The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
Use by Special Review, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and
requirements are as follows:
COMMENTS:
WCR 19 is designated on the Weld County Road Classification Plan (FHU) as a collector status road, which
requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. The road is
maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23,
Article Ill, Section 23-3-50, the required setback is measured from the future right-of-way line.
--`cur most recent average daily traffic count (ADT) reflects 1900 vehicles taken in 2002. .
REQUIREMENTS:
Access: The applicant is proposing to utilize the existing access, which appears to be a shared access with
Lot B of RE-2313. Utilize the existing shared access point as no other additional accesses shall be granted to
the parcel.
Off-Street Parking: Off-street parking including the access drive shall be surfaced with gravel or the
equivalent and shall be graded and drained to prevent drainage problems. There will be no parking or staging
on WCR 19. Utilize the on-site parking only.
Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent property damage of the
type generally attributed to run-off rate and velocity increases, diversions, concentration, and/or unplanned
ponding of storm run-off.

Environmental Health Services has reviewed this proposal for storage of vehicles and
equipment associated with a tree trimming business. We have no objections to the
proposal, however, we do recommend that the following conditions be part of any
approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
Environment.
2. The applicant shall provide current evidence that the facility has an adequate
water supply.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement
plan at all times.
5. This facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in 25-12-103 C.R.S., as amended.
6. Adequate handwashing and toilet facilities shall be provided.
7. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
8. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
9. If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
10.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

A Site Specific Development Plan and special Review permit for a Use by Right or Accessory Use in the
Industrial Zone District (storage of vehicles and equipment associated with a tree trimming service) in the A
(Agricultural Zone District.)
1. A building permit shall be obtained prior to the construction of any new building.
2. A plan review is required for each building for which a building permit is required. Plans shall include a floor
plan. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans
are required when applying for each permit. Provide a Code Analysis Data sheet provided by the Weld County
Building Department with each Building permit application.
d. Buildings shall conform to the requirements of the various codes adopted at the time of permit application.
Currently the following has been adopted by Weld County: 2003 International Building Code; 2003 International
Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; and the 2002 National
Electrical Code and Chapter 29 of the Weld County Code.
4. Each building will require an engineered foundation based on a site-specific geotechnical report or an open
hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a
Colorado registered engineer.
3 The building (if built)will probably be classified as a S-2 vehicle and equipment storage occupancy. Fire
resistance of walls and openings, construction requirements, maximum building height and allowable areas will
be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning Ordinance.
6. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of
determining the maximum building size and height for various uses and types of construction and to determine
compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall be
measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset
and setback requirements. Offset and setback requirements are measured to the farthest projection from the
building.

Subject: USR-1482 Referral
Upon review of my case files and computer, a Zoning Violation (VI-0400027)was noted. The violation was
initiated as a result of a commercial tree trimming operation without a Use by Special Review(USR)permit.
The property owner has since submitted this Use by Special Review (USR-1482) application to the
Department of Planning Services.
Due to the prompt response of the property owners,this case has not been presented to the Board of County
Commissioners through the Violation Hearing process.
Should this Use by Special Review(USR-1482)application be approved,the plat shall be recorded within 30
days of approval to avoid revocation proceedings. As soon as the plat has been recorded,this violation will be
closed.
Should this Use by Special Review (USR-1482) application be denied, the applicant shall have 30 days to
remove all commercial equipment and associated activity prior to proceeding with the violation process.

Dear Chris:
The City of Dacono has reviewed the Thompson request to store vehicles and equipment
for a tree service operated from a home in an Agriculture District. The vehicle and
equipment storage is to be behind tree rows about 400 feet west of WCR 19. Under those
conditions the City of Dacono has no objection to the Special Review Use permit.
The City does not oppose this application subject to the property owners completing the
following conditions:
1. The property owners agree to annex the property to the City of Dacono
when the property is eligible for annexation under applicable City and
State laws and regulations.
2. The property owner dedicate for public right-of-way 40 feet west of the
centerline of Weld County Road 19.
