Brand Jr. ADDRESS: 3251 Weld County Road 21 REQUEST: Two Lot Recorded Exemption LEGAL DESCRIPTION: Lot B RE-2505; Part S2N2SE4 Section 15,Ti N, R67W of the 6TH P.M.,Weld County, Colorado PARCEL NUMBER: 1469 15 000085 PARCEL SIZE: 34 +/- acres ZONE DISTRICT: Agricultural WATER SOURCE: Individual Shared Well SEWER SOURCE: Septic system Background: The applicant has a pending zoning violation on this property(VI-0200413) for having two residences on a single parcel. The proposed recorded exemption is located on Lot B of Recorded Exemption 2505 that was recorded November 11, 1999. One of the conditions of approval for RE-2505 was to vacate the older residence as a dwelling unit. This was not done and resulted in the zoning violation. This zoning violation was brought before the Board of County Commissioners on September 10, 2002. At this violation hearing the Board of County Commissioners advised Mr. Brand to proceed forward with a recorded exemption application to address the violation even though he is still within the 10-year time frame for his existing recorded exemption. It is the understanding of Planning staff that Mr. Brand intends to use the older residence as housing for people starting out in the teaching profession. Lot A of proposed recorded exemption 3636 is to be served by a domestic well that is to be shared with the existing home to be located on Lot B. Lot A is to be only 1.5 acres in size. Section 24-8-40.L of the Weld County code requires a minimum lot size of 2.5 net acres for lots served by a well unless exempted by the Board of County Commissioners. The location of the existing homes and outbuildings on the property make it difficult and impractical to create a Lot A that is a minimum 2.5 net acres in size. Staff feels that a Use by Special Review would have been preferable in this case given the layout of the property and the close proximity of the residences to each other. The Department of Planning Services' staff has reviewed this request and could not approve this request since the Department of Planning Services staff does not have the authority to grant an exception to Section 24-8-40.L of the Weld County Code. 1. It is the opinion of the Department of Planning Services' staff that the applicant has not shown compliance with the following sections of the Weld County Code: 2004-0531 A. Section 24-8-40.J The proposal is consistent with sound land use planning practices. The proposed recorded exemption would make Lot B of RE-3636 an island lot. Access to Lot B will be provided through a 30-foot access easement through Lot A of the recorded exemption. Section 24-7-50 J of Weld County Code states: "A flag lot configuration shall be avoided when possible." The minimum width of a flag lot appendage shall be thirty(30)feet." Lot B does not meet the minimum standards of a flag lot because it does not border the public right-of-way(County Road 21). An island lot configuration creates the possibility of future access and land use conflicts between adjacent property owners upon sale of Lots A and B. B. Section 24-8-40.K The proposal is consistent with the Statement of Purpose as expressed in Section 24-1-30 of this Chapter. Section 23-1-30.A Assisting orderly and integrated development. Section 23-1-30.8 Promoting the health, safety and general welfare of the residents of the County. C. Section 24-8-40.L- The minimum size of any lot proposed with a public water supply is not less than one(1)acre net. The minimum size of any lot proposed with a well as the water supply is not less than two and one-half(2%)acres net. Minimum lot sizes do not apply in zone districts which allow smaller lots or where exempted by the Board of County Commissioners. The minimum lot size does not apply to subdivision exemption lots created for the temporary use of a parcel for public utility facilities. D. Section 24-8-40.M- The proposed recorded exemption is not part of a recorded exemption or subdivision exemption which was done in conjunction with a recorded exemption approved within the last ten (10)years unless the original exemptions had an application pending as of October 25, 1995. This provision shall not apply in any Commercial or Industrial Zone District. Should the Board of County Commissioners approve this request, the Department of Planning Services' staff recommends the following conditions be attached:. 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations. 2. Topographic or physical features of the proposed Lot A, such as ravines, ditches, streams etc. may limit the area available for a new or replacement septic system. Prior to recording the plat the Weld County Department of Public Health and Environment recommends that the applicant review the Weld County Code pertaining to septic systems to assure that any installed septic system will comply with all setback requirements found in the Code. In the event the proposed lot is not of sufficient size to allow the installation of a septic system the lot may need to be enlarged. 3. Prior to recording the plat: A. The plat shall be titled: Recorded Exemption No. 1467-15-4 RE-3636 B. Lots A and B shall share a joint access point. C. The applicant shall supply a road access information sheet to the Department of Public Works. D. A 30 foot wide joint access and utility easement extending across Lot A from County Road 21,for the benefit of Lots A and B, shall be shown clearly on the plat. The joint easement shall be dedicated for the use as shown using the language set forth in the Weld County Code, Appendix 24-F.E. The easement shall be graded and drained to provide all weather access. E. County Road 21 is designated on the Road Capital Improvement Plan in the County Wide Impact Fee Code Ordinance as a local gravel road. There is presently 60 feet of right-of-way. The City of Dacono, in their referral dated August 7, 2003 indicates that the property is located within the City of Dacono Planning area. A total of 60 feet from the centerline of County Road 21 shall be delineated on the plat as right-of-way reservation for future expansion of County Road 21. This road is maintained by Weld County. F. The Platte Valley Soil Conservation District has provided information regarding the soils on the site.The applicant shall submit written documentation that they have reviewed the information and will use it to positively manage on site soils. G. The applicant shall address the recommendations of the Weld County Department of Public Health & Environment as stated in their referral received August 27, 2003 and provide a replacement septic system envelope for Lot A. Written evidence of such shall be provided to the Department of Planning Services. H. The applicant shall submit a sketch of the existing septic system in relation to the proposed lot line to the Weld County Department of Public Health and Environment. Evidence of Health Department approval shall be submitted to the Department of Planning Services. I. The applicant shall submit a joint ownership, access and/or operation maintenance agreement for the shared well. This agreement shall be delineated on the plat and an appropriate certificate using the language set forth in the Weld County Code, Appendix 24-F.E shall be included. J. The applicant shall attempt to address the requirements of the City of Dacono as stated in their referral received August 11, 2003. Written evidence of such shall be provided to the Department of Planning Services. K. The applicant shall provide the Weld County Department of Planning Services with a Statement of Taxes from the Weld County Treasurer showing no delinquent taxes exist for the original parcel. L. The following notes shall be placed on the plat: 1) All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line No building or structure as defined and limited to those occupancies listed as Groups A, B, E, H, I, M and R in Table 3-A of the 1997 Uniform Building Code,shall be constructed within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead. Any construction within a 200-foot radius of any tank battery or 150-foot radius of any wellhead shall require a variance from the terms of the Section 23-6-10 of the Weld County Code. 2) Any future structures or uses on site must obtain the appropriate zoning and building permits. 3) Prior to the release of building permits,the applicant shall submit a recorded deed describing the Lot upon which the building permit is requested with the building permit applications. The legal description on such deed shall include the Lot designation and Recorded Exemption number. 4) Potential purchasers should be aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment.The Weld County Department of Public Health and Environment strongly encourages well users to test their drinking water prior to consumption and periodically there after. / 5) Should noxious weeds exist on the property or become established as a result of the proposed development the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code. 6) Future development may necessitate a larger Lot A than what is displayed on the plat. In addition,a larger Lot A would provide additional dilution and attenuation of sewage wastes which may be beneficial to the environment. 7) Effective January 1, 2003, Building Permits issued on the proposed lots will be required to adhere to the fee structure of the Weld County Road Impact Program. (Ordinance 2002-11) 8) WELD COUNTY'S RIGHT TO FARM Weld County is one of the most productive agricultural counties in the United States, ranking fifth in total market value of agricultural products sold. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural area: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms,those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal pens, field work, harvest, and gravel roads; odor from animal confinement, silage, and manure; smoke from ditch burning; flies and mosquitoes; and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of the way of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Weld County covers a land area of over 4,000 square miles in size(twice the State of Delaware)with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement,ambulance,and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed,will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment,ponds and irrigation ditches,electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their children. 3. The applicant shall submit two(2)paper copies of the plat for preliminary approval to the Weld County Department of Planning Services. Upon approval of the paper copies the applicant shall submit a Mylar plat along with all other documentation required as conditions of approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services' Staff. The plat shall be prepared in accordance with the requirements of Section 24-8-70 of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty (60)days from the date of the Board of County Commissioners resolution. The applicant shall be responsible for paying the recording fee. 4. The Department of Planning Services respectfully requests the surveyor provide a digital copy of this Recorded Exemption. The applicant has a pending zoning violation on this property (VI-0200413) for having two residences on a single parcel. The proposed recorded exemption is located on Lot B of Recorded Exemption 2505 that was recorded November 11, 1999. One of the conditions of approval for RE-2505 was to vacate the older residence as a dwelling unit. This was not done and resulted in the zoning violation. This zoning violation was brought before the Board of County Commissioners on September 10, 2002. At this violation hearing the Board of County Commissioners advised Mr. Brand to proceed forward with a recorded exemption application to address the violation even though he is still within the 10-year time frame for his existing recorded exemption. It is the understanding of Planning staff that Mr. Brand intends to use the older residence as housing for people starting out in the teaching profession. Lot A of proposed recorded exemption 3636 is to be served by a domestic well that is to be shared with the existing home to be located on Lot B. Lot A is to be only 1.5 acres in size. Section 24-8-40.L of the Weld County code requires a minimum lot size of 2.5 net acres for lots served by a well unless exempted by the Board of County Commissioners. The location of the existing homes and outbuildings on the property make it difficult and impractical to create a Lot A that is a minimum 2.5 net acres in size. Staff feels that a Use by Special Review would have been preferable in this case given the layout of the property and the close proximity of the residences to each other. Planning & Health Department staff have also recently discovered a septic permit (issued in 1980) that appears to be for the existing house on proposed Lot A. The septic permit has a sketch of the location of the septic tank & leach field. The sketch shows that the leach field was located approx. 360 feet west of the existing residence at its furthest point. This would mean that the septic system would not be located on the same lot as the house that it serves. Section 24-8-40.J The proposal is consistent with sound land use planning practices. The proposed recorded exemption would make Lot B of RE-3636 an island lot. Access to Lot B will be provided through a 30-foot access easement through Lot A of the recorded exemption. Section 24-7-50 J of Weld County Code states: "A flag lot configuration shall be avoided when possible." The minimum width of a flag lot appendage shall be thirty(30) feet." Lot B does not meet the minimum standards of a flag lot because it does not border the public right-of-way (County Road 21). An island lot configuration creates the possibility of future access and land use conflicts between adjacent property owners upon sale of Lots A and B. Lupton, CO 80621 Mr. Brand: On Friday, November 13th I met with Monica Daniels-Mika, Director of the Weld County Planning Department, regarding the request to perform a Subdivision Exemption in conjunction with a Recorded Exemption (RE/SE) on property located at 3251 WCR 21, located in Section 15, Township 1 North, Range 67 West of the 6th P.M. of unincorporated Weld County. Specifically, the property includes approximately 40 acres which have existed under the same legal description since prior to the enaction of formal zoning in Weld County(August 30, 1972), making the parcel legal and buildable. The site currently includes two homes, one of which has been on site for several decades, and another which was moved on site in 1980. The older home is considered a legal, Non-Conforming structure since it has existed on site since prior to August 30, 1972. The newer of the two homes was moved on site after this date, and therefore prompted review by Planning staff. According to Section 31.2.1 of the Weld County Zoning Ordinance, only one (1) principal dwelling unit is allowed per legal lot in the (A)Agricultural zone. Weld County normally offers the Recorded Exemption/Subdivision Exemption option to land owners who have two homes on one parcel which have existed prior to August 30, 1972. This status allows the landowner to separate both homes from the "mother" parcel, creating a total of three separate, legal, buildable parcels. In this situation, however, it has been determined that the newer home does not afford the landowner the RE/SE option because it was moved on site after August 30, 1972. The following is supporting evidence for this decision: 1. Section 3.3 B.a. of the 1980 Weld County Zoning Ordinance allows "Dwellings or living quarters for persons customarily employed at or engaged in the principal permitted use as listed in this Resolution" as a Use by Right in the (A)Agricultural zone. 2. In a letter written by Alvin R. Brand, Jr., dated October 7, 1980, a request was made to allow a second home on the site to allow such "farm hand" quarters to be constructed. Specifically the letter reads, "I am requesting permission to place another dwelling on this property so that a farm hand can live on residence...We, my brother and myself, need help in maintaining our farm land...Because of our occupations we need the help of someone on a full-time basis...Our father will act as the farm hand. His salary will be based on the profits made from the land...advantages for having a farm hand in res. nce on my property: 1) Cost of operation of both farms would be reduced by having a farm hand on residence... 2) Having a farm hand on residence will also make operating both farms much easier for everybody involved." This letter obviously describes a second home which will facilitate an accessory to the farm. It is the understanding of the Weld County Planning Department that you are requesting to split the property through the RE/SE option because your father, who still resides in the home but can no longer operate as a farm hand, has lived there since 1980 and no other reasonable living arrangement exists. Furthermore, you would like to build a new home on this parcel to replace the older home, and a demolition/replacement schedule cannot be worked out. While the practical difficulties involved here are understood by Planning Staff, it seems that no options are available with regard to an RE/SE combination. The Zoning Ordinance simply does not afford a landowner this option when a home was placed on a parcel after August 30, 1972. Furthermore, in none of the governing regulations for Weld County does it allow this procedure to occur when an accessory dwelling to a farm becomes obsolete due to the advancing age of the farm hand. In essence, the fact that your father can no longer function as a farm hand does not make the site eligible for an RE/SE split. In addition, the original letter requesting the second dwelling does not mention the possibility that, when the farm hand employed on site becomes unable to function in that capacity, the home shall then become a second principal dwelling unit. Given this situation the property owner has several options if a land split is still desired. First, a simple two-lot Recorded Exemption may be applied for on the property. This process will separate the property into two lots, with one home residing on each lot. Another option is to perform the Recorded Exemption, and then apply for Zoning Permit for a Mobile Home (ZPMH) as a Temporary Use During Construction, so that the property owner may reside on site while a new home is constructed. This option will require the demolition of one of the existing homes. The Ulm clay loam soil has severe limitations, and the Weld loam and Wiley-Colby soils have moderate limitations, for dwellings with or without basements due to shrink-swell potential. The low strength of the Weld loam, Wiley-Colby and Renohill clay loam soils create moderate limitations for roads. For sanitary septic system absorption fields,the Ulm clay loam soil has severe limitations due to its slow percolation rate. PRIME FARMLANDS: When irrigated, the Ulm clay loam,Weld loam and Wiley-Colby soil types are considered `prime farmland'. • SOIL EROSION POTENTIAL: The Wiley-Colby soil has high potential for wind erosion, while the other soil types on the proposed parcels have moderate potential for wind erosion. Appropriate measures should be taken to minimize wind soil erosion during any future construction activities, such as avoiding disturbances to large areas. It is recommended that, at the conclusion of construction activities, disturbed areas be stabilized with perennial vegetation.
