COLORADO December 23, 2003 Duke Energy Site Specific Development Plan and Special Review Permit for a Mineral Resource Development Facility including an Oil and Gas Support and Service Facility (Oil and Gas Processing Facility) in the A (Agricultural) Zone District 2nd AmUSR-542 There are three permits on record for this parcel number or address, all of which received final inspection approval. One permit was issued for a cooler. The second permit was issued for an additional cooler. The third permit was issued for an upgrade to equipment at the facility. Permits will be required for the installation of all new equipment and all electrical work, but not for the replacement of equipment on existing foundations, including the piping and electrical connections to that equipment, nor for the addition of minor equipment such as filters and coolers, however electrical permits are required for any new electrical circuits provided to added equipment. Our comments and requirements are as follows: COMMENTS: WCR 35 and WCR 40 adjacent to the USR site are designated as local gravel roads. Both roads have a 60-foot right-of-way, and are maintained by Weld County. Our most recent traffic count taken on WCR 35 reflects 158 vehicles taken 10/10/2002. On WCR 40, the recent traffic count reflects 116 vehicles taken 7/13/1999. REQUIREMENTS: `"-,ccess: Utilize the main access point on to WCR 35. There is a secondary emergency access located at the aouth corner of the proposed USR. Only utilize this access for emergency purposes. Off Street Parking: The off-street parking spaces including the access drive shall be surfaced with gravel or the equivalent and shall be graded to prevent drainage problems. Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. I am referring a portion of the storm water drainage to the Department of Health and Environment, as it deals with oil and gas production. Additional requirements and/or permits may be necessary. Traffic: The Weld County Public Works Department has not received any complaints on dust issues. In the questionnaire, the applicant identified that five employees will be utilizing the site in a 24-hour period. These employees will utilize pick up trucks and semi truck traffic approximately three per day. The sheriff's office would however be willing to provide a program entitled Crime Prevention through Environmental Design to the developer. This program reduces the likelihood of criminal activity at a specific location by"hardening" it to crime. The Sheriff's Office lacks the ability to absorb any additional service demand without the resources recommended in the multi-year plan provided to the Board of County Commissioners or as indicated by growth not considered at the time the plan was developed. AMUSR-542 DUKE ENERGY(MEWBOURN PLANT) DATE: COLORADO CC: Environmental Health Services has reviewed this proposal for Mineral Resource Development facility. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application from the Air Pollution Control Division, Colorado Department of Health and Environment, if applicable. 2. The applicant shall submit a dust abatement plan for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. 3. The septic system serving the office, (septic permit# G830182) was designed to serve 2 persons per day. The application materials indicate that five persons per day will we utilize the site. Therefore, the existing septic system shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. 4. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). EX4IBIT 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan". 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan at all times. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Light industrial Zone as delineated in 25-12-103 C.R.S., as amended. 7. Adequate handwashing and toilet facilities shall be provided for employees and patrons of the facility. 8. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 9. Adequate toilet facilities (port-a-potty) shall be provided during the construction of the facility. 10.The facility shall utilize the existing public water supply.
