HomeMy WebLinkAbout20040934.tiff HEARING CERTIFICATION DOCKET NO. 2004-36 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1462 FOR AN OIL AND GAS PRODUCTION FACILITY(FOUR OIL AND GAS WELLS)IN THE I-1 (INDUSTRIAL) ZONE DISTRICT - PRIMA OIL AND GAS COMPANY A public hearing was conducted on April 7, 2004, at 10:00 a.m., with the following present: Commissioner Robert D. Masden, Chair Commissioner William H. Jerke, Pro-Tem Commissioner M. J. Geile Commissioner David E. Long Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Sheri Lockman Health Department representative, Char Davis Public Works representative, Donald Carroll The following business was transacted: I hereby certify that pursuant to a notice dated March 19,2004,and duly published March 24,2004, in the Fort Lupton Press, a public hearing was conducted to consider the request of Prima Oil and Gas Company for a Site Specific Development Plan and Use by Special Review Permit#1462 for an Oil and Gas Production Facility(four oil and gas wells) in the I-1 (Industrial)Zone District. Lee Morrison,Assistant CountyAttorney,made this a matter of record. Sheri Lockman,Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Lockman gave a brief description of the location of the site and surrounding land uses. She stated nine referral agencies reviewed this proposal, seven responded with comments that have been addressed through the Conditions of Approval and Development Standards,and staff received no correspondence from surrounding property owners. In response to Commissioner Jerke, Ms. Lockman stated there will be four separate oil and gas wells,and the only reason a Use by Special Review Permit is required is that the use is located in the Industrial Zone District. Responding to Chair Masden, Ms. Lockman stated the applicant did submit a letter from Kodak to address Condition of Approval #1.A. She further stated the wells will be in separate locations, not on the same pad. Char Davis,Department of Public Health and Environment,stated Condition of Approval#1.F was included in the event the Colorado Department of Public Health and Environment requires the applicant to apply for an Air Pollution Emission Notice (APEN). Donald Carroll, Department of Public Works,stated the site will be accessed from Highway257 or through the Kodak property,therefore,no Weld County access points are involved. In response to Commissioner Vaad, Mr. Carroll stated the gross vehicle weight allowed is 80,000 pounds, and Condition of Approval#1.E will ensure the road width and access are adequate with an all-weather surface. 2004-0934 PL1714 (O ! /&Zi (_c��- 0t/-( -e>q HEARING CERTIFICATION - PRIMA OIL AND GAS COMPANY (USR#1462) PAGE 2 Mike Wozniak,attorney,represented the applicant and reiterated this permit is required because the use is in the Industrial Zone District. He stated the applicant has secured a signed Surface Use Agreement with Kodak and the Anderson family,as well as the necessary State permits. He stated two of the wells will be located at the edge of the floodplain, therefore, a Flood Hazard Permit will be obtained. In response to Commissioner Geile,Mr.Wozniak stated theywill not do drilling during the agricultural season, in an effort to mitigate concerns expressed by the tenant of the Kodak property. In response to Chair Masden, Mr. Wozniak reiterated they will have four separate locations;however,they are trying to join the wells to one or two tank batteries,and the agreement designates the specific locations. Chair Masden commented the Board is going through the Early Action Compact process, and he questioned whether special equipment will be necessary. Mr. Wozniak stated during 2005, each operating company must reduce its emissions by 35 percent, which will involve adding$20,000 worth of equipment to each of the tank batteries. He stated these four wells will be in compliance with the attainment status. Chair Masden commented they have heard testimony regarding the two types of equipment used and the flares involve tall towers. Mr. Wozniak concurred there will be visual impacts to be mitigated,and often the internal measures are preferable to the tall towers. No publictestimonywas offered concerning this matter. In response to Chair Masden,Mr.Wozniak stated he and the applicant have reviewed and concur with the Condition of Approval and Development Standards as proposed. He stated the APEN will be done for the wells as a group, rather than individually. Commissioner Long moved to approve the request of Prima Oil and Gas Company for a Site Specific Development Plan and Use by Special Review Permit#1462 for an Oil and Gas Production Facility(four oil and gas wells)in the I-1 (Industrial)Zone District,based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Jerke,and it carried unanimously.
