HomeMy WebLinkAbout20040451.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST CHRIS AND CHERYLON DUVALL FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Chris and Cherylon Duvall,VI#0200461, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 10th day of February, 2004, a public hearing was held before the Board , of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Chris and Cherylon Duvall, property owners, were represented by Chrisann Rees at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until August 10, 2004, to allow adequate time for the property owners to submit a demolition permit to tear down the mobile home and bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. May 23, 2003 Received letter from Chris Duvall requesting ZPMH-2229 be converted to a "Temporary Storage of a Mobile Home". December 3, 2003 Wendi Inloes sent a letter of advisement regarding the expiration of ZPMH-2229. January 14, 2004 Letter sent to property owner indicating that the violation case was scheduled before the Board of County Commissioners. I have scheduled a meeting with the Board of County Commissioners on February 10, 2004, at 10:00 a.m., to consider the violations occurring on the property. The above mentioned property remains in violation of the following Section(s) of the Weld County Code: Chapter 23, Article III, Div 1 "A(Agricultural) Zone District" Section 23-3-20 "Uses allowed by right." Section 23-3-30 "Accessory uses." Section 23-3-30.F "Mobile Home subject to the additional requirements of Article IV, Division 3 of this Chapter." Chapter 23, Article IV, Div 3 "Mobile Homes" -No mobile home may be located or relocated in the County after August 25, 1981, except in accordance with this Division, including the issuance of any zoning permit which may be required by this Section. Each mobile home located or relocated in the County after said date must have a building permit for a mobile home issued pursuant to Chapter 29 of this Code.... Section 23-4-140 "Mobile homes permitted in the A Zone District." Chapter 29, Article VII "Mobile, Manufactured or Factory-Built Home Permits" • Section 29-7-10 "Permit required." -No mobile, manufactured or factory-built home,as defined in this Building Code,may be located or relocated within the County without a building permit issued by the Building Official. To bring the property into compliance: The mobile home, previously permitted through ZPMH-2229,for temporary storage,shall be removed or permitted. Our records indicate that you have been previously advised (December 3, 2003) that a renewal fee was to be submitted or the mobile home was to be removed from the property. We can find no evidence that either has occurred, as a result this letter is being issued. Additionally, upon reviewing my case files, it appears that the building permit for this mobile home (PR-0030293) was never completed. To remedy this aspect of the violation, the mobile home shall be removed or the permit shall be completed by receiving the necessary inspections to ensure your safety and welfare. Although I understand your circumstances, mobile homes are not allowed to be used for storage units per Section 23-4-160 of the Weld County Code. Parcel Identification Number: 0457 32 000019 Water Source: Private Well Sewer Source: Se tic The Department of Planning Services'staff has reviewed this request and approves this request for the following reasons: WILL WILL NOT Be compatible with the Weld County Comprehensive Plan. x Be compatible with the surrounding area. x _ Be in harmony with the character of the neighborhood. Adversely affect the immediate area. Be adequately served by wafer and sewage disposal facilities. The Department of Planning Services'staff recommendation for approval is conditional upon the following: 1. The applicant shall apply fora building permit for the permanent dwelling unit currently located on the property as stated in Section 43.2.1.1 of the Weld County Zoning Ordinance. 2.. The applicant shall apply for a building permit for the mobile home prior to locating the mobile home on the property. • 3. Prior to the occupancy of the mobile home, the mobile home shall be connected to an approved septic system and a legal water supply. 4. The mobile home shall not be occupied until such time that the applicant has complied with Conditions 1 through 3 stated above. 5. The mobile home shall be removed from the parcel within 30 days of receipt of the Certificate of Occupancy for the principal dwelling. 6. The temporary permit for occupancy of the mobile home shall be issued for a period of six (6) months. The permit may be renewed by the department of planning services for two (2) additional six(6)month periods upon a determination by staff that construction of the permanent dwelling unit is being pursued with diligence. 7. All vehicles located on the property must be operational with current license plates,be screened from all adjacent properties and public rights of way, or be removed from the property. All other items considered to be part of a noncommercial junkyard must also be removed from the property or screened from adjacent properties and public rights-of-way. 8. The Department of Public Health and Environment recommends that the applicant set aside an area for a septic system replacement envelope. 9. WCR 100 is designated on the Transportation Plan Map as a local gravel road,which requires a 60- foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89, as amended), the required setback is measured from the future right-of-way line. 10. Direct access from a public road shall be limited; only one access is allowed per legal residential parcel. No circle drives will be allowed. This policy shall apply to all new and existing accesses within the unincorporated areas of Weld County. Properties within municipalities or other counties that access Weld County roads are also subject to this policy. 11. The applicant shall utilize the existing residential access to this parcel, and no additional accesses shall be granted. 12.
