clerk to the Board.

1. Want to share my concern regarding the MPO Council membership and resulting less than fair
results in voting. Perhaps Glenn has already given you a coy of this, but I wanted it handy to tie it
into the Resource Allocations. My concerns with the Pop,Local $ & Votes:
1/3 (5) votes pay nothing into the MPO Council
90% of population represented by only 1/3 (5) votes
Larimer County, with 65%of population, has 1/3 (5) votes
2. Demonstrated with the Resource Allocation is a rather dramatic change when those who pay,
have the say. I've added the average information for FC, Loveland and Larimer Co. using a
straight average, and also the "100 weighting" method.
You will notice that the Weld Co numbers are not indicated, and that is the reason I am here
today, to see if you all can provide that input. The Resource Allocation numbers should relect
how Weld County submits projects for the 2030 Plan, and the dollars you will be appropriating
for the local dollar match, where appropriate; therefore, this information should be easy to
ascertain. The percentages might also include regional projects which you support and would like
to see in the plan.
The total dollars available for allocation were stated at $402.4 million over 25 years; or
16.1M/year. This was after the "restricted" dollars were removed. For example, if 10% is
appropriate for a given category, then 10% of the dollars you submit in projects should be in
that category. Or, another way to look at it would be to agree that $1.6 million/year should be
spent within the region in that category.
4. Although on a slightly different subject, but in light of so many unmet needs and so few
dollars available, I question Weld County's support for the VanGo program. This is approx. a
36% subsidy for between 2-250 people with very good paying jobs who oftentimes work outside
our MPO area. This is a $236,000(NET)/year program, using dollars which could be spent on
roads, bridges, or even transportation for the less fortunate (STP $). The 5 million miles/year
"saved" by this program equals .2% (two-tenths of one percent) of the regional travel trips, which
is over 11 million trips per DAY. This program has spent over $8 MILLION since 1995, with
very little benefit.
Again, the reason I came here today is to ask for Weld County's Resource Allocation information.
Greeley has promised to send theirs and I believe having complete information from the Big 5
(90% of the population) will provide data pointing out deficiencies in the process so that proper
changes can be made by the MPO Council.
The Resource Allocation numbers approved by the Council are very important, in that they
are used throughout the Five-Year Planning period for allocation of extra dollars coming into the
Region. There are many concerns about how the Federal Government wastes our highway fuel
tax dollars; and, the Council's Resource Allocation demonstrates how frugal or spendthrift IT is in
comparison to the percentage of dollars allocated from the highway fuel tax dollars, to improve
highways.
