Dear Mr. Ogle,
Alpine Gardens has made the changes you have requested on the Landscape Plan.
Minimum font is now 10 point or greater. The Wild Plum has been changed as noted on
Landscape plat
I have an attachment showing our method of preparing and planting the Open Space. The
method for soil preparation and planting of Open Space area was obtained from the Soil
Conservation Department, John Wicke, and from Pawnee Buttes Seed Company.
We didn't indicate the requirement of burning the Open Space, because we will not be
intentionally burning the Open Space. The risk from burning 35 acres next to residential
properties is not acceptable, especially to the Eaton Fire Department. Also, this type of
planting will not need burning.
As mentioned at the Public Hearing of the County Commissioners, we have two shares of
Larimer-Weld irrigation water to irrigate the Open Space. This will provide irrigation
water from the Poudre River and is considered"River Water". The historic delivery for
this water starts in early spring and has run through the end of July. Most years Larimer-
Weld is through running by the middle to end of June. Our planting for the Open Space
takes this into consideration.
Our Landscape plan shows how the vegetation, trees, shrubs, and ornamentals will be
watered by a drip system. The drip irrigation water will come from one of the residential
water taps (Lot 5 or 6). There will be a separate water meter beyond the residence and at
the start of the drip line. The water used for irrigation will be metered and the HOA will
pay for the usage from this meter. According to irrigation contractors,the usage will be
minimal. Each plant will have the appropriate emitters to provide adequate water.
Although we intended to use a species (Wild Plum)that "suckers"to increase the visual
buffer to the west side of Appaloosa Acres Estates, we did change species to the
Caragana(caragana arborescens) shrub. The Caragana size is 8-12 feet high and the
spread is 5-8 feet.
We also changed the type of rose we well be planting at the entrance. We will be using
"rosa fubiginosa" in place of the "rosa rugosa". The "rosa f." does not sucker.

Our Covenants will require two Austrian Hills pine trees be planted at the rear of each
lot. We will also be installing a two rail white vinyl fence on the exterior perimeter of the
lots, at our expense.
Concerning your comment about our orientation of the lots, so the front of the homes face
west, we have developed a way we can use the same lot configuration as first presented
to you.
First of all, Commissioners Jerke and Guile in there motion to approve our zone change
did not make a requirement to turn lots outward. I ask Commissioner Jerke after the
meeting if his comments meant for us to put a road around the perimeter of the lots and
face the homes outward were a requirement for his vote of approval. His response to me
was his comments were made as a suggestion and not a requirement for the zone change
approval. Commissioner Guile's vote for approval was not conditioned upon Jerke's
suggestion.
Kim, if you would like, I will ask Commissioners Jerke, Guile, Long, and Masden write
you a letter explaining their thoughts on voting for the approval of our zone change
request. The audio tape of the hearing provides a very good record of the meeting.
We believe we have provided a unique way to provide a compatible and ascetically
pleasing view for the neighbors to the west. As you can see from the Landscape Plan, we
have provided a two-rail, vinyl fence along the property line, around the perimeter of the
property. We have provided shrubbery and trees, which will provide a visual buffer
between Gilbaugh's Appaloosa Acres and our project.
Within the covenants, all residences will have to have fifteen percent of the back of the
home in stone or brick, which will match the front of the homes. The fifteen percent
excludes roof, windows and doors. We will have a requirement of"gridded and wrapped"
windows in front and back of home. There will be a requirement of a covered patio (100
square feet) and this will be roof coverage, or we will require a deck and arbor if no roof
covered patio. One out building will be allowed, not to exceed 800 square feet, within
the building envelope. Out building material will have to be of the same building
material as the home. The back of the out building will have to have windows and stone,
the same as the home. The vents on the roofs will be painted the same color as the
singles. There will be side loaded garages. Basically, the rear of the homes will look like
the fronts.
Also, I believe when you see our Covenants, some of your concerns about the visual
appearance of the rear view of the homes will be mitigated. We have pictures of similar
properties which show our fencing, landscaping, and how the rear of the properties will
be viewed. We would like to show you these pictures at your convenience.

Staff review of the Landscape Plan prepared by Alpine Gardens dated July 15, 2004 for the
above referenced projects generated the following comments:
The minimum font for the drawings associated with a Landscape Plan is 10 point, no
exceptions. All type shall be of the same size for callouts and notation.
The materials indicate that a Dryland Pasture Seed will be placed in all areas not identified as
building sites. There is no indication of the seed mix by specie or percentage. Further, the
seed source has not been identified nor has the method of planting, including the rate. Staff
requests written evidence of this information, including the rate of seed application if drilled and/
or the rate of application if broadcast. Further, given the exposed and disturbed site conditions,
staff requests additional information on site preparation.
The applicant's descriptive sketch materials indicate that the pasture will be mown 2-3 times
each calendar year. The applicant's text does not indicate if the pasture will be burned to
promote a healthy seed climate reflective of the proposed on-site conditions.
The applicant's descriptive sketch materials indicate that the pasture will be irrigated with water
that may or may not be available through each growing season. Additional information is
requested to determine if there is adequacy of water available. Although the applicant's
materials indicate the plant materials are xeric in habitat, there remains a requirement of
irrigation for each plant and each species. Staff further requests additional information on the
source of the irrigation water, including the statement specific to the utilization of residential
water taps.
Staff notes that the proposed plant material to be placed west of the proposed lots will be
comprised entirely of American Plum, a plant identified as a large shrub with a height and width
span of approximately ten feet under ideal conditions. Given the exposure of the site, the
likelihood of the plant reaching this proportion is remote and highly unlikely. This plant species
has thorns which may create a "garbage collector" appearance specific to wind blown debris.
Further, this plant has a several suckering habitat which tends to create a nuisance appearance
condition.
Staff further notes that the applicant is proposing Rosa rugosa a highly invasive plant material
under certain conditions. Soil type, exposure and acidity all play important factors with this
species. It is suggested that another plant material be utilized in lieu of this selection.
The Board of County Commissioners Resolution and Minutes suggested that efforts be made to
address the issues of screening by the surrounding property owners, specifically the neighbors
west of this development. Page 6, paragraph 5 (paragraph after the Recess) of the Hearing
Certification, states "Commissioner Jerke stated most of the concern of neighbors could be
mitigated by changing the front and back yards, with a road looping around them, and if
approved today, suggested Mr. Cliff consider a different layout prior to Final Plan." "...Mr Clifford
Clift stated they will be amenable to whatever needs to be done." Further, on page 7 paragraph
2 states "Commissioner Geile stated he also feels it appropriate, as Commissioner Jerke
suggested, to turn the lots around. Therefore, he will be in support of the application.
The Landscape Plan reviewed by staff does not indicate that the direction of the Board was
followed. It is strongly suggested that the applicant review the orientation of all lots prior to
submitting the Final Plat for processing by this office and prior to the land use hearings by both
Planning Commission and the Board of County Commissioners.
The applicant may desire to redesign the site to address this issue relative to the selection and
location of all plant material associated with this development.
The bus pull-off and mailbox location is not accurately delineated on this plan. It is requested
that future plan reviews include accurate information.

We have reviewed the above applicant's Change of Zone diagram dated June 1.1, 2004. The
placement of the bus stop pickup structure is acceptable to us. At a minimum, the District would
like a 5' x 10' structure placed at that site.
We anticipate reviewing additional documents the Planning Department will send to us prior to
final approval by Weld County.

LANDSCAPE MAINTENANCE PLAN
OPEN SPACE
Native dry land grass will be planted. Mowing will be two to three times per year.
Irrigation will be from irrigation water. OPEN SPACE will be irrigated two to three
times per year, as availability of water allows.
OPEN SPACE trees and shrubs will be irrigated by drip system. Also, entrance area will
be irrigated with drip system. Vegetation will be xceriscape types of plants.
Drip system water will be from one or two of the residence water taps. There will be a
separate meter used to monitor the water usage and charged to the HOA as an expense.
Please see attached plat for types of plants, trees, and shrubs being used in PUD.

submitted Change of Zone Plat
Dear Mr. Clift:
Thank you for the opportunity to review your proposed submittal. Based on the resolution as adopted and approved
by the Board of County Commissioners on April 24, 2004, the following information or changes need to occur to the
proposed plat in order to be consistent with the resolutions:
1. The Change of Zone plat shall meet the requirements of Section 27-9-20 and should be amended to include the
following: Primary and secondary septic envelopes shall be designated on the plat. Each envelope must meet current
minimum setbacks as specified in the Weld County Individual Sewer Disposal Regulations.
2. The landscaping plan and maintenance schedule as approved by the Department of Planning Services shall be
submitted. The plans shall adhere to the requirements of Section 27-6-60 of the Weld County Code. The landscape
plan shall be delineated in a legible font for all cut-outs,with plant materials listed to include botanical names,common
names, species as applicable, and size of materials. The location of the subdivision sign needs to be identified
specifically on the plat. Currently only a reference to a monument sign is listed.
3. Plat Change Requirements: the plat shall be amended to include
/"The submittal size for the plat should be 24 x 36 inches.
The property boundary lines shall be identified in a single, black, non-hatched line.
(C. he location of the present bus stop does not meet the intent of the school district's referral dated January 8,2004
and shall be removed.

D. Evidence shall be supplied from the local postal authority that the location of the mailbox pull out has been agreed
upon.
A. The vicinity map needs to be a 1 to 2000 scale.
'The street cross section needs to be scaled.
/General notes and Corrections:
Item A. contains two typographical errors.
,Item F. contains an error in grammar.
/Item G. contains a punctuation error.
D. Item S. needs additional spacing in the sentence.
E. Item W. has the incorrect section citation. It should be Section 27-8-50, with the addition of a comma in the
sentence.
F. The right to farm language needs to be modified to include the word 'people in place of"children".
G. The legal description is incorrect and a complete legal description needs to be included. It should be referenced
as Lot 15, 4th plat of Gilbaugh Appaloosa Acres, being the W2 SW4 of Section 33, T7N, R65W of the 61h P.M.,
Weld County, Colorado. Delete the additional information in the sentence.
H. The signature block for acceptance by the Department of Planning Services Director needs to be excluded.
Once you have made the above changes, please submit two additional copies and we would be happy to review this
again. Furthermore, prior to recording the plat, condition 3 A. needs to be met. Also please submit a digital file of all
drawings associated with the Change of Zone application materials.

By this letter, I am recusing myself from participation in the handling of applications in land use
case numbers PK-1020, PZ-1020 and PF-1020. My recusal will include refraining to participate
in any discussions with other Department of Planning Services' staff members, consultants and
associated referral agencies regarding the cases. The applications have been submitted by
Bruce Johnson and Clifford Clift.
I am submitting this letter of recusal at this early date in order to inform supporters and
opponents that while these cases are being processed by the Department of Planning Services
and considered by the Weld County Planning Commission and Board of County
Commissioners, I will not be privy to case specific information, other than that which is normally
open to the public.
I own property which is located nearby the subject properties of these cases. I may ask to
