ADOLESCENT TREATMENT Alternative Homes For Youth is working very hard with the Boulder Homebuilders -
CENTER - Association to get a new building in place that could be used to house youth who are
Longmont,CO currently living in the upstairs of our primary building. They have recruited contractors

to our needs.

Staff will be requesting a change to the code to include pre-existing uses which were legally established to

Dear Ms. Lochman:
Attached is your letter of November 8, 2000 regarding the school building and clarifying
that the child care facility is not non-conforming but is a use by Special Review 851.
We have been notified that the Homebuilders Association has decided to build us an
approximate 2,856 Sq ft (42' x 68') residence with a full basement so that we can move
one of the living units off of the top floor of our exiting building. With this contribution
we will have several different options that could have varying impacts on zoning
requirements. Of primary importance is the desire of the Homebuilders Association
to begin construction on or as soon after July 1, 2002 as possible. The building plans
are not quite complete but they report that they already have commitments for 80% of the
materials and labor for a July 1 start date.
• The main building is approximately 6,000 sq. ft. (about 2,000 sq. ft per floor.
which includes a bi-level style basement area.
• The new school building is 2,000 sq. ft. with a bi-level style full basement.
• The current school building is 1,000 sq. ft. with a full basement. Prior to 1988 it
was a 3-bedroom residence. There is a possibility that we will tear down this
building with the construction of the new residence.
• We expect to provide sewer service to the property within the next month as
approved by the St. Vrain Sanitation District last year. This improvement will
remove all of the buildings from a septic system that has been a real pain to
maintain over the years.
Option I
The new building could be licensed for either 11 or 12 youth to replace the top floor unit
in the main building, which is licensed for 11 youth. The top floor could be used for
office space could be converted to office space for family therapy etc.

Option II
The new building could be licensed for 12 youth and be used in addition to the existing
22 bed (2 living units) main building, which would increase the occupancy for the one-
acre site to 36 youth. This is not a high priority for us.
Option III
The new building could be licensed for 11 or12 youth,the new school building could be
converted to an 11 or 12 bed residence, and the main building could be converted back
into a school and office building. This main building was originally built about 1920 as a
school. This option would leave the occupancy of the site the same or add 2 additional
beds, depending on whether adding two beds would lengthen any zoning process.
Eventually, and by that we mean it could be several years, we may consider increasing
the license capacity to 48 youth. This is not a high priority at present.
We are unclear as to what, if any zoning process we need to initiate in order to begin
construction as soon as possible on the new residential building.
• Does a change in the number of licensed beds alone,require a hearing?
• Does the new building replacing an old living unit(the top floor) require a
hearing?
• If we leave the number of licensed beds the same, is the new building just an
accessory building that requires no hearing?

COLORADO:
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is
vested with the authority of administering the affairs of Weld County,
Colorado, and
WHEREAS, the Board of County Commissioners has the power and authority
under the Weld County Home Rule Charter and Article 28 of Title 30 CRS
1973, to adopt zoning regulations for the unincorporated areas of the
County of Weld, and

Re: Letter of Intent Clarification
Our letter of October 5, 2000 regarding the construction of an approximate
2,000 square foot building did not adequately define the use by right utilization of
the building. The Creative Arts Building is to be utilized as a part of the school,
said school meeting the definition of a "Public School" in your ordinances.
Activities in the building will result in educational credit or will be consistent with
utilization of a "public school building".
The school is funded by the Colorado Department of Education and local
school districts and "satisfies compulsory SCHOOL attendance requirements" of
CRS 33.22. Attached is official notice from the Colorado Department of
Education of"special education" authorization for this last school year.
It is our belief that this constitutes a use by right and does not require a t )

Dear Mr. Cunliffe :
Attached is an initial floor-plan for remodeling the interior
of the main floor of the ancillary building located in the north
west quarter of the property known as 745 Hwy 119 , Longmont ,
Colorado (PT. -SE, S .-6 , T-2 , R. 68) . Walls to be removed are
indicated in yellow, walls being added are in green. The four
piece bath is being converted into two toilet facilities . David
Bishton, AIA, CSI of Longmont will be providing working drawings .
We 've researched our records from when the property was owned
by Midwest Children ' s Home for information on the approved use of
this building. The only pertinant records we found was an
Application For Individual Sewage Disposal System No . 71-82 ,
approved on 05/28/82 . Attachments to this document indicate the
use was for "Office and Apartments" . Based on usage when we
purchased the property, the main floor of the building would have
been the apartment, which housed a caretaker/emergency worker and
his family, a total of four persons . We recently asked him to move
out so that we could proceed with the remodeling and move the
classroom from the office area in the basement to the main floor.
No change in the footprint is planned.
In the next year or two we hope to remodel the interior of the
main building on the property. At that time we plan to increase
our licensed capacity from 18 youth to 20 youth. The two projects
combined will result in a net reduction of two individuals living
on the property.
Please inform us in writing of any problems or special
requirements with regard to these plans .

Our office has established a Special Review permit No. USR-851 under Section
76. 1 of the Weld County Zoning Ordinance for a one acre tract of land
located in part of the SE} of Section 6, T2N, R68W of the 6th P.M. , Weld
County, Colorado. The permit is issued for a residential child care
facility for a maximum of 18 youth. The permit shall be limited to plans
and information submitted by Mr. Virgil Good, the Colorado Department of
Social Services, and Alternative Homes for Youth on file with the Department
of Planning Services. The use of the property must comply with any County,
State, or Federal requirements or regulations which may apply to the uses
conducted on the property.
The use may not be expanded or enlarged without first obtaining an amendment
to USR-851 in accordance with the requirements of the Weld County Zoning
Ordinance. Expansion or enlargement is determined by the number of youth
being care for in the facility, the physical expansion of the facility
including buildings or accessory structures, or a change in the use of the
facility or property which results in a more intense use or creates
potentially greater impacts than what was originally permitted.

Dear Mr. Holland:
Thank you for your letter of July 27. The Board of County Commissioners has
reviewed your letter. It was determined that a Special Review permit could
be considered under Section 76.1 of the Weld County Zoning Ordinance
provided the following items are submitted:
1. Written documentation from Midwest Children's Home, Inc.
indicating the maximum number of staff and children that were
- present when it operated the facility and property.
2. A scaled drawing or plot plan of the property showing all existing
structures and information how they were being used under the
management of Midwest Children's Home, Inc.
3. A copy of the approved license granted to Midwest Children's Home,
Inc. by the State of Colorado to operate a residential child care
facility.
Once these items have been submitted and no additional information is
requested, a decision will be made whether to establish a Special Review
permit for the property and use of the facility as a residential child care
facility.

Dear Mr. Cunliffe:
Alternative Homes For Youth has agreed to purchase the
Midwest Children ' s Home , Inc . property located in the SE 1 /4
of Section 6 , T2N , R68W of the 6th P .M. , Weld County
Colorado. This facility is a licensed Residential Child
Care Facility by the State of Colorado grandfathered in
under Paragraph 76 . 1 , Page 70-4 of the Weld County Zoning
Ordinance .
Alternative Homes For Youth has applied for a license
under its name as a Residential Child Care Facility . The
facility will not be licensed for more than its previously
licensed capacity of eighteen youth . The number of staff
will not be increased from the number of staff maintained by
Midwest . No expansion of the facilities is expected
although some interior remodeling and/or repairs shall be
made with appropriate building permits when required. We
understand that any expansion of the facilities or increase
in the number of youth or staff would require a special use
review by the County.
As was the case with Midwest Children's Home, Inc . , our
clients display a wide range of needs which require a broad
range of skills from our staff . Just as a mother would have
difficulty listing all the things she does or teaches her
children, we have difficulty listing all of the different
aspects of working with disturbed youth. Major components
or areas of service and expertise in our program include
family therapy, individual therapy , group therapy , wilder-
ness experience and recreational therapy , an approved educa-
tional program, vocational and independent living skills
training , drug education and counseling ,and personal hygiene
training .

Department has placed adolescents with Alternative Homes in the past, and we
are very satisfied with the quality of care our youngsters have received.
The proposed expansion of Alternative Homes is in our best interest since
the proposed physical plant is in our county. We feel this will be another
resource for our youth.

RE: Notice of Inquiry for Alternative Homes for Youth
Dear Sheri:
The City of Longmont has received a Notice of Inquiry form for the Alternative Homes for
Youth (AIiY) at 145 $11119 East. AHY wants to expand their special use permit to allow up to
24 youth to live in the one story frame building that already has been constructed on.site. It will
be licensed as a Residential Child Care Facility by the Colorado Department of Human Services.
From conversations with Jean Osborne of AllY, part of the special use application will be to
connect the older two story children's home to sanitary sewer (the new one story frame building
already is connected to sanitary sewer), and to reinoWe an existing one story apartment/office
building and an existing storage shed from the site. IVIjr iutderstandipg is that these changes will
be completed before the end of the summer. In short, no new buildings will be constructed with
the approval of this amendment to their special use application,
Weld County's Notice of Inquiry form asks whether the City of Longmont wants this site to
develop within the City. As you know, this property is a Weld County enclave surrounded by
the City of Longmont. As such, the City is in a position to annex it unilaterally. Under City
Council's direction, City staff has contacted owners of gnclaves to determine whether or not they
are agreeable to annexation. Phil Delveccbio, Community Development Director, has traded
voice mails with Dave Lack of the AHY main office in Wheatridge. Mr„Lackk has expressed an
interest in discussing annexation. Action on any unilatgral annexations would not begin until the
end of the year. The City of Longmont does not desire to delay the licensing and occupancy of
the one story frame, building for a Residential Child Care Facility provided that the other
•improvements to the site mentioned above occur as represented to us. Consequently, the City
respectfully requests that Weld County process the amendment to the special use permit. When
the City receives that referral,we will comment on it at that time.
