and agree to and with the grantees, their heirs and assigns, that at the time of the
ensealing and delivery of these presents, he is well seized of the premises above
conveyed, has good, sure, perfect, absolute and indefeasible estate of inheritance, in
law, in fee simple, and has good right, full power and lawful authority to grant,
bargain, sell and convey the same in manner and form aforesaid, and that the same are
free and clear from all former and other grants, bargains, sales, liens, taxes,
assessments, encumbrances and restrictions of whatever kind or nature soever, except
general taxes for 2002 and subsequent years; except easements, restrictions,
covenants, conditions, reservations and rights of way of record, if any;
The grantor shall and will WARRANT AND FOREVER DEPEND the above-bargained premises
in the quiet and peaceable possession of the grantees, their heirs and assigns,
against all and every person or persons lawfully claiming the whole or any part
thereof.
The singular number shall include the plural, the plural the singular, and the use
of any gender shall be applicable to all genders.

and under said property, together with the right of ingress and
egress for the purpose of exploring for and producing the same, an
reserved by warranty deed dated December 7, 1963, recorded December
26, 1963 in Book 501 as Reception No. 1424693 of the Wald County
records, end any interest therein or rights thereunder, and
(b) One-half (1/2) of all oil, gas and other minerals
in, on and under the above described property as reserved by
warranty deed dated December 8, 1978, recorded December 19, 1978

(4) Right to the use of water produced from a certain
irrigation well located on the above described property near the
Northeast corner of Parcel A of Recorded Exemption No. O8O3-3-2-
RE343 for a period of time of one hour per week during the farming
season for irrigation of the pasture ground on said Parcel A,
together with the right of way and easement existing from said
irrigation well to said Parcel A, and together with the rights of
access for the purpose of cleaning, maintaining and operating said
right of way, easement and ditch system, as conveyed in warranty
deed recorded July 23, 1979 in Book 867 as Reception No. 1797605
of the Weld County records.
(5) Subject to that certain deed of trust from Howard G.
Harper and Helen L. Harper to the Public Trustee of the County of
Weld, State of Colorado, for the use of Herman Schaller and Nina
M. Schaller to secure the sum of $262,900.00, which deed of trust
is dated December 8, 1978, recorded December 19, 1978 in Book 854
as Reception No. 1776267 of the Weld County records, which deed of
trust is being assumed by the Grantee herein.
