The lot shall have its own access; each access shall be designed to carry a designed wheel load of 18000pounds (80000 pound gvw) (H2O loading). 2. Storage, use, dispensing, mixing and handling of flammable and combustible liquids shall be in accordance with Article 79 of the 97 UFC. 4. Material classification. Flammable and combustible liquids shall be classified in accordance with Article 2 and as set forth in Table 7901.1-A of the 97 UFC. COMBUSTIBLE LIQUID is a liquid having a flash point at or above 100'F (37.8'C). Combustible liquids are subdivided as follows. The category of combustible liquids does not include compressed gases or cryogenic fluids. Class II liquids are those having closed cup flash points at or above 100"F (37.8'C) and below 140'F (60'C). Class III-A liquids are those having closed cup flash points at or above 140'F (60'C) and below 200'F (93.3"C). Class III-B liquids are those liquids having closed cup flashpoints at or above 200'F (93.3'C). FLAMMABLE LIQUID is a liquid having a closed cup flash point below 100'F (37.8'C). The category of flammable liquids does not include compressed gases or cryogenic fluids. Flammable liquids are further categorized into a group known as Class I liquids. The Class I category is subdivided as follows: Class I-A liquids include those having a flash point below 73'F (22.8"C) and having a boiling point below 100'F (37.8'C). Class I-B liquids include those having a flash point below 73'F (22.8'C) and having a boiling point at or above 100'F (37.8"C). Install, construct, alter or operate tank vehicles, equipment, tanks, plants, terminals, wells, refineries and similar facilities where flammable and combustible liquids are produced, processed, transported, stored, dispensed or used. 5. Change the type of contents stored in a flammable or combustible liquid tank to a material other than that for which the tank was designed and constructed. 7901.3.2 Plans. Plans shall be submitted with each application for a permit to store more than 5,000 gallons (18 925 L) of liquids outside of buildings in drums or tanks. The plans shall indicate the method of storage, quantities to be stored, distances from buildings and property lines, access ways, fire-protection facilities, and provisions for spill control and secondary containment. Oil and gas wells should be fenced off in order to mitigate the potential for tampering. These facilities are known to create an attractive nuisance for young people. Tampering not only creates a significant danger to safety but also has the potential of environmental damage with extensive mitigation and clean-up costs. The Sheriff's Office lacks the ability to absorb any additional service demand without the resources recommended in the multi-year plan provided to the Board of County Commissioners or as indicated by growth not considered at the time the plan was developed. SUBJEDATE:CT.02/R-1462 19/O04 PRIMA OIL AND GAS COLORADO CC: Environmental Health Services has reviewed this proposal for an oil and gas production facility (four oil and gas wells). We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application from the Air Pollution Control Division (APCD), Colorado Department of Health and Environment. Alternately, the applicant can provide evidence from the APCD that they are not subject to these requirements. 2. According to the application materials submitted the site will temporarily store oil and water in aboveground storage tanks. Therefore, the applicant shall submit evidence of an Aboveground Storage Tank permit from the Colorado Department of Labor and Employment (CDL&E), Oil Inspection Section for any aboveground storage tanks located on the site. Alternately, the applicant can provide evidence from the (CDL&E), Oil Inspection Section that they are not subject to these requirements. 3. In the event that 1 or more acres are disturbed during the construction and development of this site, the applicant shall inquire with the Water Quality Control Division (WQCD) of the Colorado Department of Public Health and Environment if they are required to obtain a stormwater discharge permit. Alternately, the applicant can provide evidence from WQCD that they are not subject to these requirements. 4. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: r 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan". 5. If applicable, the applicant shall comply with all provisions of the Underground and Above Ground Storage Tank Regulations (7 CCR 1101-14). 6. Fugitive dust and fugitive particulate emissions shall be controlled on this site. 7. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in 25-12-103 C.R.S., as amended. 8. Adequate toilet facilities (port-a-potty) shall be provided during the construction of the facility. 9. The subject property is located within the Town's Growth Management Area and is depicted as Parks, Open Space, Mineral Extraction and Floodplains; Light Industrial; and Heavy Industrial on the Town's Land Use Plan map. The proposed drilling of oil and gas wells is compatible with the industrial land use depictions and, while the Windsor Comprehensive Plan states that the Parks, Open Space, Mineral Extraction and Floodplains land use depiction provides for recreational uses and facilities, the impact on the existing recreational facilities in the immediate vicinity should be minimal. The applicant has been authorized by the Town to utilize the Town's road to the sewage treatment plant during the drilling and on-going operation of the oil and gas wells. The applicant is to restore the road to its original condition in the event that the applicant causes any damage to the road. Based upon the aforementioned information, the Town of Windsor Planning Commission recommends approval of the Use by Special Review to the Weld County Department of Planning Services subject to the following conditions: (1) In the event that the applicant causes any damage to the Town's sewage treatment plant road, the applicant shall restore the road to its original condition. (2) All requirements of the Windsor-Severance Fire Protection District shall be addressed to the District's satisfaction. (3) The applicant shall provide information regarding the status of their discussions with the Eastman Kodak Company regarding the proposed wells to Weld County.
