K. P. Kauffman Company, Inc. ("KPK") owns and operates several oil and gas
wells within the subject development. KPK is in conflict and objects to any surface
development by the surface developer. KPK has many oil and gas wellheads,
Bowlines, pipelines, right a ways and easements that must be protected before any
surface activity can be performed. Also, KPK and the surface developer have not
formalized a surface use agreement covering the subject property.

Dear Clerk and County Board Members:
Please be advised that K. P. Kauffman Company, Inc. (KPK) is concerned about a
proposed surface development called Delmar Estates or Delmar Properties(Surface
Development). KPK has sent Delmar Properties (Developer) a copy of KPK's Surface
Use Agreement on February 18, 2003 and September 30, 2003. As of the date of this
letter, KPK has not received feed back from the Developer concerning the surface issue
and the oil and gas estate on the property. As per the last plat that I have seen in 2003,
KPK has many conflicting issues with the Developer's plat and KPK's oil and gas estate.
The proposed Surface Development will directly impact KPK's existing and future oil
and gas operations.
KPK requests assurance from Weld County that the proposed Surface Development will
not preclude KPK from drilling, operating, producing and other normal activities for
maintaining existing and future oil and gas lease operations. KPK objects to the
K. P. KAUFFMAN COMPANY, INC.
the proposed Surface Development because of the damaging impact the said Surface
Development will cause to KPK's real property rights and said oil and gas lease
operations. KPK request any approve of the Surface Development be conditioned upon
KPK's reasonable use of the surface. Any approval of the Surface Development should
be conditioned upon an executed Surface Use Agreement between KPK and the
Developer.
In the absence of a Surface Use Agreement, the action of the Weld County may
impair the real property rights and oil and gas leases rights of KPK. Also, approval of the
Surface Development Final Plat by the Weld County may constitute regulatory takings of
ICPK's real property rights.
KPK requests this letter of formal objection for the Surface Development plat be
noted and recorded within the Weld County public hearings and notices. Should you
have any questions please contact me at any time. Thank you for your attention to this
matter.
